1. Acknowledgment of Participation

I voluntarily choose to participate in scenic tour activities operated by Moab Express Tours (“MET”). I understand that these activities involve travel in outdoor environments and may include short walks, stops at viewpoints, vehicle transportation, and related services. I acknowledge that participation is entirely voluntary and that I am free to decline or modify my participation at any time.

2. Assumption of Risk

I understand that participation in scenic tour activities involves inherent risks that cannot be eliminated, even with reasonable care. These risks may include, but are not limited to:

  • Uneven or rocky terrain, steps, curbs, and natural surfaces
  • Slippery footing, loose gravel, or changing weather conditions
  • Vehicle travel and roadside stops
  • Limited or delayed access to medical facilities
  • Physical exertion, fatigue, dizziness, shortness of breath
  • High altitude effects, dehydration, and dry climate conditions
  • Trips, slips, or falls
  • Acts or omissions of other participants

I knowingly and freely assume all such risks, whether known or unknown, foreseeable or unforeseeable.

3. Health and Personal Responsibility

I acknowledge that I am responsible for my own health, physical condition, and well-being. I understand that high altitude, physical activity, and environmental conditions may affect individuals differently, particularly those with pre-existing medical conditions.

I represent that I am physically capable of participating in these activities and agree to:

  • Monitor my own condition and comfort level
  • Stay adequately hydrated
  • Wear appropriate footwear and clothing
  • Inform MET staff promptly if I feel unwell, unsafe, or unable to continue

I understand that MET staff are not medical professionals and are not responsible for diagnosing or treating medical conditions.

4. Release of Liability and Waiver of Claims

To the fullest extent permitted by law, I hereby release, waive, and discharge Moab Express Tours, and its owners, officers, directors, employees, agents, contractors, and affiliates from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind arising out of or related to my participation, including those resulting from the negligence of Moab Express Tours, except where prohibited by law.

This release applies to personal injury, illness, death, property damage, or any other loss that may occur during or as a result of participation in scenic tour activities.

5. Indemnification

I agree to indemnify and hold harmless Moab Express Tours from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of my participation or my breach of this agreement.

6. Binding Effect

This agreement is binding upon me and my heirs, executors, administrators, personal representatives, and assigns.

7. Tour Itinerary and Travel Conditions

I understand that any itinerary provided is a general guideline and not a contract. Tour routes, schedules, stops, and activities may change due to weather, road conditions, mechanical issues, safety concerns, medical situations, or other circumstances beyond MET’s control.

I agree that MET is not responsible for additional expenses I may incur as a result of such changes, including meals, lodging, personal expenses, or rebooking of commercial transportation.

8. Responsibility Outside of Scheduled Tours

When I am not participating in a scheduled MET activity or traveling in an MET vehicle—including during free time, at hotels, restaurants, or other locations—I am solely responsible for my own care, safety, and well-being. This applies to both single-day and multi-day tours.

9. Media and Marketing Authorization (Optional)

I grant Moab Express Tours permission to use photographs, video, or other media captured during my tour for marketing, promotional, or educational purposes, including use on websites, social media, printed materials, and other public outlets, without compensation.

I understand that once media is published, it may be accessible to the public and that MET cannot control third-party use.

Opt-Out Option:

If I prefer not to be included in marketing media, I may opt out at any time by notifying Moab Express Tours by phone or email at:

10. Governing Law and Venue

This agreement shall be governed by and interpreted in accordance with the laws of the state in which the tour activity primarily occurs, without regard to conflict-of-law principles.
