 WAIVER AND RELEASE OF LIABILITY

The Park is committed to Exceptional Guest Experiences by providing a safe and enjoyable environment for all Guests.

THE GEORGIA SAFARI CONSERVATION PARK, LLC (“The Park” or “Park”) REQUIRES THE TICKET

HOLDER OR LODGING GUEST (“Ticket Holder” or “Lodging Guest” or “Guest” or “You” or “I” and includes any minors or other persons in Ticket Holder’s or Lodging Guest’s care or charge (“Guest’s Party” or “Party”) while at The Park) TO HONOR THE FOLLOWING CODE OF CONDUCT:

The following are NOT PERMITTEDat The Park and may result in removal from The Park without a refund:

•   Firearms, ammunition, knives, and weapons of any kind. Self-defense or restraining devices (e.g., pepper spray, mace). Including objects or toys that appear to be firearms or weapons.

•   Fireworks or other similarly explosive and/or flammable objects, smoke machines, or fog machines.

•   Smoking, vaping, and products that produce vapor or smoke, such as incense. Smoking and vaping are only permitted in designated smoking areas.

•    Marijuana (including marijuana enriched products) or any illegal substance.

•    While beverages in appropriate containers (Glass containers are prohibited) are acceptable, food is not permitted aboard safari touring vehicles or during animal encounters, programs and Activities.

•    Pets; excluding assistance from certified service animals.

•    Balloons or inflatables.

•   Recreational devices such as remote-control toys, skateboards, scooters, inline skates, shoes with built-in wheels, bicycles (these may remain on vehicle racks during Park stay) or other skating equipment..

•    Large beach umbrellas

•    Lounge or folding chairs

•    Radios and amplified sound equipment (Park contracted Special Events excepted)

•    Grills or open fires outside of designated fire pit areas operated by Park staff

•   Clothing with offensive language, obscene gestures/graphics, or nudity. Clothing that does not sufficiently cover the undergarments. Face coverings designed to conceal identity. (Medical masks are allowed if required by the Guest.)

•   Family-oriented themed outfits/attire are permitted. Costumes that conceal identity are prohibited. Specific Activities may also have additional restrictions on attire. NOTE: Open-air safaris are held rain or shine;    please dress appropriately.

•   The launching and/or operation of an Unmanned Aircraft System (“UAS” or “Drone”) from or above The Park’s property is strictly prohibited.

•   Laser Pointers, strobe, and spotlights are prohibited on Park property unless used inside an event facility for meeting purposes.

•   Unruly or disruptive behavior that interferes with guests’ enjoyment of The Park, including running, the incitement of running, and blocking pathways and exits.

•   Acts or behavior that Park management deems to be a safety concern or that interrupts Park operations or guests’ experience.

•   Harassing/threatening behavior, sexual misconduct, or lewd behavior, including inappropriate interaction with park guests or associates.

•    Fighting or physical aggression of any kind, including verbal assaults.

•    Offensive language or gestures.

•   Conduct deemed by The Park to be inappropriate for the peace and good order of the park, guests, or associates, and which may adversely affect the safety of others.

•    Theft of any kind.

•   Selling Park tickets, credentials, and other entitlements, or soliciting and distributing literature not sponsored by The Park except where otherwise approved.

•   Refusing to follow verbal or printed instructions or cooperate with Park personnel or security.

•   Venturing into Restricted Areas. Guests are not permitted in any restricted areas unless accompanied by Park staff including but not limited to, animal barns and housing, fenced off pastures and yards, offices, exhibits, maintenance and service buildings, service roads, perimeter fencing etc. Overnight guests may not explore Park grounds after Park closing and may not approach animals in exhibits, pastures or holding yards unless accompanied by Park staff. Please note that The Park utilizes security cameras to monitor the safety of our animals and guests.

•   Attempting to enter animal enclosures, crossing established habitat barriers, and harassing animals are actions punishable in accordance with all applicable local, state and federal law and may result in misdemeanor and/or felony charges.

•   Unsolicited photography or video recording that disrupts a guest’s experience or interferes with Park operations. You are welcome to take photos and/or video for personal use only; commercial photography requires written permission from The Park’s Community Relations department. When taking photos/videos, guests are not permitted to cross barriers or use devices, tripods or bright lighting, to do so.

NOTICE TO PARENTS AND GUARDIANS - TEENS/CHILDREN: Parents or guardians

are responsible for the behavior of their minor children. Appropriate behavior and supervision are the responsibility of the parent/guardian and is always expected. The Park does not assume any responsibility or liability for unattended minors. Parents/guardians may be held legally liable for all acts of the children under their care.

CHAPERONE POLICY: Under this policy, all guests aged 18 years old or younger must be accompanied by a chaperone who is at least 21 years old to be admitted to or remain in The Park.

