Model Agreement

This agreement applies to any and all photographs of the Model and their property (including pets) made by Joe B Photographs on the session date/s covered by this agreement, and to all edits, versions and reproductions of such photographs. 

The Model consents and authorizes the use of these photographs by Joe B Photographs and their authorized representatives, licensees, successors, and assigns for any purpose whatsoever including without limitation : sale, reproduction in all media, publication, display, broadcast and exhibition for promotion, advertising, trade, art, or illustration. 

The Model agrees that the photographs can be used without further compensation for perpetuity, worldwide, and that this agreement is irrevocable. 

The Model agrees that the photographs, the copyright in the photographs, and all other rights in the photographs or copies or reproduction thereof are the sole property of Joe B Photographs and that Joe B Photographs may protect the copyright or dispose of or authorize the use of any or all rights in any manner whatsoever. As such, these photographs may not be used or published for any commercial purposes whatsoever without express written permission from Joe B Photographs.

The Model agrees to release Joe B Photographs and all persons entitled under this agreement to use the photographs from all liability for libel, invasion of privacy, and all causes of action whatsoever in relation to the photographs making and use, the Model or the Model's property (including pets) including without limitation any liability for alteration of the photographs, whether intentional or otherwise, that may occur during the making or subsequent use of the photographs.

Pet Photo Agreement

The Releasor hereby grants permission for Joe B Photographs to use any photographs taken during this photoshoot in any and all of its publications, across all media, display, broadcast and exhibition for promotion, advertising, trade, art, or illustration. 

The Releasor understands and agrees that these images will become and remain property of Joe B Photographs, and that Joe B Photographs may protect the copyright or dispose of or authorize use of any or all rights in any manner whatsoever.

The Releasor hereby authorizes Joe B Photographs to edit, alter, copy, exhibit, publish or distribute these photos for purposes of publicizing or other lawful purpose in any media that may include without limitation advertising, promotion, marketing, packaging, art or illustration.

The Releasor waives any right to royalties or other compensation arising or related to the use of these photographs for perpetuity, worldwide. 

The rights to these photographs remain with Joe B Photographs. As such, these photographs may not be used or published for any commercial purposes whatsoever without express written permission from Joe B Photographs. The Releasor hereby releases rights to all claims, demands, and causes to action which the Releasor, their heirs, representatives, executors, administrators, or any other persons acting on the behalf of their estate have or may have by reason of this authorization.

Assumption of Risk, Release, Waiver of Claim and Indemnity

The Releasor acknowledges and agrees that participation in this photoshoot with live animals involves potential dangers, risks, and hazards, including risk of physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent paralysis and/or death to self and/or charge/pet. 

The Releasor further acknowledges and agrees that participation in this photoshoot is entirely at their own risk and they free accept all the inherent risks of participating, and the possibility of personal injury, death, assault, property damage and loss resulting therefrom, for myself and/or my charge/pet.

The Releasor, and anyone claiming on my behalf, waive any and all claims that may now, and in the future, have against, and release and forever discharge from all liability and agree not to sue Joe B Photographs, its affiliates, employees, agents, representatives, heirs, successors and assigns (the "Releasees"), with respect to any and all liability, costs, (including legal costs, fees and/or expenses), claims, damages, demands, actions and causes of action of whatever kind that might arise from or in connection with the participation in this photoshoot including, without limitation, any personal mental or physical injury, illness, death, property damage, loss, or theft (including but not limited to live animals), loss of personal freedom or financial loss or other loss suffered by the Releasor or any family members or dependants arising, directly or indirectly, from the participation in this photoshoot, whether foreseen or unforeseen and regardless of the cause thereof including, without limitation, negligence or partial negligence on the part of the Releasees or any of them. 

The Releasor agrees to hold harmless and indemnify the Releasees against any and all claims, actions, lawsuits, damages and judgement, including attorney's fees, arising out of or relating to the participation in this photoshoot, including claim or action by or on behalf of the Releasor's dependants (present or future), for damages suffered or costs incurred arising out of or related to any aspect of my participation in this photoshoot, including without limitation, any of the matters described or contemplated above. 

This release for participating in this photoshoot shall not be in any way construed as an admission by the Releasees that they have acted wrongfully with respect to the Releasor or any other person, that it admits liability or responsibility at any time for any purpose, or that I have any right whatsoever against Joe B Photographs or other releasees.

This release constitutes the entire agreement between the Releasor/Model and Joe B Photographs (the Releasees), and supersedes any prior oral or written agreements or understandings between the parties concerning the subject matter of this release.

This release may not be altered, amended or modified, except by a written document signed by both parties.

The Releasor declares that they fully understand the terms of this agreement and have not been influenced by any representations or statements made by or on behalf of Joe B Photographs not recorded herein. 

The Releasor confirms that they are the full age of 18 years and have the full legal capacity to execute this release. The Releasor has read and understood this agreement prior to signing it, and agree that the legal rights and obligations under this agreement will be legally binding upon their heirs, next-of-kin, executors, administrators and successors. 

The Releasor is aware that by signing this agreement they are releasing and waiving certain legal rights, including the right to sue and to be awarded potentially substantial damage, which they or their heirs, next-of-kin executors administrators and assigns have or may have against the Releasees. 

If the Model / Releasor has not reached 18 years of age, their Parent or Guardian hereby gives their irrevocable permission to the photographer to use the photographs as outlined above.
