Spur Road Use Rules

1. The Spur Road is a private road located on Kuukpik Corporation-owned land. Use is by permission of Kuukpik Corporation only and is a privilege, not a right. Use privileges may be lost or suspended for violation of these Rules. Kuukpik may terminate a user’s use privilege at any time for any reason.

2. By using the Spur Road you accept that such use is at your own risk and that Kuukpik is not liable or responsible for any accidents, personal injuries, property damage, death, or for unforeseen circumstances or events that may occur while using the Spur Road.

3. These Rules apply to the Spur Road only.

4. Kuukpik may close or restrict access to the Spur Road at any time and for any reason.

5. Permanent Nuiqsut residents and Kuukpik shareholders may use the Spur Road for subsistence and recreation only, and may do so ONLY AFTER obtaining permission from Kuukpik by signing (1) the Waiver of Liability and (2) these Rules.

6. Nuiqsut residents and Kuukpik shareholders who want to use the Spur for purposes other than subsistence or recreation (such as for business, commercial, or other uses for themselves or on behalf of a public or private employer) must obtain written approval from Kuukpik before such use by submitting a Spur Road Access Form to Kuukpik.

7. All other potential Spur Road users (including federal, State, or North Slope Borough employees, and CPAI personnel and their contractors) must sign (1) the Waiver of Liability and (2) these Rules prior to Spur Road use. After providing these 2 documents, these potential users must submit a Spur Road Access Form IN ADVANCE of EACH planned use and obtain Kuukpik’s written authorization.

8. For any Spur Road use or user not specifically addressed in these Rules, the potential user must contact the Kuukpik office in Nuiqsut or Anchorage to obtain written approval of use.

9. Spur Road users are not allowed to travel on the Spur Road with passengers who do not have Kuukpik’s permission to use the road. Everyone using the Spur Road (drivers and passengers) must have Kuukpik’s permission and sign the Waiver of Liability and Road Rules BEFORE using the Spur Road. Drivers are responsible for the actions of all passengers in their vehicle.

10. All drivers are required to present a valid driver’s license or government ID to Kuukpik (or Kuukpik’s designee) when signing the Waiver of Liability and these Rules.

11. ATV/snowmachine users, and those who will be vehicle passengers only must also sign the Waiver of Liability and these Rules. If an ATV/snowmachine user or non-driver does not have a photo ID, he or she must be known to Kuukpik to be a permanent Nuiqsut resident or Kuukpik shareholder.

Individuals under the age of 18 must have a parent or guardian sign the Waiver of Liability and these Rules.

12. Spur Road users must follow all rules set by Kuukpik and must comply with all road closures and safety checkpoints established by Kuukpik.

13. Travel on the Spur Road is permitted only when weather conditions are suitable. This is a self-policing restriction. Kuukpik does not expect to have the staff or the budget to routinely open or close the Spur Road based on weather or Spur Road conditions. All travel is at the user’s own risk.

14. It isn’t Kuukpik’s or Nanuq’s job to assist vehicles that (1) get stuck in the snow on the Spur Road or drive off the road surface, (2) breakdown, or (3) stop for other vehicle problems or driver error. The driver is responsible for obtaining any necessary assistance from other authorized Spur Road users.

Tundra damage caused by driving off the road surface will be reported to the North Slope Borough by Kuukpik. The driver will be responsible for such damage. All off road incidents with cars and trucks must be promptly reported to Kuukpik at 907-480-6220.

15. Car and truck drivers must be licensed and carry their valid driver’s license while driving on the Road.

16. 25 miles per hour is the speed limit for the Spur Road for all vehicles (e.g. cars, trucks, ATVs, snowmachines, etc.).

17. All vehicles - cars, trucks, ATVs, and snowmachines - must adhere to all signs posted on the Spur Road (e.g. reduced speed in construction or maintenance areas, etc.).

18. Do NOT pass any equipment operating on the Spur Road (e.g. snow blowers, compactors, graders, water trucks, etc.) until the equipment operator has acknowledged your presence and signaled that it is safe to pass.

19. No littering or disposal of any trash, pollutants, or other materials (including cigarette butts) is allowed on the Spur Road.

20. Spur Road users must not disturb or tamper with any equipment that may be present along the Spur Road or next to the Spur Road.

21. Stopping on the Spur Road is generally prohibited. However, brief stops for subsistence purposes (e.g., dropping off a hunter, retrieving game, etc.) are allowed. Cars and trucks must turn on their flashers to signal that they are stopped. ATVs and snowmachines must pull to the edge of the Spur Road to stop for subsistence purposes.

22. Hunting from, but not on, the Spur Road is permitted. The hunter must be off the driving surface of the Spur Road while shooting. The hunter must not shoot from the inside of a vehicle or shoot across the Spur Road.

23. All ATV and snowmachine operators and passengers must wear helmets while on the Spur Road.

24. ATVs must stay on the Spur Road. ATVs are not allowed to access the tundra from the Spur Road.

25. Snowmachines may be used on the Spur Road only after a sufficient new snowfall and before plowing of the Spur Road. This restriction does not apply to crossing the Spur Road on a snowmachine.

26. Snowmachines crossing the Spur Road are responsible for ensuring no traffic is present prior to crossing.

27. Kuukpik has complete discretion to change these Spur Road Rules at any time.
