Paddle Sports Rental Agreement and Release of Liability Waiver

PLEASE READ CAREFULLY BEFORE SIGNING.

I acknowledge that I will be the only person using the equipment I receive during this rental period. I understand that rental equipment is issued in AS IS condition and accept full responsibility for the care of the equipment during the rental period. I will be responsible for any late fees and/or the replacement, of any equipment that is not returned by the agreed upon date and time. I acknowledge my obligation to return all equipment by the agreed date and time in the condition it was received and agree to pay for any repairs, or cleaning fees, up to and including a full replacement, in the event the equipment is damaged beyond normal wear and tear. I understand that a valid drivers license and credit card are required to rent any paddle sports equipment. [For store pickup only] I acknowledge that I have adequate and safe means to transport any rental equipment.

 

I verify that I am in good health and am capable of pursuing paddle sports. My participation in this activity is voluntary. I agree that I will not consume alcohol or use drugs of any kind while operating any rental equipment. I also agree to properly wear a personal floatation device at all times while operating any watercraft. I will abide by all local and state laws that govern the use of this equipment and areas and waterways where it will be used. I verify that I understand the function of this equipment.

 

I acknowledge and agree that water sports activities, including kayaking and paddle boarding, involve certain inherent risks, dangers and hazards that can result in serious injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/ or total paralysis, death or other ailments that could cause serious disability. I understand that wearing a personal floatation device does not remove all risks of injury and will not guarantee my safety while kayaking or paddle boarding. Risks and dangers may arise during these activities from foreseeable or unforeseeable causes including, but not limited to, weather, water level, obstacles, other people, risk of falling out of or drowning while paddle sporting and such other risks, hazards and dangers that are integral to recreational activities that take place in a wilderness, outdoor, or recreational environment.

 

I ACKNOWLEDGE THAT BY SIGNING THIS DOCUMENT I AM RELEASING THE SKI SHACK ENTERPRISES, INC. DBA SKI SHACK AND THEIR RESPECTIVE AGENTS, EMPLOYEES, MEMBERS, SPONSORS, PROMOTERS, AND AFFILIATES (COLLECTIVELY “RELEASEES”) FROM ANY AND ALL LIABILITY, REGARDLESS OF ANY NEGLIGENCE, INCLUDING BREACH OF CONTRACT ON THE PART OF THE “RELEASEES” IN THE DESIGN, MANUFACTURE, SELECTION, INSTALLATION, MAINTENANCE OR ADJUSTMENT OF THE EQUIPMENT.
