We collect personal information that is necessary to provide and manage the Beach Patrol. We maintain the confidentiality of this information.

When you give the Canadian Sea Turtle Network personal information pertaining to others (for example an emergency contact), we rely on you to have made or make that person or people aware that you will or have provided their information to us and the third parties we may provide it to (for example, in the case of medical emergency), the relevant purposes we and the third parties will use it for, and how they can access it or make a privacy complaint. If it is sensitive information, Canadian Sea Turtle Network relies on you to have obtained their consent on these matters. The Canadian Sea Turtle Network, Incorporated (referred to hereafter as “Canadian Sea Turtle Network”) is conducting the Canadian Sea Turtle Network Beach Patrol for Stranded Sea Turtles (referred to as “Canadian Sea Turtle Network Beach Patrol” or “Beach Patrol” hereafter).

It is important to be aware that there are factors involved in the Canadian Sea Turtle Network Beach Patrol that are beyond the control of the Canadian Sea Turtle Network. Driving living sea turtles or dead sea turtle carcasses involves many inherent risks, dangers and hazards, including but not limited to bodily injury due to traffic accidents, illness (some severe) from inappropriate contact with a sea turtle, or discomfort in driving inside a vehicle at a cold temperature.

Factors that are beyond the control of the Canadian Sea Turtle Network include—but are not limited to—aspects such as:

  • Weather, including sudden temperature change, sudden rain or snowstorms, fog banks rolling in, high winds, etc.
  • Road conditions, including severe and unexpected snow or rainstorms, icy conditions, foggy conditions, or extreme wind. Roads may also be in poor condition, including potholes that are difficult to see and could damage your vehicle.
  • Traffic conditions, including construction, traffic congestion, poorly marked intersections, etc.
  • Other drivers, including those driving too fast, driving under the influence of drugs or alcohol, driving unlicensed, driving recklessly, passing in non-passing zones, etc.
  • Possible traffic accidents that cause damage to your vehicle and injury to you or those traveling with you that may be severe, life threatening, or fatal.
  • Vehicle condition, including unsafe vehicles, vehicles with unsafe tires, vehicles with insufficient fuel, vehicles without current permits, etc.
  • Your health condition and your level of driving skill.

It is your responsibility to ensure that you handle the sea turtles or sea turtle carcasses while wearing disposable rubber gloves (example, dish gloves or medical gloves). It is your responsibility to ensure that you do not put your fingers in your mouth after handling the turtle without washing your hands thoroughly first and to ensure that you do not kiss the turtle or to touch the turtle in any way with your mouth except at your own risk.

Risks that can occur as a result of contact with alive or dead sea turtles include contact with human pathogenic bacteria such as Salmonella. If any part of the sea turtle is consumed, humans are at risk of chelonitoxism, a life-threatening disease for which there is no known antidote.

Be prepared for a range of weather. You are responsible for checking the safety of your vehicle, ensuring that your vehicle has sufficient fuel, ensuring that it is has a current provincial permit, and ensuring that you are skilled and properly licensed to drive it.

The Canadian Sea Turtle Network accepts NO RESPONSIBILITY OR LIABILITY for the experience or fate of any passenger you choose to bring in your car with you.

Walking the beach looking for places to put up posters involves many inherent risks, dangers and hazards, including but not limited to bodily injury due to mishaps while on beaches.

Factors that are beyond the control of the Canadian Sea Turtle Network include—but are not limited to—aspects such as:

  • Weather, including sudden temperature change, sudden rain or snowstorms, fog banks rolling in, high winds, etc.
  • Beach substrate, including the stability of beach substrate, the presence of water or ice on the beach or beach substrate, uneven terrain, debris—including sharps—on the beach and potentially obscured by sand, etc.
  • Presence of others on the beach, including people who are rude or threatening, etc.
  • Sufficiency of lighting on beach
  • Available parking near beach, including the proximity of the parking or the path you travel to reach the beach (on foot, by bike, by car, or by other form of transportation) to a highway, where vehicles may be operated by inexperienced or dangerous drivers
  • Your health condition

