Training Agreement Assuming Risk, Waiver And Release Of Claims, Agreement Not To Sue And Release Of Likeness 

I have made a voluntary decision to be a participant in a Truffle Dog Company LLC (the “Company”) seminar/ event/ training (the “events”) and to be taught truffle hunting and dog training techniques by the Company. I understand that the Company may take me on to property owned and operated by others (the “Owner/Agent”) or public property. 

I understand and agree that hunting truffles and mushrooms involves risks including, but not limited to, the risk of personal injury, and/or personal property damage; such risks may be generated by the action or inaction of any employees, representatives, property, or agents of the Company or Owner/Agent; or may occur in a truly limitless variety of ways. I acknowledge that dogs are unpredictable animals with their own will and drives, and therefore, regardless of training, handling, or environmental circumstances, the Company cannot protect against every potential injury, risk, or accident to myself, to other persons participating in the training, or on the property where the training is taking place, or to dogs. These may include dog bites and the responsive actions and complications that arise from them, and I understand and acknowledge that such risks are inherent and cannot be eliminated. I voluntarily expose myself and my canine to such risk by accompanying, or participating in, truffle hunting with the company.

I agree that I will be responsible for my conduct and others accompanying me (including minors) at all times. I agree to indemnify and hold harmless the Company, its directors, officers, members, managers, employees, agents, sponsors, organizers, volunteers and other representatives (Company Personnel), from any and all claims of injury (including death), loss, cost, expenses, or damage to persons, or property caused by the acts or omissions of you, and any other persons accompanying you, including any minor children, during the course of training or related activities. This provision applies whether the claims are made by you, members of your family, your accompanying guests, the Company or third parties.

I agree and acknowledge the consumption of wild fungi is widely recognized as an inherently dangerous activity that can result in serious illness, permanent disability, or death. Even mushrooms that are well known to be non-toxic for the great majority of people can potentially cause allergic reactions and other idiosyncratic symptoms in certain susceptible individuals. These symptoms may be caused or worsened by undercooking, overindulgence, or by drinking alcohol. Every person should cautiously test their own tolerance for unfamiliar species of wild mushrooms.

I acknowledge that collecting wild mushrooms commonly involves strenuous physical exertion in rugged, high-altitude wilderness locations, and entails many known and unknown risks to human health and life. By way of example only, these risks include but are not limited to slips and falls; weather-related hazards such as heat stroke, hypothermia, exposure, and lightning strike; infectious diseases; rockfall or avalanche; altitude sickness; allergic reactions; drowning; penetrating or lacerating injuries from tools, branches, or other features of the local flora and terrain; and insect bites and stings, snakebites, and other wild animal attacks. 

These serious injuries or illnesses may occur in areas remote from medical care, and the availability of emergency medical services or emergency transportation to medical facilities cannot be assured.

Knowing these risks, I hereby agree to voluntarily assume all risks, and to release and hold harmless the Company, Owner/Agents, and their respective directors, officers, representatives, employees, agents, and all other associated individuals which/who, through negligence, might otherwise be liable for my damages. I understand by executing this agreement, I agree not to sue the Company or Company Personnel for any injury resulting to myself or my personal property arising from or in connection with my participation in any Company Events on Owner/Agent property or public property.

I grant the Company and its representatives and employees the right to take photographs or video of me and/or my pet, and to copyright, use and publish the same in print and/or electronically. I understand that the Company may use such images with or without associating names thereto. I further waive any claim for compensation of any kind for the Company's use or publication of images of me and/or those of my minor children (if applicable).

I understand and agree this assumption of risk, release, hold harmless, and release of likeness shall be binding on me, my heirs, personal representatives, successors and assigns.

THE UNDERSIGNED HAS READ THIS AGREEMENT ASSUMING RISK OF INJURY, WAIVER AND RELEASE OF CLAIMS, AGREEMENT NOT TO SUE, AND RELEASE OF LIKENESS AND FULLY UNDERSTANDS ITS CONTENTS; IS AWARE THAT THIS IS A WAIVER OF LIABILITY AND HAS SIGNED THIS VOLUNTARILY.

NOTE: THE SIGNATURE OF A PARENT OR GUARDIAN IS REQUIRED FOR THOSE UNDER THE AGE OF EIGHTEEN (18).
