RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND RENTAL AGREEMENT

In consideration of being permitted to rent an electric bicycle ("e-bike") from Tropical Bay Rentals LLC ("Company"), I, the undersigned, agree to the following:

  1. ASSUMPTION OF RISK: I understand that riding an e-bike involves inherent risks including but not limited to falls, collisions, equipment malfunction, and injury or death. I voluntarily assume all such risks.
  2. RELEASE OF LIABILITY: I hereby release Tropical Bay Rentals LLC, its owners, employees, and agents from any and all claims, damages, losses, or liability arising from my use of the rented e-bike, including claims of negligence.
  3. RENTAL RULES: I agree to (a) operate the e-bike safely and legally, (b) obey all traffic laws, (c) not allow any other person to ride the e-bike, (d) not ride under the influence of alcohol or drugs, (e) return the bike in the same condition it was received.
  4. DAMAGE/LOSS: I agree to pay the full replacement cost of the e-bike if it is lost, stolen, or damaged beyond normal wear. Replacement value is $900 per bike.
  5. HELMETS: I acknowledge that Florida law requires riders under 16 to wear a helmet. Adult riders assume full responsibility for their own helmet use.
  6. MINORS: If I am signing on behalf of a minor, I accept all terms on their behalf and assume full responsibility.
  7. GOVERNING LAW: This agreement is governed by the laws of the State of Florida.
