Coast to Coast Paddle, LLC Waiver and Release of Liability

1. ACKNOWLEDGMENT AND STATEMENT OF RISKS: I hereby acknowledge that there are significant elements of risk in any adventure, sport, or activity associated with watersports, the outdoors, the presence or use of motorized watercraft, and activities incidental thereto (referred to herein as “the Activity”). Certain risks cannot be eliminated without destroying the unique character of the Activity. The same elements that contribute to the unique character of the Activity can be causes of loss or damage to equipment, cause accidental injury, illness, or in extreme cases, permanent trauma or death. 

2. EXPRESS ASSUMPTION OF THE RISK AND RESPONSIBILITY: I, for myself and any minor children for whom I am responsible, and on behalf of my heirs, assigns, personal representative and next of kin, hereby knowingly and freely assume all such risks, both known and unknown, including full responsibility for and risk of bodily injury, or death, or damage to other third parties and their property as a result of my participation in the Activity and/or my use of the rented equipment, even if the injury, death or property damage is caused, in whole or in part, by the negligence of Coast to Coast Paddle, LLC (“CCP) its members, officers, officials, agents and/or employees.  

3. RELEASE AND WAIVER OF LIABILITIES: I further agree to hold CCP harmless from any and all liability, actions, causes of actions, claims and demands of any kind and nature whatsoever which I now have or may arise from or in connection with the Activities. I further understand that CCP carries no medical insurance for the protection of participants in the Activities, and any insurance coverage existing with respect to CCP shall not alter the terms of this waiver nor impose any liability on CCP. 

4. NAME AND LIKENESS: I hereby grant CCP the right to use, for promotional purposes only, any photographs and/or videos taken of me in connection with my participation in the Activities. 

5. PHONE CASES/DRY BAGS: I understand that if I choose to rent a phone case or dry bag, that CCP is not responsible for any items damaged or ruined therein. 

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY.
