STOKE RUN LLC: WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT

PLEASE READ CAREFULLY. THIS IS A LEGAL CONTRACT.

By signing this document, you waive certain legal rights, assume all risks, and release the owners, landowners, and operators from liability.

1. PARTIES RELEASED FROM LIABILITY

This waiver releases and forever discharges the following (collectively, “Released Parties”):

  • Stoke Run LLC, including owners Caleb Burns and Tecca Burns
  • Jeffrey T. Gillson, Trustee, and any related property trust(s)
  • All affiliated brands, sub-entities, contractors, volunteers, or organizations, including but not limited to Stoke Run Build Co and Ride for More Foundation
  • Any employees, event staff, promoters, vendors, lessees, sponsors, volunteers, contractors, instructors, and landowners
  • The owners, operators, and insurers of the real property located at 3495 Tugend Road, Butler, Ohio

2. ACTIVITIES AND AREAS COVERED

This agreement applies to any and all activities, including but not limited to:

  • Use or operation of BMX bikes, scooters, skateboards, inline skates, personal electric vehicles (PEVs), pit bikes, motorcycles, ATVs, UTVs, e-bikes, and gas or electric-powered vehicles
  • Use of ramps, trails, jumps, tracks, terrain features, or any facility structures
  • Spectating, volunteering, instructing, organizing, or participating in any event or recreational use
  • Competitions, races, recreational riding, training, or freestyle riding
  • Camping, fires, overnight stays, RVs, glamping units, use of any shower house or restroom facilities
  • Use of any staging, storage, food service, merchandise, or wash station areas

 3. ASSUMPTION OF RISK & WAIVER OF LIABILITY

I acknowledge that participation or presence at the Stoke Run facility involves inherent risks, including but not limited to:

  • Collisions, falls, crashes, errant rider behavior, terrain or feature malfunction
  • Failure or misuse of equipment (including my own), obstacles, fire, wildlife, weather, uneven surfaces, and visibility hazards
  • Risk of serious injury or death

I freely and voluntarily assume ALL risks, known or unknown, including those arising from the ordinary negligence of the Released Parties.

I fully waive and release the Released Parties from any and all liability, claims, or causes of action, including for injury, illness, death, or property damage, except in cases of gross negligence or willful misconduct.

4. NO INSURANCE PROVIDED

I understand that no insurance is provided to me by any Released Party. I am solely responsible for all medical care, property damage, or other costs resulting from any incident.

5. SAFETY GEAR POLICY (MANDATORY)

  • Helmets are REQUIRED for all participants under 18.
  • For motorized vehicles, helmets are mandatory for all riders, regardless of age.
  • Recommended gear includes: gloves, goggles, boots, long pants, and long sleeves.
  • Failure to follow gear policies or staff instructions may result in removal without refund.

6. RULES OF CONDUCT

I agree to:

  • Operate only in designated areas within my skill level
  • Refrain from indoor use of gas or electric-powered vehicles
  • Follow all posted signs and staff instructions
  • Avoid reckless or unsafe conduct toward others
  • Maintain personal accountability for safety and awareness

7. CAMPING AND OVERNIGHT STAY ACKNOWLEDGMENT

If I stay overnight, I accept all risks including, but not limited to:

  • Weather, wildlife, insects, terrain, fires, carbon monoxide, equipment failure, theft, and noise
  • I am responsible for my own safety, setup, fire safety, and generator use
  • I release all Released Parties from any claims arising from overnight stays or camping

8. SPECTATOR AND NON-PARTICIPANT ACKNOWLEDGMENT

Spectators and non-participants understand and agree that:

  • There is risk of injury from rider collisions, equipment, or flying debris
  • The facility contains uneven terrain, loud noise, dust, and weather exposure
  • Spectators must remain in designated viewing areas and assume all risks voluntarily

9. SELF-INSPECTION & HAZARD AWARENESS

I agree to personally inspect all areas before use and acknowledge that:

  • I am responsible for identifying and avoiding hazards
  • I will notify staff of any unsafe conditions before use

10. INDEMNIFICATION & HOLD HARMLESS AGREEMENT

To the fullest extent permitted by law, I agree to defend, indemnify, and hold harmless the Released Parties from any and all claims, demands, actions, losses, liabilities, and attorney fees arising from:

  • My presence, conduct, actions, or omissions
  • Any injury or damage caused to myself or others
  • Any violation of this agreement or facility rules

11. MEDIA RELEASE

I authorize the use of any photographs, videos, or recordings taken of me or my children for promotional, commercial, or documentation purposes by the Released Parties. I waive any rights to compensation or review.

12. OHIO LAW & LEGAL VENUE

This waiver is governed by the laws of the State of Ohio.

Any disputes must be brought exclusively in Richland County, Ohio, or the Federal Court for the Northern District of Ohio.

13. SEVERABILITY

If any portion of this agreement is found invalid, the remaining provisions shall remain in full force and effect.

14. RECREATIONAL IMMUNITY & ATHLETIC PARTICIPANT PROTECTIONS

Participants understand and agree that:

  • Under Ohio Revised Code § 1533.181, landowners are immune from liability for injuries sustained during recreational use of land, including biking, riding, and camping
  • Under Ohio’s Athletic Participant Doctrine, there is no liability for injuries resulting from inherent risks of voluntary sports participation
  • These laws may significantly limit or bar recovery of damages in the event of injury

15. HEALTH & FITNESS ACKNOWLEDGMENT

I confirm I am physically and mentally able to safely participate in the listed activities

I am not under the influence of drugs, alcohol, or impairing substances

16. BINDING AGREEMENT – KNOWING AND VOLUNTARY CONSENT

By signing below, I acknowledge:

  • I have read, understood, and voluntarily agree to this release
  • This waiver applies to this and all future visits to Stoke Run or affiliated events
  • I am signing on behalf of myself and/or my minor child(ren) knowingly and without coercion
