Into The Blue Scuba, LLC Student Policy

Section 1 - Student Agreement

 I understand that my training course is non-refundable.

I understand that I have 1 year from my registration date to complete my training course.

I understand that I must satisfactorily complete all course requirements to receive certification.

I will complete all required paperwork as specified by the instructor.

I will complete the assigned learning requirements as specified by the instructor.

I will complete all knowledge development work as specified by the instructor.

I will bring a signed copy of the eLearning completion certificate (If applicable) to the instructor.

I will follow all course procedures set forth by the instructor.

I will follow all instructions and directions given by the instructor or the instructor’s assistants.

I will ask questions if I do not understand.

I will be on time and prepared for every training session.

I understand that I cannot use any type of photography equipment during in water training.

I understand that if I do anything deemed unsatisfactory or dangerous by the instructor or the instructor’s assistants, I will be removed from the training course and will not receive a refund.

I will supply my own scuba quality personal equipment. (Mask, snorkel, fins, and boots)

I understand that I am supplied with SCUBA equipment (BCD, reg. set, and gages) for training and that it is highly recommended that I purchase my own SCUBA equipment that I will be diving in after certification, so I can learn in it and become comfortable with it.

I understand that if I already own, choose to purchase my personal equipment, or SCUBA equipment from an outside source it must be approved by the instructor prior to use. I also understand that if the forementioned equipment has a malfunction or failure during training I will have to either rent equipment at an additional cost (If available) to continue or I will have to reschedule my training and rescheduling fees will apply.

I understand that If I am participating in any dive course above open water diver the only equipment supplied are cylinders, air fills, and weights. I must provide all additional required equipment for the training course (Rental available) If I own equipment and it’s from an outside source it must be approved by the instructor prior to use. I also understand that if the forementioned equipment has a malfunction or failure during training I will have to either rent equipment at an additional cost (If available) to continue or I will have to reschedule my training and rescheduling fees will apply.

Section 2 – Reschedules: (Confined & Open Water Training)

10 days from the date of scheduled training there will be a $100.00 rescheduling fee.

7 days from the date of scheduled training there will be a $150.00 rescheduling fee.

48 hours from the date of scheduled training there will be a $200.00 rescheduling fee.

24 hours from the date of scheduled training there will be a $250.00 rescheduling fee.

Less than 24 hours from the start of scheduled training there will be a $300.00 rescheduling fee.

A no call no show on the day of training will be considered a cancellation from the training program and no refunds will be given.

For a rescheduling to be valid it must be confirmed by an ITBS employee via phone (No voicemail, email, or texts) and rescheduling fees will be collected at the time of notification to reschedule. If payment of fees is not received at the time of notification to reschedule it will be considered a withdraw from the training program and no refunds will be given.

Into The Blue Scuba, LLC understands that things do happen, and we are willing to consider reasonable unforeseen events. (Examples: Medical issue, Military deployment, Family death – Documentation will be required) However, the student must also understand that we have limited spots available in each training course and a no show causes us a lost opportunity to add another potential diver and revenue.

Swimming Ability Information

I understand that my instructor may advise that I need training on swimming, swimming with a mask, snorkel, and fins or training on water treading/floating. If this is determined this must be completed before I can start my SCUBA course.

*If you have not been swimming in the last 12 months or have never been swimming while using a mask, snorkel, and fins, please contact us to schedule a swim/water tread evaluation. (*Additional cost)

Swimming Pool Liability Release

For good and valuable consideration, including but not limited to being allowed to participate in scuba diving/ swimming and/or utilize the swimming pool at Into The Blue Scuba, LLC. The receipt and sufficiency of such consideration is hereby acknowledged, the undersigned, on behalf of myself, my minor children identified below, my and their heirs, executors and assigns (hereinafter collectively referred to as the “Participant”), do hereby release and discharge Glenn E Mikos, Sandy S Mikos, and Into The Blue Scuba, LLC their shareholders, officers, employees, agents, legal representatives, successors and assigns (hereinafter the “Released Parties”) from any claims, demands, actions, or judgments of any kind related to my and/or my minor children’s participation in the scuba diving/ swimming program, use of the swimming pool, and access to the facility at Into The Blue Scuba, LLC. Such release and waiver shall be valid from the time of execution of this document until such time as I revoke this document in writing. Until such revocation, this release and waiver shall apply to any past, present, or subsequent event, whether known or unknown, without regard to the cause or causes thereof, or the negligence of gross negligence of any party including the Released Parties.

The Participant does hereby agree to indemnify and hold harmless the Released Parties from any and all liability, loss, damage, or expense, including reasonable attorney fees that they may incur as a result of any injury to person or property, claim, demand, or litigation arising out of Participants use of the swimming pool or participation in the scuba diving/swimming program. Such indemnification obligation shall accrue regardless of any negligence or gross negligence on the part of the Released Parties.

Participant hereby represents and warrants that he/she has the legal authority and capacity to execute this document; that the Participant has the mental capacity and physical fitness to engage in strenuous activity such as scuba diving/ swimming; and that Participant has familiarized themselves with the facility and the pool. It is expressly agreed that the Participant is undertaking participation in the scuba diving/ swimming program and/or use of the pool at his/her own risk. Parents acknowledge that they are solely responsible for the supervision and safety of their minor child.