The chaperone must present a valid government-issued photo identification with date of birth at ticket entry. One (1) chaperone may accompany no more than fifteen (15) guests ages 18 or younger per Park visit. In addition, the chaperone must accompany their party during entry, remain inside the park during their visit, and be available by phone throughout their time at The Park.

Guests 18 years of age or older may be asked to present a valid government-issued photo identification (Driver's license, state-issued ID Card, or Passport) with date of birth at entry to verify their age. If unable to verify proof of age, guests may be denied entry into The Park.

Guests aged 18 years old or younger who are found inside The Park unaccompanied by a chaperone will be subject to ejection. This chaperone requirement applies to all Ticket Holders.

Additional Lodging Items

Late Arrival – Lodging: Check-in is from 4:00 pm to 5:30 pm daily. If your party requires a late check-in or will arrive after Park closing at 6:00 pm, please contact Guest Services at 706-443- 0097 prior to 4:00 pm on the day of your arrival for instructions.

Check out is at 11:00 am.

Quiet Hours: For the safety and well-being of our guests and animals, all guests agree to adhere to “Quiet Hours” after 10:00 PM.

Food and Coaxing Approach: For the safety of our animals, guests will not attempt to feed or coax the approach of any animals using or tossing food into a containment area. Guests in the Giraffe Barn Suite will not tap or make noise on glass windows to illicit an approach by any animals.

Smoking: The Park has designated smoking areas for our Lodging Guests and is otherwise a smoke-free property dedicated to the health and safety of the animals in our care, guests, and employees. This policy includes all use of smoking products, including cigarettes, cigars, pipes as well as alternative smoking devices including e-cigarettes. Smoking in or around any lodging accommodations is cause for immediate removal without refund, and a sanitization fee of $1,500.00 will be charged to the credit card on file for that reservation.

Governing Law: This Code of Conduct, and its application and interpretation shall be governed exclusively by Georgia law, and the Guest acknowledges and stipulates that any suits, actions, and/or other proceedings arising from or related to this Code of Conduct shall be brought in the state courts in Morgan County, Georgia, and the Guest hereby irrevocably consents to the personal jurisdiction and venue to such court in any such suits, actions, and/or proceedings. The Guest also irrevocably waives any and all rights to trial by jury in any such suits, actions, and/or proceedings between the parties.


Violation of the Terms & Conditions or Code of Conduct: You understand that any violation of the Park’s Terms and Conditions and/or Code of Conduct may result in cancellation of your reservation and you forfeiting any monies paid for such reservation. The Park has the right and duty to charge your credit card account on file for any costs it incurs as a result of such violation.

Notice: The Park’s Security personnel utilize surveillance cameras and body-worn cameras as part of their overall security program.

THE GEORGIA SAFARI CONSERVATION PARK, LLC (“The Park” or “Park”) REQUIRES THE TICKET

HOLDER OR LODGING GUEST (“Ticket Holder” or “Lodging Guest” or “Guest” or “You” or “I” and includes any minors or other persons in Ticket Holder’s or Lodging Guest’s care or charge (“Guest’s Party” or “Party”) while at The Park) TO AGREE TO THE FOLLOWING TERMS & CONDITIONS:

Ticket Terms & Conditions

All Sales Are Final: I agree that all ticket sales are final. There are no refunds or exchanges. Tickets are only valid for a set Tour on a specific date at The Park and are subject to availability. Lodging, Tickets, products or services booked with an invalid credit card are subject to immediate cancellation.

Official Records: Emailed ticket confirmations are provided to You solely for your convenience. The Park retains the official records of reservation transactions, including details of dates of your Tour, product and service rates. In the event of discrepancies, alterations, modifications, or variations between this confirmation and our official records, The Park’s official records shall prevail. Tampering with any confirmation record to alter any product or service rate or any other Tour reservation information is strictly prohibited and will have legal consequences.

Permission to Photograph or capture Video Image: Entry into any of The Park constitutes consent for The Park to take a photographic image of Ticket Holder, Ticket Holder’s Party or any minor children Ticket Holder is supervising for any purpose stated in The Park’s Privacy Policy.

Security Screening: Prior to entering the park, all guests may be required to go through a bag check and metal detection screening, and you hereby consent to doing so if requested.

Lost Property: The Park is not responsible for lost or stolen property of a Ticket Holder.

Improper Behavior: A Ticket is the property of The Park and is non-transferable, non-refundable, non-exchangeable, and not valid for cash. A Ticket may also be revoked without refund, and the Ticket Holder removed from the park for any misuse, failure to abide by applicable Terms and Conditions or conduct detrimental to The Park, including, but not limited to, theft of property or services, violation of Federal, State, Provincial and Local laws, assisting any person to obtain unauthorized entry, violation of Park rules, safety procedures, vandalism, disorderly conduct, intoxication, and possession of intoxicating liquors, drugs or weapons.

