Agreement of Release and Waiver of Liability, Acceptance of Risk, and Indemnity With Parental Consent for “Indoor Cricket Center Tampa”


1. SPORTS ACTIVITIES

By signing this Agreement, I acknowledge that I am giving up certain legal rights. This Agreement applies to my participation, or the participation of my minor child/ward, in activities at or through PowerPlay Tampa / Indoor Cricket Center Tampa, including cricket, soccer, baseball, and all other sports, training, practices, clinics, camps, events, and related activities (collectively, "Sports Activities").

2. BUSINESS IDENTITY AND RELEASED PARTIES

“Indoor Cricket Center Tampa LLC d/b/a PowerPlay Tampa” refer to the facility, programs, trade names, and operations conducted by or on behalf of Nova Sporting Group LLC. For purposes of this Agreement, Nova Sporting Group LLC, Indoor Cricket Center Tampa LLC d/b/a PowerPlay Tampa, and their respective owners, members, managers, affiliates, landlords, lessors, officers, directors, employees, independent contractors, coaches, instructors, volunteers, agents, vendors, sponsors, successors, and assigns are collectively the “Released Parties,” to the fullest extent permitted by law.

3. ASSUMPTION OF RISK

I understand that Sports Activities and use of the facility involve inherent and foreseeable risks, including falls, collisions, being struck by balls, bats, racquets, equipment, or other participants, overexertion, injuries, equipment malfunction, uneven or wet surfaces, and the actions or omissions of other participants, spectators, coaches, employees, contractors, or third parties.

These risks may result in injury, disability, death, or property damage. I knowingly and voluntarily assume these risks, whether I am participating, training, observing, entering or leaving the facility, or using parking areas, walkways, courts, cages, lanes, turf, nets, or other facility areas.

4. RELEASE OF LIABILITY

To the fullest extent permitted by Florida law, I release and hold harmless the Released Parties from claims, demands, damages, losses, liabilities, costs, and expenses arising from or relating to my participation, or that of my minor child/ward, in Sports Activities or use of the facility, including claims arising from the ordinary negligence of any Released Party. This release does not apply to claims that cannot legally be waived under applicable law.

5. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from claims, damages, liabilities, costs, expenses, and reasonable attorneys’ fees arising from my participation, or that of my minor child/ward, in Sports Activities, except to the extent caused by the negligence or wrongful conduct of a Released Party.

6. RULES AND EQUIPMENT

I agree to follow all posted rules and staff instructions, use equipment only as intended, and use appropriate protective equipment. I will not operate bowling machines, ball feeders, training machines, or other powered equipment unless authorized. PowerPlay Tampa and Nova Sporting Group LLC may suspend or terminate participation for unsafe conduct, misuse of equipment, or violation of facility rules.

7. MEDICAL TREATMENT

If I or my minor child/ward is injured or becomes ill and I am unable to provide instructions, I authorize the Released Parties to obtain or arrange reasonable first aid, emergency medical care, transportation, or emergency services. I understand that the Released Parties are not medical providers and do not guarantee the availability or outcome of medical treatment. I am responsible for all medical, ambulance, hospital, and related expenses.

8. PERSONAL PROPERTY

I am responsible for my personal property and my minor child/ward’s personal property. To the fullest extent permitted by law, the Released Parties are not responsible for loss, theft, disappearance, or damage to personal property brought to or left at the facility or surrounding areas.

9. PHOTOGRAPHY / VIDEO

I grant PowerPlay Tampa, Nova Sporting Group LLC, and their authorized representatives permission to photograph, videotape, and otherwise record me and/or my minor child/ward during Sports Activities. I authorize the use of such images and recordings for promotional, advertising, social media, and other business purposes without compensation or further approval, and release the Released Parties from claims arising from such permitted use.

10. MINOR PARTICIPANT

As the parent or legal guardian of a minor participant, I consent to the minor’s participation in Sports Activities and confirm that I have authority to provide this consent. I understand the risks described above and agree that all applicable acknowledgments, assumptions of risk, releases, and indemnification obligations apply to the minor participant to the fullest extent permitted by law.

11. GENERAL / CONTINUING EFFECT

I have read and understand this Agreement and voluntarily agree to its terms. If any provision is found invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

This Agreement is governed by Florida law, and to the extent permitted by law, any legal action relating to this Agreement or participation at the facility shall be brought in Hillsborough County, Florida.

An electronic signature, click-through acceptance, or Smartwaiver execution has the same force and effect as a handwritten signature. Unless replaced by a later written waiver, this Agreement applies to all visits, memberships, rentals, practices, clinics, camps, events, and Sports Activities at or through PowerPlay Tampa / Nova Sporting Group LLC.

PARTICIPANT / PARENT OR LEGAL GUARDIAN ACKNOWLEDGMENT

By signing electronically, I confirm that I have read, understood, and voluntarily agreed to this Agreement and that the information provided in the Smartwaiver form is accurate.
