Nuiqsut Spur Road Access Form

The Spur Road is a private road built and maintained by Kuukpik on land owned by Kuukpik Corporation (Kuukpik). The Spur Road connects the Village of Nuiqsut to oil and gas industry infrastructure. All individuals who want to use the Spur Road MUST obtain advance approval from Kuukpik. This applies to every individual within a company or vehicle, even if other members of your party or company have already received permission to use the Spur Road.

The applicant may not use the Spur Road until he or she receives confirmation from Kuukpik that all three forms have been completed and approved. Please monitor your inbox for a confirmation email from Kuukpik before using the Spur Road.

Spur Road Use Rules

1. The Spur Road is a private road located on Kuukpik Corporation-owned land. Use is by permission of Kuukpik Corporation only and is a privilege, not a right. Use privileges may be lost or suspended for violation of these Rules. Kuukpik may terminate a user’s use privilege at any time for any reason.

2. By using the Spur Road you accept that such use is at your own risk and that Kuukpik is not liable or responsible for any accidents, personal injuries, property damage, death, or for unforeseen circumstances or events that may occur while using the Spur Road.

3. These Rules apply to the Spur Road only.

4. Kuukpik may close or restrict access to the Spur Road at any time and for any reason.

5. Permanent Nuiqsut residents and Kuukpik shareholders may use the Spur Road for subsistence and recreation only, and may do so ONLY AFTER obtaining permission from Kuukpik by signing (1) the Waiver of Liability and (2) these Rules.

6. Nuiqsut residents and Kuukpik shareholders who want to use the Spur for purposes other than subsistence or recreation (such as for business, commercial, or other uses for themselves or on behalf of a public or private employer) must obtain written approval from Kuukpik before such use by submitting a Spur Road Access Form to Kuukpik.

7. All other potential Spur Road users (including federal, State, or North Slope Borough employees, and CPAI personnel and their contractors) must sign (1) the Waiver of Liability and (2) these Rules prior to Spur Road use. After providing these 2 documents, these potential users must submit a Spur Road Access Form IN ADVANCE of EACH planned use and obtain Kuukpik’s written authorization.

8. For any Spur Road use or user not specifically addressed in these Rules, the potential user must contact the Kuukpik office in Nuiqsut or Anchorage to obtain written approval of use.

9. Spur Road users are not allowed to travel on the Spur Road with passengers who do not have Kuukpik’s permission to use the road. Everyone using the Spur Road (drivers and passengers) must have Kuukpik’s permission and sign the Waiver of Liability and Road Rules BEFORE using the Spur Road. Drivers are responsible for the actions of all passengers in their vehicle.

10. All drivers are required to present a valid driver’s license or government ID to Kuukpik (or Kuukpik’s designee) when signing the Waiver of Liability and these Rules.

11. ATV/snowmachine users, and those who will be vehicle passengers only must also sign the Waiver of Liability and these Rules. If an ATV/snowmachine user or non-driver does not have a photo ID, he or she must be known to Kuukpik to be a permanent Nuiqsut resident or Kuukpik shareholder.

Individuals under the age of 18 must have a parent or guardian sign the Waiver of Liability and these Rules.

12. Spur Road users must follow all rules set by Kuukpik and must comply with all road closures and safety checkpoints established by Kuukpik.

13. Travel on the Spur Road is permitted only when weather conditions are suitable. This is a self-policing restriction. Kuukpik does not expect to have the staff or the budget to routinely open or close the Spur Road based on weather or Spur Road conditions. All travel is at the user’s own risk.

14. It isn’t Kuukpik’s or Nanuq’s job to assist vehicles that (1) get stuck in the snow on the Spur Road or drive off the road surface, (2) breakdown, or (3) stop for other vehicle problems or driver error. The driver is responsible for obtaining any necessary assistance from other authorized Spur Road users.

Tundra damage caused by driving off the road surface will be reported to the North Slope Borough by Kuukpik. The driver will be responsible for such damage. All off road incidents with cars and trucks must be promptly reported to Kuukpik at 907-480-6220.

