Passenger Liability Waiver & Assumption‑of‑Risk AgreementNOTICE: By signing below you waive certain legal rights, including the right to sue. Read carefully. 1. PartiesThis Agreement (“Waiver”) is entered into on November 5, 2025 between Eco Buzz Tours LLC, an Arizona limited‑liability company (“Company”), and the undersigned participant (“Passenger”). 2. Description of ActivityPassenger will participate in a guided tour provided by Eco Buzz Tours, LLC, involving travel in the Company's 2025 Volkswagen ID.Buzz to various wineries and/or breweries in southern Arizona. The specific date of the tour (the "Tour Date") will be selected by the Passenger at the time of booking and is recorded in the Company's reservation system. This waiver applies to the Passenger's participation in the Tour on the Tour Date. 3. Assumption of RiskPassenger understands that the Tour involves risks that include, but are not limited to, vehicle travel on public roads, entering and exiting the van, walking on uneven terrain, weather conditions, wildlife encounters, consumption of alcoholic beverages, and actions of third parties. Passenger voluntarily assumes all such risks, both known and unknown. 4. Temporary Unsupervised Periods During Charging
Eco Buzz Tours LLC operates fully electric vehicles that may occasionally require a brief charging stop during the course of a tour. In such cases, guests may be asked to remain at a public venue (such as a winery) without direct supervision for approximately 30–40 minutes while the vehicle is charged. By signing below, Passenger accepts responsibility for their own conduct and safety during this time and agrees that Eco Buzz Tours LLC and its representatives shall not be held liable for any incidents, injuries, or other issues arising during these periods. The tour operator will remain reachable by phone or text if needed. 5. Release & Waiver of LiabilityIn consideration of being permitted to participate, Passenger releases, waives, discharges, and agrees not to sue the Company, its owners, employees, contractors, vehicle manufacturer, and winery/brewery partners for any claims, demands, losses, or damages arising from ordinary negligence in connection with the Tour. This waiver does not apply to gross negligence, recklessness, or intentional misconduct as defined by Arizona law. 6. Alcohol & ConductPassenger affirms and agrees to the following: - Legal Drinking Age: Only passengers who are 21 years of age or older and possess valid government-issued identification are permitted to consume alcohol during the Tour. Passengers who are under 21 or who do not have appropriate identification agree that they will not consume alcohol at any time during the Tour.
- Prohibition of Alcohol in the Vehicle:Consumption of alcohol and possession of open containers are strictly prohibited within the Eco Buzz Tours vehicle. This policy is in compliance with Arizona Revised Statutes § 4-251, which prohibits the presence of open containers of alcohol in the passenger area of a motor vehicle on public highways. While some other companies may allow in-vehicle alcohol consumption, Eco Buzz Tours' current license does not permit this. Passengers must store any opened alcoholic beverages in the trunk or another area of the vehicle not readily accessible to occupants
- Responsible Behavior: Passengers agree to consume alcohol responsibly and to comply with all instructions from the driver-guide. The Company reserves the right to refuse service or terminate the Tour without refund for any passenger exhibiting disruptive or unsafe behavior.
- Seat Belt Usage: Passengers are required to wear seat belts whenever the vehicle is in motion.
7. Health & Medical TreatmentPassenger certifies they are physically able to participate and do not have medical conditions that would make Tour participation unsafe. Passenger authorizes the Company to obtain emergency medical care if necessary and agrees to be responsible for associated costs. 8. Property Loss or DamagePassenger is responsible for personal belongings. The Company is not liable for lost, stolen, or damaged items. Any excessive cleaning fees or damage to the vehicle caused by Passenger are governed by a separate Rental & Damage Agreement signed by the booking party. 9. IndemnificationPassenger agrees to indemnify and hold harmless the Company from any claims brought by third parties arising out of Passenger’s own acts or omissions during the Tour. 10. Governing Law & SeverabilityThis Waiver is governed by the laws of the State of Arizona. If any provision is held invalid, the remaining provisions remain in full force. 11. Acknowledgment of UnderstandingPassenger has read this Waiver, fully understands its terms, and signs it freely and voluntarily with the intent to be legally bound. (Parents/guardians must sign on behalf of minors.)
