Perennial Farm LLC, Jessie Frankowiak, Dara Dresden, Shelby Wietharn, and Alpha Boarding Complex Inc. hereafter known as “Perennial Farm,” is an equestrian professional and sponsor engaging in equine activities. Perennial Farm’s principal place of business is located at 5305 Interbay Boulevard, Tampa, Florida 33611. Perennial Farm engages in an equestrian activity on and off-site of its principal place of business, including but not limited to, non-Perennial Farm horse shows, clinics, and training. Perennial Farm is an equine activity sponsor, which sponsors, organizes, or provides the facilities for equine activity, including, but not limited to, programs, and activities, therapeutic riding programs, instructors, and promoters of equine facilities, including, but not limited to, farms, stables, and clubhouses, and the arenas at which activities may be held. Perennial Farm is an equine professional engaged for compensation in the instruction of, and/or renting of an equine to, a participant for the purposes of riding, driving, or being a passenger upon the equine, in renting equipment or tack to a participant, to provide daily care of horses boarded at an equine facility; and/or to train an equine. Perennial Farm’s equine activities include, but are not limited to, horseback riding, training and teaching activities, boarding, including the normal daily care of an equine, assisting in the veterinary treatment of, driving, and/or being a passenger upon an equine, mounted or unmounted. They also include riding, inspecting, or evaluating an equine belonging to another by a purchaser or an agent, whether or not the owner has received monetary consideration or anything of value for the use of the equine or is permitting a prospective purchaser to ride, inspect, or evaluate it, as well as rides, trips, hunts or other equine activities of any type, no matter how informal or impromptu. Additionally, it also includes visiting or touring or utilizing an equine facility as part of an organized event or activity, and assisting a participant or horse show management. WARNING
Under Florida law, an equine activity sponsor or equine professional is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activity. Inherent risks of equine activity means those dangers or conditions which are an integral part of equine activities, including, but not limited to, the propensity of equines to behave in ways that may result in injury, harm, or death to persons on or around them, and the unpredictability of an equine’s reaction to such things as sounds, sudden movement, and unfamiliar objects, persons, or other animals. It also means certain hazards that may be encountered such as surface and subsurface conditions, collisions, with other equines or objects, and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within his or her ability. You, “Participant,” agree, understand, and acknowledge the above on behalf of yourself and/or your minor child, also “Participant,” and agree to engage the services of Perennial Farm, to include directors, employees, working students and volunteers, to instruct or sponsor the Participant in equine activities. Participant agrees to indemnify, release, and hold harmless Perennial Farm for any and all claims, loss, actions, damages, costs or demands that Participant now or hereafter may have for any injury, loss or damage of any sort resulting in any fashion from Participant’s engagement of Perennial Farm. Participant agrees that in signing this release and waiver, Participant further limits the liability of Perennial Farm beyond the statutory protection given to equine professionals and sponsors under Florida law. Participant agrees that Participant and Participant’s heirs, successors, assignees, insurers, executor/administrator or legal representative are bound to this waiver and any and all claims, loss, liability, actions, damages, costs or demands that Participant now or hereafter may have for any injury, loss or damage of any sort resulting in any fashion from Participant’s engagement of Perennial Farm. Participant and Perennial Farm agree that the release and waiver of claims is intended to be broad and inclusive as is permitted by the law of the State of Florida and that if any portion of this waiver and release is held invalid, it is agreed that the remaining portion of the waiver and release shall, notwithstanding, continue in full legal force and effect. If a dispute arises from or relates to this release and waiver and/or an alleged breach, Participant and Perennial Farm agree to settle the dispute by mediation administered in Hillsborough County, with the cost of mediation to be equally split between Participant and Perennial Farm. CONDITION OF HORSE SHOW I SUMMER CLINIC ENTRY
Every horse entered will be under the control of the Equine Professional, but the Equine Professional will in no case be responsible for any loss or damage that may occur, and it shall be a condition of every entry that each exhibitor and owner shall hold harmless the show or Summer Clinic, its directors, employees, volunteers and Perennial Farm LLC. All owners and exhibitors will be held responsible for any and all damage incurred by them, their agents or employees. The Equine Professional reserves the right to refuse any entry with reason. If the Participant is under 18 years of age, a parent or a legal guardian must sign here to indicate acceptance of responsibility and the permission for the administration of first aid, if required, on the grounds. BILLING POLICY: Perennial Farm is a subscription-based lesson program. Lesson subscriptions secure the day and time for riders to take one lesson per week. The subscription fee for 1 lesson per week is $355 plus a processing fee. Your subscription rate will be the same each month and automatically renew each month based on an annual calendar of 50 lessons per year. This agreement can be canceled by either party with at least 30 days written notice prior to the desired date of determination, however, no refunds will be given. Drop-in lessons will be charged at the time of booking at a rate of $100 per lesson. CANCELLATION POLICY: Lessons canceled after 5 pm the day prior to your lesson will be charged the full lesson fee. One make-up lesson per month is allowed and it must be scheduled within the same month. Lessons missed during the last week of the month will have an additional one-week grace period in the following month.