15. Car and truck drivers must be licensed and carry their valid driver’s license while driving on the Road.

16. 25 miles per hour is the speed limit for the Spur Road for all vehicles (e.g. cars, trucks, ATVs, snowmachines, etc.).

17. All vehicles - cars, trucks, ATVs, and snowmachines - must adhere to all signs posted on the Spur Road (e.g. reduced speed in construction or maintenance areas, etc.).

18. Do NOT pass any equipment operating on the Spur Road (e.g. snow blowers, compactors, graders, water trucks, etc.) until the equipment operator has acknowledged your presence and signaled that it is safe to pass.

19. No littering or disposal of any trash, pollutants, or other materials (including cigarette butts) is allowed on the Spur Road.

20. Spur Road users must not disturb or tamper with any equipment that may be present along the Spur Road or next to the Spur Road.

21. Stopping on the Spur Road is generally prohibited. However, brief stops for subsistence purposes (e.g., dropping off a hunter, retrieving game, etc.) are allowed. Cars and trucks must turn on their flashers to signal that they are stopped. ATVs and snowmachines must pull to the edge of the Spur Road to stop for subsistence purposes.

22. Hunting from, but not on, the Spur Road is permitted. The hunter must be off the driving surface of the Spur Road while shooting. The hunter must not shoot from the inside of a vehicle or shoot across the Spur Road.

23. All ATV and snowmachine operators and passengers must wear helmets while on the Spur Road.

24. ATVs must stay on the Spur Road. ATVs are not allowed to access the tundra from the Spur Road.

25. Snowmachines may be used on the Spur Road only after a sufficient new snowfall and before plowing of the Spur Road. This restriction does not apply to crossing the Spur Road on a snowmachine.

26. Snowmachines crossing the Spur Road are responsible for ensuring no traffic is present prior to crossing.

27. Kuukpik has complete discretion to change these Spur Road Rules at any time.

Waiver of Liability for Spur Road Use and Acknowledgement

The Spur Road is a private road built and maintained by Kuukpik Corporation on land owned by Kuukpik.

Use of the Spur Road by Nuiqsut residents and shareholders is a privilege, not a right. To use the Spur Road, you must follow Kuukpik’s rules.

Two vehicle accidents occurred on the Spur Road before it was open for use. In both cases, the drivers did not have Kuukpik’s permission to use the road. One accident involved a visitor to Nuiqsut. These accidents proved to Kuukpik that all users of the Spur Road must (1) strictly follow Kuukpik’s Rules for Spur Road Use, (2) use the Spur Road at their own risk and be responsible for their own actions, and (3) agree not to sue Kuukpik. Kuukpik believes the Spur Road will benefit Kuukpik shareholders and Nuiqsut residents.

Kuukpik does not want its efforts to help the community end up creating lawsuits against Kuukpik.

Nuiqsut residents and shareholders may use the Spur Road, but only those who follow the Spur Road Use Rules and agree not to sue Kuukpik. Everybody, including Nuiqsut residents and shareholders, must sign this Waiver before using the Spur Road. If you don’t sign this Waiver, you can’t use the Spur Road---it’s as simple as that.

Please carefully read the terms below and the attached Rules for Spur Road Use. Sign and date this Waiver in the space below if you agree to all these terms.

1. I have read and understand the Rules for Spur Road Use.

2. I understand that I do not have a right to use the Spur Road. Spur Road use is not an essential service and all users must have Kuukpik’s permission to use the Spur Road.

3. I agree to follow all the Rules for the Spur Road and understand that Kuukpik can change these rules in the future. If I break the Rules Kuukpik may revoke my permission to use the Spur Road.

4. I understand that using the Spur Road without permission is trespassing.

5. I will not transport passengers on the Spur Road who do not have Kuukpik’s permission to use the Spur Road. I agree that I will be held responsible for the acts, conduct, or omissions of my passengers.

