In consideration of being permitted to rent bike equipment or participate in a sponsored Event from The Line Experience, Inc. ("The Line"), I, agree to the following terms and conditions: 

Section 1. I acknowledge, agree, and represent that I understand the nature of biking and that I am qualified, in good health, and in proper physical condition to participate in biking. I further agree and warrant that if I believe the conditions to be unsafe, I will immediately discontinue further participation.

Section 2. I understand that (a) mountain/gravel or other forms of biking entails known and unknown risks, inherent and otherwise, that could result in serious bodily injury including permanent disability and paralysis, property damage, emotional injury, illness, or death; (b) these risks and dangers may be caused by my own actions or inactions including my own negligence, inexperience, fatigue, loss of balance, and inability to control speed and direction, the actions or inactions of others, the terrain including variations in the riding surface and manmade structures, the weather, mechanical failure of the equipment, encounters with wildlife, or the negligence of the Released Parties (defined below); (c) there may be other risks or social and economic losses either not known to me or not readily foreseeable at this time. I AM AWARE OF THE RISKS, DANGERS, AND HAZARDS ASSOCIATED WITH THE USE OF THE EQUIPMENT AND FACILITIES, AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGES, LOSSES, COSTS, AND DAMAGES RESULTING THEREFROM.

Section 3. I acknowledge that I am ultimately responsible for my own safety during my use of The Line’s equipment and facilities. I WILL WEAR A HELMET AT ALL TIMES WHILE BIKING and will obey all trail signs and remain on open trails. I agree to abide by all written and unwritten rules of the Line which may from time to time be made or implemented by The Line.

Section 4. I specifically acknowledge that The Line and its staff, volunteers, and instructors may be ignorant of my or another rider's fitness or abilities, may choose the wrong bike for me or another rider, may give inadequate warnings or instructions, may choose improper equipment, and may fail to maintain, fit, or adjust the equipment.

Section 5. My use of The Line’s equipment and facilities or participation in a Line sponsored event or ride is purely voluntary. By signing this agreement, I expressly agree and promise to accept and assume all the risks identified herein and those risks not specifically identified, both inherent and otherwise.

Section 6. I hereby voluntarily and forever release, discharge, and covenant not to sue The Line, its administrators, directors, agents, officers, trainers, members, volunteers, and employees, officials, and rescue personnel (collectively, the “Released Parties”) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, EXPENSES OR DAMAGES relating to any claim that I may have, now or in the future, based on or related to my use of The Line’s equipment or facilities. I AGREE TO INDEMNIFY AND HOLD HARMLESS EACH OF THE RELEASED PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, COSTS, LOSSES, DAMAGES AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) INCURRED BY ANY RELEASED PARTY ARISING OUT OF OR IN CONNECTION WITH MY USE OF THE EQUIPMENT OR FACILITIES.

Section 7. I further represent and warrant that I have the power, capacity, and authority to enter into this agreement. I agree that this agreement shall be legally binding upon me personally, all members of my family and all minors participating with me, my and their heirs, successors, assigns, and legal representatives, it being my intention to assume all the risks associated with this activity and to release The Line from any and all liabilities. 

Section 8. I hereby consent to and permit emergency treatment in the event of injury or illness. I either have appropriate insurance, or in its absence, agree to pay all costs of rescue and medical services as may be incurred on my behalf.

Section 9. The laws of the State of Washington will govern this agreement, without regard to choice of law principles. Actions or claims of any type related to this agreement shall be brought in the appropriate court in King County, State of Washington, USA, and the parties hereby submit to the venue and jurisdiction of such court and waive any objection thereto (irrespective of whether the individual signing this agreement changes his or her state of residence). 

Section 10. If any provision of this agreement is found to be unenforceable in any respect by a court of competent jurisdiction, it is my intention and understanding that this agreement will nonetheless be enforced to the maximum extent to which it is found to be legally enforceable. 

I HAVE READ, UNDERSTAND, AND ACCEPT THE TERMS AND CONDITIONS OF THIS AGREEMENT. I AGREE TO ACCEPT AND ASSUME ALL OF THE RISKS OF THE ACTIVITIES WHICH I AM TO PARTICIPATE IN. I AGREE TO RELEASE AND DISCHARGE THE LINE FROM ALL CLAIMS, LIABILITIES, AND LOSSES ASSERTED BY OR ON BEHALF OF ME ARISING FROM OR RELATED TO MY USE OF THE EQUIPMENT OR FACILITIES. BY SIGNING THIS RELEASE, I AM GIVING UP ANY RIGHT TO FILE A LAWSUIT. THIS RELEASE INCLUDES CLAIMS FOR PHYSICAL AND EMOTIONAL INJURY, PROPERTY DAMAGE, ILLNESS, OR DEATH.

MINOR RELEASE (must be completed by parent/legal guardian for renter under age 18)

I, as parent or legal guardian of the below renter, hereby give my permission for the renter to rent the equipment. My signature below reflects my understanding and agreement, for myself and on behalf of the renter, to the terms stated in this agreement. I have explained to the renter the risks and terms stated in this agreement. I acknowledge that I am waiving any and all rights that my child or ward may have to bring a lawsuit against The Line for any damages, including injury or death, caused in whole or in part by the negligence of The Line. I further agree to defend, hold harmless, and indemnify The Line from any claim and from any liability incurred by any Released Party arising out of or in connection with my use of the equipment or facilities.
