The undersigned (the “Participants”), for and in consideration of being permitted to participate in the activity or activities, as applicable, described below (collectively, the “Activity”), do, for themselves (and their respective spouses, heirs, executors, administrators and assigns) and on behalf of any of their minor children or grandchildren who are also participating in the Activity (collectively, the “Minors”), do hereby completely and fully release and discharge, and agree to defend and hold harmless, SANIBEL-CAPTIVA CONSERVATION FOUNDATION, INC., a Florida not-for-profit corporation, and its employees, officers, trustees and agents, as well as its affiliates, SANIBEL SEA SCHOOL, INC. and COASTAL WATCH (collectively, “SCCF”), of and from any action, liability, claim, loss or damage to person or property, including without limitation injury or death of a Participant or Minor, arising out or as a consequence of participation in the Activity.
Description of the Activity: - Observe and assist SCCF Marine Lab personnel in certain marine scientific research and related matters, which could include time on SCCF’s Oceanographic Research Vessel the Norma Campbell, or other SCCF vessels;
- Participate as a volunteer in monitoring the beaches of Sanibel, Captiva and North Captiva Islands for nesting sea turtles and shore birds;
- Participate in various projects of the Hammerheads group or the Trail Blazers group;
- Participate as a volunteer at the Nature Center or the Native Landscape & Garden Center; and/or
- Participate as a volunteer in other SCCF projects, activities or groups.
Participants acknowledge that neither they nor any of the Minors have any physical limitations, medical ailments, or physical or mental disabilities which would limit or prevent participating in the Activity.
This General Release will be construed in accordance with and governed by the laws of the State of Florida, excluding conflict of laws principles.