Late Arrival – Touring: It is important for our tours to depart on time. We cannot hold a tour for late arrivals. As a reminder, all Tour ticket sales are final, and we can't reschedule or refund your money. If you have booked a PREMIER or SUNSET TOUR and your group is delayed in transit and expects to be more than 15 minutes late, please contact Reservations at 706-342- 4296.

Pets: For the safety and well-being of our guests, animals, and staff, no pets, including emotional support animals, are allowed on the Park property. Guests are not permitted to leave their pets in their vehicles for any reason during their visit to the Park. For convenience, daycare and boarding options are available at the LODGE MADISON – an independent full-service, boarding, grooming, training, and day care facility located a few miles from the Park. Reservations for your pet at the LODGE MADISON may be made in advance of your visit by calling (706) 707-7829 or online at https://thelodge.pet/. Reservations at the Lodge are subject to availability and not guaranteed by the Park or by your reservation at the Park.

Service Animals: Georgia Safari Conservation Park is committed to providing an inclusive and accessible experience for all guests, including those with disabilities who rely on service animals. Although prohibited from all Tours and all animal encounter activities, service animals are allowed in our Lodging options. Service animals must wear official service animal harnesses or vests identifying them as a service animal and be properly leashed while in the Park Grounds. Certified service animals may accompany owners in lodging accommodations, provided they are well-behaved and maintain their training. Service animals who exhibit excessive barking or aggression towards our animals, staff, or other guests will be asked to leave the Park along with their owners without refund.

ADA Accommodation: The Park adheres to the standards set forth by the Americans with Disabilities Act (ADA) to ensure that everyone, regardless of their abilities, can fully partake in our lodging and touring offerings. Our public spaces and safari touring vehicles are designed to be wheelchair-friendly for guests with mobility challenges, and lodging is equipped with ADA-compliant amenities to offer a comfortable and welcoming stay.

Area Closings: The Park may elect to close certain areas or attractions due to maintenance issues, animal health concerns, weather hazards or other safety conditions and will re-open as soon as is safely possible.

Alcoholic Beverage Policy: You must be 21 years of age (valid state-issued driver's license with photo or state-issued identification card with photo required by state law) to possess or consume alcoholic beverages at The Park. No outside alcohol may be brought into The Park except by Lodging guests and only in reasonable amounts for the number of guests in their Party. For Park activities and events where alcohol is served, no one is permitted to take alcoholic beverages outside Park grounds.


LODGING: Additional Terms & Conditions

In addition to the Ticket Terms & Conditions, Lodging Guests will be held accountable to the following Lodging-specific Terms & Conditions:

Lodging & Activity Availability: The lodging offerings indicated on The Park’s website, as well as other products and services advertised, are subject to availability.

Cancellation Policy – LODGING ONLY:

All lodging reservations must be paid in full at the time of booking. To cancel or reschedule your Lodging reservation, please call 706-342-4296. Refunds for cancellations will be issued according to the following schedule:

Rescheduling Your Reservation: If you cancel and immediately rebook your lodging or touring reservation at the time of cancellation, and your cancellation/rebooking falls within the reservation window that guarantees a 100% refund, you will not be charged a rebooking fee. Any reservations that are cancelled and rebooked in either the 50% or 0% refund category per the schedules above will be charged a $50.00 rebooking fee at the time of rebooking.

Late Arrival – Lodging: Check-in is between 4:00 pm and 5:30 pm daily. If your party requires a late check-in or will arrive after Park's closing at 6:00 pm, please contact Guest Services at 706-443-0097 prior to 4:00 pm on the day of your arrival for instructions.

Cooking food other than in the provided microwave is prohibited. All food and beverages (no glass) must be enjoyed in designated areas. While beverages in appropriate containers are acceptable, food is not permitted aboard safari touring vehicles or during animal encounters, programs, and Activities.

Smoking: The Park has designated smoking areas for our Lodging Guests and is otherwise a smoke-free property dedicated to the health and safety of the animals in our care, guests, and employees. This policy includes all use of smoking products, including cigarettes, cigars, pipes as well as alternative smoking devices, including e-cigarettes. Smoking in or around any lodging accommodations is cause for immediate removal without refund and a sanitization fee of $1,500.00 will be charged to the credit card on file for that reservation.

Other Terms and Conditions

Currency: Reservations will be charged in The Park’s local currency as shown on The Park’s website. The price shown is based on today’s exchange rate. A foreign currency transaction fee may be charged by your card provider. Any deposits or pre-payments will be deducted from the final reservation invoice in The Park’s local currency.

A refund of a deposit or prepayment, if any, will be subject to the exchange rate applied by your payment card provider at the time of any such refund and may differ from the exchange rate applied at the time such deposit or prepayment was made.

