RELEASE OF LIABILITY AND ASSUMPTION OF RISK

The individual named below (“Participant”) desires to participate in dance instruction and training (the “Activity”) provided by Heighten Your Performance, LLC, a Michigan limited liability company doing business as LoMI Studios (“LoMI Studios”). In consideration of being permitted to participate in the Activity and in recognition of LoMI Studios’ reliance hereon, Participant agrees to all the terms and conditions set forth in this instrument (this “Release”).

Participant is aware and understands that the activity involves the risk of injury, disability, and/or death (including all risks for exposure to COVID-19 and/or other communicable diseases). Participant acknowledges that any injuries that participant sustains may result from or be compounded by the actions, omissions, or negligence of LoMI Studios. Notwithstanding the risk, Participant acknowledges that Participant is voluntarily participating in the activity with knowledge of the risks involved and hereby agrees to accept and assume any and all risks of injury, disability, and/or death arising from my participation in the activity.

Participant hereby expressly waives and releases any and all claims, now known or hereafter known, against LoMI Studios, its members, managers, and its successors and assigns (collectively, “Releasees”), on account of injury, disability, or death arising out of or attributable to my participation in the Activity, whether arising out of the ordinary negligence of LoMI Studios or any Releasees or otherwise. Participant covenants not to make or bring any such claim against LoMI Studios or any other Releasee, and forever release and discharge LoMI Studios and all other Releasees from liability under such claims. This Release constitutes the sole and entire agreement of the Host and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter.

BY SIGNING, PARTICIPANT ACKNOWLEDGES THAT IT HAS READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT PARTICIPANT IS VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE STUDIO.
