GENERAL LIABILITY WAIVER, RELEASE OF CLAIMS, ASSUMPTION OF RISK, AND MEDIA RELEASE

By attending, participating in, volunteering at, traveling to or from, purchasing food from, entering, or otherwise being present at any activity, event, outing, festival, celebration, gathering, trip, game, sport, hike, recreational activity, religious activity, or program organized, sponsored, operated, or hosted by St. John the Beloved & St. Mary Magdalene Coptic Orthodox Church (“the Church”), whether on Church property or off-site, I acknowledge and agree to the following:


1. VOLUNTARY PARTICIPATION


I understand that participation in Church and Festival activities is completely voluntary. I choose to participate freely and voluntarily for myself and for any minor child or individual for whom I am legally or reasonably responsible.


2. ASSUMPTION OF RISK


I acknowledge that participation may involve inherent risks including, but not limited to:


• Sports and recreational activities

• Soccer and games

• Bounce houses and inflatables

• Children’s activities

• Outdoor activities

• Travel and transportation

• Parking lot and vehicle-related incidents

• Slips, trips, and falls

• Crowd-related incidents

• Food consumption and allergic reactions

• Weather-related conditions

• Equipment malfunction

• Supervision of minors

• Lost or separated children

• Physical exertion

• Exposure to illness or communicable diseases

• Church-sponsored outings and off-site activities


I voluntarily assume all risks of injury, illness, allergic reaction, emotional distress, property damage, disability, death, or other harm for myself and for any minor child or dependent under my supervision.


3. RELEASE OF LIABILITY


To the fullest extent permitted by law, I release, waive, discharge, and hold harmless the Church and its clergy, officers, board members, volunteers, organizers, staff, sponsors, vendors, contractors, members, representatives, agents, affiliates, and property owners from any and all claims, demands, causes of action, liabilities, damages, losses, costs, expenses, or lawsuits arising from or related to participation in any Church or Festival activity.


This release includes claims arising from ordinary negligence but does not apply to gross negligence or intentional misconduct where prohibited by law.


This release applies to:

• Personal injury

• Illness

• Allergic reactions

• Medical emergencies

• Property damage

• Theft or lost items

• Vehicle incidents

• Participation in activities

• Food consumption

• Child supervision matters

• Recreational equipment usage

• On-site and off-site events


This waiver applies to me and to any minor child or individual for whom I am legally or reasonably responsible.


4. FOOD & ALLERGY DISCLAIMER


I understand that food and beverages served, sold, distributed, or consumed during Church or Festival activities may contain or come into contact with allergens including but not limited to nuts, dairy, gluten, eggs, sesame, seafood, and other allergens.


The Church does not guarantee an allergen-free environment.


I accept full responsibility for any dietary restrictions, allergic reactions, medical conditions, or food-related injuries.


5. MINOR CHILDREN & SUPERVISION


Parents and legal guardians are solely responsible for supervising minors and dependents at all times.


The Church is not responsible for:

• Lost or separated children

• Injuries involving minors

• Child-to-child interactions

• Unsupervised participation

• Injuries from games, inflatables, sports, or activities


6. BOUNCE HOUSES, GAMES, & RECREATIONAL ACTIVITIES


I understand that participation in inflatables, bounce houses, games, sports, and recreational activities involves physical risk, including falls, collisions, and injuries.


Participation is voluntary and entirely at my own risk or the risk of minors under my supervision.


7. PERSONAL PROPERTY


I understand that I am solely responsible for my personal belongings and property.


The Church is not responsible for lost, stolen, or damaged items including but not limited to:

• Bags

• Wallets

• Phones

• Jewelry

• Watches

• Vehicles

• Cash

• Personal equipment


8. PARKING & VEHICLE DISCLAIMER


I understand that parking and traffic areas may be temporary, crowded, volunteer-managed, or outdoors.


I assume all risks associated with entering, exiting, parking, loading/unloading, and operating vehicles during Church and Festival activities.


The Church is not responsible for accidents, theft, towing, vehicle damage, or personal injury occurring in parking or traffic areas.


9. MEDICAL TREATMENT


I authorize Church representatives, volunteers, or emergency personnel to obtain medical treatment for me or any minor child or dependent under my supervision if deemed necessary.


I understand that I am solely responsible for all medical expenses and costs incurred.


10. PERSONAL RESPONSIBILITY & REQUIRED ACCOMMODATIONS


I am solely responsible for managing my own medical conditions, disabilities, limitations, supervision responsibilities, accommodations, equipment, medications, supplies, transportation, and personal support needs, as well as those of any individual under my care.


The Church does not provide medical supervision, personal accommodations, or specialized support services.


11. PHOTOGRAPHY, VIDEO, & MEDIA RELEASE


I grant permission to the Church to photograph, video record, livestream, or otherwise capture my image, likeness, voice, and the likeness of any minor child or dependent under my supervision during Church or Festival activities.


I authorize the Church to use such media for non-commercial promotional, educational, social media, livestream, advertising, or Church-related purposes without compensation.


12. DURATION OF AGREEMENT


This agreement remains in effect for all current and future Church and Festival activities from the date signed and shall continue indefinitely unless revoked in writing by me or replaced by a new waiver issued by the Church.


13. INDEMNIFICATION


I agree to indemnify and hold harmless the Church and all released parties from any claims, liabilities, damages, costs, or expenses arising from:

• My actions

• The actions of minors under my supervision

• Violation of Church or Festival rules

• Damage caused by me or members of my party


14. BINDING AGREEMENT


This waiver is binding upon me, my spouse, family members, heirs, estate, assigns, and legal representatives.


I acknowledge that:

• I have carefully read and understood this agreement

• I understand I am waiving certain legal rights

• I sign voluntarily and without coercion

• This agreement is intended to be as broad and inclusive as permitted under the laws of the State of New Jersey