6. I understand that I use the Spur Road entirely at my own risk – Kuukpik is not responsible.

7. I understand that the Spur Road is not designed or maintained according to (a) public road standards, or (b) for my particular use of the road. I understand that whatever maintenance Kuukpik performs on the Spur Road may be inconsistent. For example, Kuukpik might clear snow drifts one week, but not during a different week. The edge of the road might be marked in some places and times but not others. The Spur Road might be damaged without any sign saying that it is damaged. Kuukpik may maintain the Spur Road worse than the government maintains public roads. As a result, the Spur Road may be more dangerous than public roads I am used to.

8. I understand that Kuukpik might have designed or constructed the Spur Road to lower standards than are used on public roads. It may be narrower than public roads. As a result, using the Spur Road might be dangerous regardless of how it is maintained.

9. I understand that other people who use the Spur Road might break the Rules. Other people’s actions may make the Spur Road even more dangerous.

10. I understand that different types of vehicles - heavy equipment, buses, four-wheelers, snowmachines, etc. - may be on the Spur Road, not just cars and pickups.

11. If I get stuck on the Spur Road or my vehicles runs off the road, it is my responsibility to retrieve my vehicle. Kuukpik is not promising to come out to help me, and Kuukpik is not responsible for retrieving my vehicle.

12. I understand that the Spur Road is NOT patrolled by NSB Public Safety Officers. Kuukpik MAY patrol the Spur Road and establish safety checkpoints to ensure users have Kuukpik’s permission and are following the Rules. I agree to allow Kuukpik and its designated security personnel to search my vehicle if it is on the Spur Road.

13. I will carry my valid driver’s license while operating a car or truck on the Road.

14. This Waiver of Liability will continue to apply to my previous Spur Road use even if I stop using the Spur Road. This means the Waiver and Release continue to apply to any accidents, injuries, death, or property damage related to my use of the road. I can’t terminate this Waiver by terminating my use of the road.

15. I agree that I will not sue Kuukpik, or allow anyone else to sue Kuukpik for me, if my property is damaged, if I get injured, physically or psychologically, or killed using the Spur Road.

16. I cannot and will not claim any right to use the Spur Road, such as, but not limited to, an easement.

17. I agree that Kuukpik can terminate my permission to use the Spur Road at any time.

18. I understand that following these Rules and waiving my rights against Kuukpik Corporation is a condition of using the Spur Road.

19. Release from Liability and Waiver of Rights:

As consideration using the Spur Road, I release and promise to defend, hold harmless, and indemnify Kuukpik and its managers, officers, employees, insurers, volunteers, agents, contractors, and representatives (collectively “Releasees”) from any and all actions, claims, or demands that I, my assignees, heirs, guardians, next of kin, spouse, legal representatives, or third parties now have, or may have in the future, relating to any physical or mental injury, death, or property damage related to my use of the Spur Road. I have these obligations even if such action, claim, or demand also relates to or alleges (i) Releases’ sole or partial negligence or other acts or omission connected to the Spur Road or (ii) the condition or design of the Spur Road, resulting from negligence or otherwise. I further agree that I, my assignees, heirs, guardians, next of kin, spouse and legal representatives will not make a claim against, sue, or attach the property of any Releasee in connection with any of the matters covered by this Release.

20. Express Assumption of Inherent and Negligently Created Risks:

I accept and assume the inherent risks of using the Spur Road and the risks created by the negligence of Releasees. I assume the risks disclosed above as well as risks that are not disclosed, known and unknown.

I HAVE CAREFULLY READ AND UNDERSTAND THIS WAIVER. IT IS CONTRACT BETWEEN ME AND KUUKPIK THAT RELEASES KUUKPIK FROM LEGAL LAIBILITY. I UNDERSTAND THAT I WILL NOT BE ABLE TO SUE KUUKPIK IF I AM HURT OR KILLED USING THE SPUR ROAD EVEN IF IT IS KUUKPIK’S FAULT.
