RELEASE OF LIABILITY, ASSUMPTION OF RISK, WAIVER OF CLAIMS & INDEMNIFICATION AGREEMENT

THATS LLC dba Hemp and Tea Company (“Host”) is a chain of retail stores and lounges selling a variety of hemp derived products, including infused beverages. Hemp and Tea Company may offer the opportunity to consume THC products on site for customers over the age of 21 (Participants). In consideration of being allowed to consume THC products on the property of the Host, Participants do hereby agree, to the fullest extent permitted by law, as follows:

I Agree
TO ATTEST that Participant is not operating any motor vehicle after the consumption of intoxicating hemp products on the property of Host. Participant will utilize public transportation, order a ride share, or have a friend drive them home. 

I Agree
TO WAIVE ALL CLAIMS that Participant (or his/her next of kin) has or may have against the Host arising out of the Participant’s use and consumption of any hemp or hemp-based products offered by the Host. Participant is responsible for the actions of himself or herself and acknowledges that participant is solely responsible for any and all damages suffered by himself or herself or caused to third parties including but not limited to personal injury, property damage, death, disfigurement, or loss of consortium as a result of consumption of any hemp or hemp-based products offered by the Host. This waiver extends to any and all claims of every kind or nature whatsoever, foreseen or unforeseen, known or unknown.

I Agree
TO ASSUME ALL RISKS of consuming hemp and hemp-based products, even those caused by the negligent acts or conduct of the Host, its owners, affiliates, operators, employees, agents, and/or officers. Participant understands the inherent risks of consuming hemp, and understands that consumption of THC products is entirely voluntary and at their own discretion, and that effects may vary based on personal tolerance, dosage, and other factors. Participant acknowledges that they are solely responsible for complying with all applicable state and local laws regarding cannabis possession and consumption, and that the Host makes no representation or warranty regarding the legality of any participant’s conduct.

TO RELEASE Host, its owners, affiliates, operators, employees, agents, and/or officers from all liability for any loss, damage, injury, death, or expense that the Participant (or his/her next of kin) may suffer, arising out of his/her consumption of hemp or hemp-based products offered by Host.

TO INDEMNIFY Host, its owners, affiliates, operators, employees, agents, and/or officers from all liability for any loss, damage, injury, death, or expense that the Participant (or his/her next of kin) may suffer, arising out of his/her consumption of hemp or hemp-based products offered by Host.

Participant acknowledges that he or she has received and read this Release of Liability, Assumption of Risk, Waiver of Claims & Indemnification Agreement (“Waiver”) in its entirety and agree with its terms. Participant executed this Waiver voluntarily and without any inducement. If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Waiver shall be governed by and construed in accordance with the laws of the State of North Carolina.