You are responsible for the risks associated with putting up posters in community locations, including ensuring that you have permission to put the poster up in that location. Factors beyond the control of the Canadian Sea Turtle Network include--but are not limited to--aspects such as:

  • People in public places, including those who may be rude or threatening.
  • Injury from the use of a power stapler and/or push pins. These could include accidentally stapling part of your body, accidentally stabbing yourself with a push pin, etc.
  • Your health condition

Be prepared for a range of weather. Walking on a beach means walking over uneven terrain. You are responsible for keeping yourself well hydrated. You are also responsible for managing your own sun protection (sunscreen, hats, and so on).

Although the Canadian Sea Turtle Network has taken precautions to make the Beach Patrol safe for all participants, the Canadian Sea Turtle Network cannot guarantee your personal safety or the safety of your belongings when you participate in the Beach Patrol. You are solely responsible for your personal safety and the safety of your belongings. By signing this agreement, you agree to indemnify and hold harmless the Canadian Sea Turtle Network and its employees and officers for any issues pertaining to your personal safety.

Assumption of risks and assent to Canadian Sea Turtle Network policies

I understand the requirements for the Canadian Sea Turtle Network Beach Patrol for Stranded Sea Turtles. I have read this Liability Release. I understand the risks described in this Liability Release. I have also had the opportunity to ask the Canadian Sea Turtle Network team questions (902-483-1781; hello@seaturtle.ca) related to the Beach Patrol and I am satisfied with the answers I have received.

I understand these and other risks not listed above can, in extreme and unlikely circumstances, cause or lead to death, injury, illness, property damage, mental or emotional trauma or disability. Further, activities may take place several hours from any medical facility or where communication, transportation or evacuation is subject to delay. I agree to assume all of the risks of the Canadian Sea Turtle Network Beach Patrol, whether inherent or not, and whether described above or not.

By signing this document, I agree to participate in the Beach Patrol activities under the terms and conditions described in this Liability Release and other relevant Canadian Sea Turtle Network material provided to me.

I declare that I am in good health. I understand it is my responsibility to review all conditions relevant to the Beach Patrol to determine if I am able to safely participate in the activities and to confer with my doctor if I have a question or concern about my health and my participation in the Beach Patrol.

Release of liability and indemnity agreement

In consideration of the Canadian Sea Turtle Network accepting me as a Participant, I, on behalf of myself, my heirs, executors, administrators, successors, and/or assigns acknowledge and agree:

  • that each of the Canadian Sea Turtle Network, Inc., their employees, officers, directors, trustees, participants, agents, affiliates, scientific staff, cooperating institutions and other persons acting under their direction and control (collectively referred to as “Released Parties”) will have no liability whatsoever for personal injury, death, loss of physical or mental health, financial loss, damage to property or any other loss or damage suffered by me, my heirs, executors, administrators, successors and/or assigns;

  • to release each of the Released Parties from and in relation to, any and all liabilities they may jointly or severally incur to me, my heirs, executors, administrators, successors and/or assigns, in respect of any claim, suit or cause of action (including negligence), including legal fees and expenses of litigation, on account of any personal injury, death, loss of physical or mental health, financial loss, damage to property or any other loss or damage suffered;
    I Agree
  • to indemnify and keep indemnified each of the Released Parties in relation to any and all liabilities they may jointly or severally incur, in respect of any claim, suit or cause of action (including negligence), including legal fees and expenses of litigation, on account of any personal injury, death, loss of health, financial loss, damage to property or any other loss or damage caused or contributed to by me;

  • that the Canadian Sea Turtle Network is not responsible or liable for acts or omissions of third parties, including but not limited to cooperating institutions, independent contractors, other entities or other Participants;

  • that this Liability Release contains the entire understanding between myself and the Canadian Sea Turtle Network concerning the subject matter of this Liability Release and supersedes, terminates and replaces all prior agreements and communications between us;
