Waiver and Release from Liability


You agree that when engaging in any physical exercise or activity, or when using the facilities and equipment on Club premises, including the parking area, you may assume any and all risk of injury, including but not limited to physical injury, contraction of an illness and development of a new medical condition or aggravation of an existing one. You also agree that you and your guests are responsible for consulting with physician regarding personal physical limitations and restriction of activities prior to using Club facilities and equipment, and the Club is not liable for any injury resulting from a failure to consult. You further agree that the Club shall not be responsible for any injury to you arising from a course of therapy prescribed by your physician and administered for your benefit by the Club. You agree that you are assuming all risk of any damage, theft, destruction, or loss of any personal property, which you or your guest may bring to the Club premises. You agree on behalf of yourself and your personal representatives, executors, administrators, heirs, agents, and assigns to release and discharge Club and its owners, affiliates, employees, officers, agents, representatives, successors and assigns from and/all causes of action arising of the Club’s negligence.

Further, the buyer or member understands and agrees that he/she will use the Club facilities at his/her own sole risk and that the Club shall not be liable for any injuries or any damage to any Buyer or the property of any Buyer, or be subject to any claim, demand, injury, or damages whatsoever, including without limitation, those damages resulting for any acts of active or passive negligence on the part of the Club, employees, or owners. The buyer, for him/herself, and on behalf of his/her personal representative(s), assigns and successor(s), does hereby expressly forever release and discharge the Club, its successors and assigns, as well as its employees, other members, and owners, from and all such claims, demands, injuries, damages, suits, or action(s) whatsoever.

Force Majeure: The Club will supervise and maintain the Club’s facilities in a reasonable condition, except as prevented by any cause beyond the Club’s reasonable control, including an act of God, governmental actions, war, strike, riot, civil commotion, fire, or other causes, which the Club cannot control.

Rules and Regulations: The buyer agrees to abide by all Club rules, which have been provided to buyer on the date of the Contract, or are hereafter adopted by the Club.