This document is meant to be a full and complete release from any and all liability that may arise from instructing the Participant on how to properly ride, manage, and care for horses and/or in the event that the Participant freely engages in Horse Showing on the grounds of Perennial Farm LLC. Any activities that may be offered as part of a Summer Clinic or Horse Showing, such as transportation to and from horseshow or field trip destinations, engaging in horseshow or field trip activities, or taking part in trail rides (Participant and/or Horse) are hereby covered by this release. This release is given freely and voluntarily by the Participant and is meant to remain in existence throughout the duration of any instruction, Horse Show event or Summer Clinic activities. Perennial Farm Rules
- All Clients must complete a Waiver of Release and Liability before engaging the services of Perennial Farm. Visitors and Clients are not permitted on the grounds of Perennial Farm until a waiver of release and liability has been acknowledged and signed.

- The barn is open Tuesday through Sunday. Unless otherwise stated or dictated by a lesson or show schedule, business hours are 8:00 a.m. to 6:00 p.m. The barn will be closed the week of June 30th – July 6th and December 23rd – December 29th, 2024.
- CANCELLATION POLICY: Lessons canceled after 5 pm the day prior to your lesson will be charged the full lesson fee. One make-up lesson per month is allowed and it must be scheduled within the same month. Lessons missed during the last week of the month will have an additional one-week grace period in the following month.
- No unsupervised minors are permitted on the premises of Perennial Farm. All minors must be accompanied by a parent or legal guardian over the age of 18. Minors may be present on the property with the permission of a trainer, who is physically present on the grounds at the same time as the minor.
- Minor riders/owners/leasers must have an adult with them when hacking their owned/leased horse/pony. ABSOLUTELY NO JUMPING IS ALLOWED outside of a lesson for anyone.
- Riders should arrive early for their lessons so they can groom and tack their horse/pony. Riders should work with the working student to learn how to tack their horse/pony if they are physically capable. After their lesson, riders need to untack and take care of their horse. Working students are there to help when needed. Please allow approximately 30 minutes before and after your lessons for this.
- Horses/ponies must be in crossties when they are in the wash rack being groomed or tacked up. Riders are asked to please clean up after their horses/ponies when using wash racks and to return all items used to their proper place, neat and clean. (e.g. pick up your horse’s manure). Horses/ponies are NEVER to be left unattended in the Cross-ties. Cross-ties must be actually clipped onto the horse/pony’s halter. Do not secure a horse/pony by its bridle without placing a halter over the bridle first.
- Riders are required to wear a helmet at all times when attempting to mount or when mounted on a horse.
- Riders are required to purchase and wear their own helmet and boots after their second lesson. A helmet may be borrowed for the first two lessons, but will not be supplied after that. ABSOLUTELY no tennis shoes may be worn due to safety reasons.
State that rider is not now pregnant and that rider has no history of epileptic seizures, heart condition or any other medical problem that could be affected by horseback riding. Perennial Farm has my permission to use my or my child’s photograph publically to promote Perennial Farm. I understand that the images may be used in print publications (The Yacht Clubber), online publications (Online Yacht Clubber), websites (Perennial Farm or Tampa Yacht and Country Club website), and social media (Perennial Farm Social Media).