Equipment Rental Agreement

THIS AGREEMENT is entered into between Into The Blue Scuba, LLC and

, for the rental of scuba, cylinder, skin diving equipment, and/or any other equipment provided by Into The Blue Scuba, LLC. This AGREEMENT is a release of my rights and the rights of my heirs, assigns or beneficiaries to sue for injuries or death resulting from the rental and/or use of this equipment. I personally assume all risks of skin and/or scuba diving, whether foreseen or unforeseen, related in any way to the rental and/or use of this equipment.

Non-Agency Disclosure and Acknowledgment Agreement

I understand and agree that PADI Members (“Members”), including Into The Blue Scuba, LLC and/or any individual PADI Instructors and Divemasters associated with the program in which I am participating, are licensed to use various PADI Trademarks and to conduct PADI training, but are not agents, employees or franchisees of PADI Americas, Inc, or its parent, subsidiary and affiliated corporations (“PADI”). I further understand that Member business activities are independent, and are neither owned nor operated by PADI, and that while PADI establishes the standards for PADI diver training programs, it is not responsible for, nor does it have the right to control, the operation of the Members’ business activities and the day-to-day conduct of PADI programs and supervision of divers by the Members or their associated staff. I further understand and agree on behalf of myself, my heirs and my estate that in the event of an injury or death during this activity, neither I nor my estate shall seek to hold PADI liable for the actions, inactions or negligence of Into The Blue Scuba, LLC or the instructors and divemasters associated with the activity.

Liability Release and Assumption of Risk Agreement

I understand and agree that Into The Blue Scuba, LLC, and its employees, owners, officers, contractor, assigns or agents (hereinafter referred to as “Released Parties”), shall not be held liable or responsible in any way for any injury, death or other damages to me, my family, estate, heirs or assigns which may occur as a result of the rental and/or use of the equipment, or as a result of product defect, or the negligence of any party, including the Released Parties, whether passive or active.

I hereby acknowledge receipt of the equipment designated in this form, and, if any of this equipment is to be used for scuba diving I affirm I am a certified scuba diver or student diver in a scuba diving course/program under the supervision of a certified scuba instructor.

I affirm it is my responsibility to inspect all of the equipment and acknowledge it is in good working condition. I affirm that it is my responsibility to check both the quality and quantity of gas in any scuba tanks. I acknowledge that I should not dive if the equipment is not functioning properly. I will not hold the Released Parties responsible for my failure to inspect the equipment prior to diving or if I choose to dive with equipment that may not be functioning properly.

I understand that skin diving and scuba diving are physically strenuous activities, that I will be exerting myself during these activities, and that if I am injured as a result of heart attack, panic, hyperventilation, drowning or any other cause, that I expressly assume the risk of said injuries and that I will not hold the Released Parties responsible for the same.

I agree to reimburse the Dive Center/Resort for the loss or breakage of any and all equipment at the current replacement value and to also pay for damages incurred while transporting the equipment. I agree to return the equipment in clean condition and to pay a cleaning fee if not returned cleaned.

I further state that I am of lawful age and legally competent to sign this liability release, or that I have acquired the written consent of my parent or guardian. I understand the terms herein are contractual and not a mere recital, and that I have signed this Agreement of my own free act and with the knowledge that I hereby agree to waive my legal rights. I further agree if any provision of this Agreement is found to be unenforceable or invalid, that provision shall be severed from this Agreement. The remainder of this Agreement will then be construed as though the unenforceable provision had never been contained herein.

I understand and agree that I am not only giving up my right to sue the Released Parties but also any rights my heirs, assigns, and beneficiaries may have to sue the Released Parties resulting from my death. I further represent I have the authority to do so and that my heirs, assigns, or beneficiaries will be estopped from claiming otherwise because of my representations to the Released Parties.

, BY THIS INSTRUMENT AGREE TO EXEMPT AND RELEASE THE RELEASED PARTIES AND ALL RELATED ENTITIES AS DEFINED ABOVE, FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH AS A RESULT OF RENTING AND/OR USING THE EQUIPMENT, HOWEVER CAUSED, INCLUDING, BUT NOT LIMITED TO PRODUCT LIABILITY OR THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. I HAVE FULLY INFORMED MYSELF AND MY HEIRS OF THE CONTENTS OF THIS NON-AGENCY DISCLOSURE AND ACKNOWLDGEMENT AGREEMENT AND LIABILITY RELEASE AND ASSUMPTION OF RISK AGREEMENT BY READING BOTH BEFORE SIGNING BELOW ON BEHALF OF MYSELF AND MY HEIRS.

Photography Release

I give Into The Blue Scuba, LLC, 11874 HWY 36, Covington, GA 30014 and Into The Blue Scuba Dive Club (photographers) the irrevocable right to use my picture and/ or photograph in all forms and media, without restriction as to changes or alterations, for advertising, trade, promotion, exhibition, or any other lawful purposes. I waive any right to inspect or approve the pictures and/ or photographs that may be used in conjunction with them now or in the future, whether that use is known to me or unknown, and I waive any right to royalties or other compensation arising from or related to the use of the pictures and/ or photographs.

I am 18 years of age or the parent/guardian of the participant and am competent to sign this release. I have read this release and waiver and am fully familiar with its contents.
