Waiver, Release and Consent to Tattoo

PLEASE READ AND BE CERTAIN YOU UNDERSTAND THE IMPLICATIONS OF SIGNING

PLEASE INITIAL EACH PROVISION IN THE SPACE PROVIDED AFTER READING TO SHOW THAT YOU UNDERSTAND EACH PROVISION.


In consideration of receiving a tattoo from "Rob" Robert Reese ( Space Angler Tattoos LLC, DBA Desert Ink Studios, the "artist") at Desert Ink Studios ( together with its employees, apprentices and agents, the "Tattoo Studio"), I agree to the following:

That I have been fully informed of the inherent risks associated with getting a tattoo. I Fully understand that these risks, known and unknown, can lead to injury, including but not limited to infection, scarring, difficulties in detecting melanoma and allergic reactions to tattoo pigment, latex gloves, and/or soap. Having been informed of the potential risks associated with getting a tattoo, I still wish to proceed with the tattoo application and I freely accept and expressly assume any and all risks that may arise from tattooing.

To WAIVE AND RELEASE to the fullest extent permitted by law each of the Artist and the Tattoo Studio from all liability whatsoever. For any and all claims and cause of action that I, my estate, heirs, executors or assigns may have for personal injury or otherwise, including any direct and/or consequential damages, which result or arise from the application of my tattoo, whether caused by the neglegence or fault of either the Artists or the Tattoo Studio, or otherwise.

That the Artist and the Tattoo Studio have given me the full opportunity to ask any and all questions about the application of my tattoo, and all of my questions have been answered to my total satisfaction.

The Artist and the Tattoo Studio have given me instructions on the care of my tattoo while it's healing and I understand them and will follow them. I acknowledge that it is possible that the tattoo can become infected, particularly if I do not follow the instructions given to me.

I am not under the influence of drugs or alcohol, and I am voluntarily submitting to being tattooed by the Artist without duress or coercion.

I do not have diabetes, epilespsy, hemophilia, blood disorders or disease, a heart disease or condition, nor do I take blood thinning medication. I do not have any other medical or skin condition that may interfere with the application or healing of the tattoo. I am not the receipient of an organ or bone marrow transplant or, if I am, I have taken the prescribed preventitive regimen of antibiotics that is required by my doctor in advance of any invasive procedure such as tattooing or piercing. I am not pregnant or nursing. I do not have a mental impairment that may affect my judgment in getting the tattoo.

I do not have a history of skin disease, skin lesions, skin sensitivities to soaps, disinfectants, etc.

I do not have a history of allergies or adverse reactions to pigments, dyes, or other skin sensitivities.

I do not have a history of allergies or adverse reactions to latex.

I do not have a history of bloodborne pathogens, including but not limited to infectious Hepatitis and HIV/AIDS.

I do not have a history with Tuberculosis, or any kind of immune disorders.

Neither the Artist nor the Tattoo Studio is responsible for the meaning or spelling of the symbol(s) or text that I have provided to them or chosen from the design.

Variations in color and design exist between the tattoo art that I have selected and the actual tattoo when it is applied to my body. I also understand that over time, the colors and the clarity of my tattoo will fade due to unprotected exposure to the sun, the naturally occuring dispersion of pigment under the skin, and the various processes that skin goes through during aging.

Tattoos lose pigment and ink during the healing process thus resulting in less saturation. Your tattoo will need touch-up (follow-up) due to the nature of tattoos. Folow-ups are done at the clients expense.

A tattoo is a permanent change to my appearence and can only be removed by laser or surgical means, which can be disfiguring and/or costly and which in all likelyhood will not result in the restoration of my skin to its exact appearance before being tattooed.

I release all rights to any photographs taken of me and the tattoo and give consent in advance to their reproduction in print or electronic form. (If you do not initial this provision, please advise and remind your Artist and the Tattoo Studio NOT to take any pictures of you and your completed tattoo).

I acknowledge that Desert Ink Studios (Space Angler Tattoos LLC) have security cameras that record video in several areas of the Studio. Some of these areas include tattoo areas so please take necessary precaution to feel comfortable due to said cameras. I fully recognize that tattoos being applied in certain areas of the body require some clothing to be removed, and I hold Desert Ink studios ( Space Angler Tattoos LLC) free of any responsibility for any discomfort that may be caused by being under surveilance in said circumstances.

I agree to reimburse the Artist and the Tattoo Studio for any attorneys' fees and costs incured in legal action I bring against either the Artist and/orTattoo Studio and in which the Artist and/or Tattoo Studio is the prevailing party. I agree that the courts of Utah in Davis County personal jurisdiction and venue over me and shall have personal jurisdiction for the purpose of litigating any dispute arising out of or related to this agreement.

I acknowledge that I have been given adequate opportunity to read and understand this document/agreement, that it was not presented to me at the last minute, and I understand that I am signing a legal contract waiving certain rights to recover against the Artist and/or Tattoo Studio.

I understand that for ongoing tattoo work (multiple sessions) The Artist Design Fee will not be applied until the last session or a combination of the second-to-last session and the last session, depending on the structure of the appointments.

I understand that I am resposible for the full payment of today's tattoo session following the completion of said session. The Artist Design Fee is only applied after the last session or second-to-last session depending on the appointment structure.

I hereby declare that I am of legal age ( and have provided valid proof of age) and am competent to sign this agreement.

If any provision, section, subsection, clause or phase of this release is found to be unenforceable or invalid, that portion shall be severed from this contract. the remainder of this contract shall then be construed as though the unenforceable portion had never been contained in this document.

Terms and Conditions:

By providing your driver's license number to Space Angler Tattoos LLC, DBA Desert Ink Studios you agree to the following terms and conditions:

Space Angler Tattoos LLC, DBA Desert Ink Studios will only collect and use your driver's license number for legitimate business purposes, such as age verification, identity confirmation, or as required by law.

Your driver's license number will be stored securely , and will not be shared with any third parties unless required by law or with your explicit consent.

Space Angler Tattoos LLC, DBA Desert Ink Studios will take all reasonable precautions to safeguard your driver's license number from unauthorized access, use, or disclosure.

You acknowledge that providing false or misleading information, including a fake or altered driver's license number, is strictly prohibited and may result in legal consequences.

Space Angler Tattoos LLC, DBA Desert Ink Studios reserves the right to refuse service or access to its products or services if the provided driver's license number is deemed invalid, suspicious, or in violation of these terms and conditions.

You agree to indemnify and hold harmless Space Angler Tattoos LLC, DBA Desert Ink Studios from any claims, damages, losses, or liabilities arising from the collection, storage, or use of your driver's license/ ID number, except in cases of negligence or misconduct on the part of Space Angler Tattoos LLC, DBA Desert Ink Studios

Space Angler Tattoos LLC, DBA Desert Ink Studios reserves the right to update or modify these terms and conditions at any time, and such changes will be effective immediately upon posting the updated terms and conditions on its website or other applicable platforms.

By providing your driver's license number, you signify your acceptance of these terms and conditions. If you do not agree with these terms and conditions, please do not provide your driver's license number to Space Angler Tattoos LLC, DBA Desert Ink Studios.
