Waiver & Release

WAIVER & RELEASE 

This form MUST be completed and signed by you before you are permitted to enter the facility and/or participate in events run by Deedop Pty Limited trading as Slam Factory (SLAM). If you are under 18 years of age a parent or legal guardian MUST sign this form and provide an emergency contact number. Access to this property is by the discretion of SLAM.

By entering the property and/or participating in an event you accept SLAM’s rules, regulations and codes of conduct comprised of:

  • RIDE SAFE TIPS Everyone has the responsibility to RIDE SAFE in the park – look out for yourselves and your friends so everyone can have fun.
  • LOOK BEFORE YOU RIDE. Its like a road, but with more options – just like you don’t cross a road without looking, you shouldn’t start riding without looking left to right, front to back first. 
  • ONLY SIT BACK ON THE DECKS OF THE RAMPS. Sitting on the lip of a ramp or on the coping can get in the way of other users on the park. Always sit back to give other riders plenty of room. Always sit on the decks so you are visible – sitting at the bottom of ramps, or stopping anywhere between ramps is VERY DANGEROUS as others can’t see you.
  • THIS IS A SKATEPARK – NOT A PLAYGROUND. You need to stay on your bike / scooter / skateboard or other wheeled device at all times. Don’t leave your equipment around the park, the ramps are NOT slippery slides, and the park is not a running track.
  • RIDE TO YOUR ABILITY. It's not a race or a competition. Ride within your limits and progress at your own pace, as you feel comfortable. Most injuries occur when you try to rush something or learn something that is a bit beyond your current level. Remember - Everyone has the same rights to use the park. Respect all the users, and you'll get the same in return!
  • The use of profane or obscene language or any type of physical or verbal violence will result in the expulsion of the user concerned;
  • Threatening, bullying, or intimidating language or behaviour is prohibited. Violators will be prosecuted;
  • Conduct considered inappropriate by staff may result in expulsion from the facility and / or suspension of future park use.
  • Graffiti, tagging, stickers, or any changes to the appearance of the skatepark are a crime. Vandals will be prosecuted.
  • The skatepark area must be kept clean and clear of all food and drink. No food, unsealed drink containers or glass containers of any kind are to be taken into the park.
  • No Alcohol, or illegal substances are permitted on the premises.
  • Smoking is prohibited inside the park.
  • Children under 10 must be accompanied by an adult or suitable guardian at all times in the park.
  • No riding is allowed in the shop or party room.

DECLARATION AND WAIVER RELEASE AND INDEMNITY DEED

All persons must complete this document prior to participation.

The activities described include adventurous recreational activities and are not without inherent risk.

SLAM thanks you for reading this document carefully.

 

TO SLAM, its directors, employees, principals, agents and independent contractors, I confirm the following is true and correct and SLAM has relied on my answers in allowing me to participate in recreational activities of and incidental to things including skateboarding, rollerblading and scooter riding (“the activities”).

In consideration of SLAM permitting me to participate in the activities:


Express Voluntary Assumption of Risk: 

I understand that I, and each participant in the activities will be engaging in activities involving a real risk of serious injury or even death from various causes including but not limited to equipment failure, collisions with other participants or spectators or other causes. I voluntarily accept all risks necessarily flowing from my participation, which could result in injury or loss of life.

 

Liability Release and indemnity:

I hereby release SLAM and all persons or corporations associated directly or indirectly with the conduct of activities from all claims, demands and proceedings arising out of my participation in the activities and hereby indemnify them against all liability (including liability for their negligence and the negligence of others) for all injury loss or damage arising out of or connected with my participation in the activities. This release shall extend to and include SLAM and owner partners, managers, officers, employees, agents, contractors, any club, organisation and volunteers including medical and paramedical personnel appointed for the activities, the owners, licensees and occupiers of land on which the activities or any part of it are conducted or which is involved directly or indirectly with the activities in any manner whatsoever and promoters, sponsors and activities organisers. This release and indemnity continues forever and binds my heirs, executors, personal representative and assigns.

 

Equipment and Facilities Inspection: 

I agree that before I participate in the activities, I will independently inspect the related facilities and equipment. I will immediately advise SLAM of any unsafe condition that I have observed. I will refuse to participate in the activities until all unsafe conditions observed by me have been remedied. I acknowledge that reasonable safety precautions are undertaken by SLAM (Such as supervision, helmet and safety checks), but such are a service to me and other participants and are not a surety of safety.

  

Protective Equipment: 

As an activities participant I agree that while I undertake any and all of the Activities I will:

  • wear a helmet; Helmets must be properly fitted and used at all times within the skate park. Helmets should be firm fitting, and sit just above your eyebrows with the strap secured under your chin and in accordance with manufactures instructions.
  • use appropriate protective gear; SLAM strongly recommends that ALL riders consider the use of protective gear such as elbow and knee pads, mouth guards, wrist guards, ankle braces and gloves as appropriate for your sport;
  • at all times wear Shirts, pants or shorts plus appropriate closed, non-slip footwear.


Physical Fitness: 

I have independently assessed the activities and I am physically fit to participate in the activities in which I have chosen to participate and have not been advised otherwise by a medical practitioner. I do not have any possibly relevant pre-existing medical or physical conditions which have not been disclosed to SLAM.

 

Medical Treatment: 

I consent and consent on behalf of the child for whom this waiver has been signed to receiving any medical treatment (e.g. first aid treatment) that SLAM considers reasonably necessary during or after the activities. This includes the calling of an ambulance.

 

Personal Property: 

I hereby acknowledge that I have the sole responsibility for my personal property during the activities.

 

I acknowledge the terms and conditions of this document are contractual in nature, are intended to have legal effect and are not a mere warning or recital. SLAM is not responsible for my decision to participate in the activities and I was not induced by SLAM to do so. I acknowledge my registration is not transferable to any other person. I have read this document, understand its contents and complete it of my own free will.