Warning and Indemnification:

Ticket Holder and Lodging Guest acknowledge the potential for injury while participating in safari tours, animal encounters, and all other activities (“Activity” OR “Activities”) while on the Premises owned and operated by The Park.

IN CONSIDERATION OF my desire to participate in said Activities and being given the right to participate in the same;

I HEREBY, for myself, minors or others in my care and charge (Ticket Holder’s and Lodging Guest’s “Party”) at The Park, all heirs, executors, administrators, assigns, or personal representatives (hereinafter collectively, “Releasor(s),” “I” or “me” or “Party,” which terms shall also include Releasor’s parents or guardian if Releasor is under 18 years of age), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my and my Party’s participation in the Activities; and;

I HEREBY release and forever discharge the Park, located at or about 1761 Monticello Highway, Madison, Morgan County, Georgia 30650 (“Premises”), their affiliates, land owners, managers, partners, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, employees, and/or assigns (collectively “Releasees”), from any physical or psychological injury that I may suffer as a direct result of my or my Party’s participation in the aforementioned Activities. I further release The Park from any and all liability for damage to my or my Party’s vehicle(s) while moving through The Park’s property or while parked on property.

Acknowledgment of Risks: I understand and acknowledge that I am voluntarily participating in an aforementioned Activity that involves inherent risks and dangers, including but not limited to, risks of injury from wild animals, risks from the natural environment, risks related to travel to and from the Activity, risk associated with riding on one of The Park’s vehicles, and risks associated with any other outdoor Activities, that these risks might arise from my own or other people’s negligence that could include physical or psychological injury, pain suffering, illness, economic or emotional loss, nonetheless I voluntarily assume all risks associated with my participation in any Activity on the premises at The Park.

1. ASSUMPTION OF ALL RISKS - PERSONAL INJURY, ILLNESS, OR DEATH: I (on behalf of myself and any other persons in my Party) acknowledge and understand that there are innumerable risks involved with outdoor environments and activities, with man-made structures, and with animal encounters. I hereby agree that by visiting the Park, I am ASSUMINGALL RISKS of any kind or nature whatsoever, including, without limitation, any incidents, accidents, injuries, illnesses, and/or death. This ASSUMPTION OF RISK includes all obvious and non-obvious risks, including, without limitation,n any animal encounters (animal bites, kicks, contact, bumps or knockdowns, the fear of a possible animal attack or charging animal, animal excretion, animal illnesses, non-Park wild animals or domesticated animals), any slip/trip/falls (whether on man-made or natural surfaces, or structures), natural habitat hazards (insect stings, snakes, falling branches, tree roots, rocks, etc.), features of the Park (including fences, sheds, unpaved roads, stairs, electrical systems), food and beverage illnesses, water and air born illnesses, illnesses transmitted from or to humans and/or animals, hazards related to The Park’s vehicles or guest vehicles, hazards caused by other guests (including the reckless, willful misconduct, or criminal acts of other guests or unauthorized trespassers), sun and heat, weather and sudden weather events (e.g., hail, tornados, microburst storms, lightning, rain, wind, etc.). In any event of an incident, accident, injury, illness, or death, I (on behalf of myself, my heirs and beneficiaries, and on behalf of any member of my Party), WAIVE AND RELEASE THE PARK OF ANY AND ALL CLAIMS, AND COVENANTS NOT TO SUE OR MAKE CLAIMS (“The Park” as used in this section, includes, without limitation, all Park owners, shareholders, officers, managers, employees, vendors, suppliers, insurers, brokers, attorneys, consultants, contractors, subsidiaries, and/or affiliates). I acknowledge that such previously described Activities are INHERENTLY DANGEROUS and that participation in such Activities involves an ASSUMPTION OF RISK that could result in damage to property, injury, or death, and I hereby knowingly and voluntarily assume all such risk.

2.   INDEMNIFICATION:I agree to indemnify and hold harmless The Park from any loss, liability, damage, or costs, including court costs and attorney’s fees, that may be incurred due to my or my Party’s participation in any Activity while on the premises at The Park even if the Ticket Holder contends that such injuries are the result of negligence on the part of The Park or Park staff.

3.   WAIVER OF JURY TRIAL:I, INDIVIDUALLY, AND ON BEHALF OF ANY MINOR CHILDREN FOR WHOM I AM SUPERVISING, AND EACH OTHER PERSON IN MY PARTY, IRREVOCABLY WAIVE ANY RIGHT TO A JURY TRIAL IN ANY SUITS, ACTIONS, AND/OR PROCEEDINGS AGAINST THE PARK.

4.   HEALTH & SAFETY:I confirm that I, and my Party, are physically and mentally capable of participating in all Activities and have no medical conditions that would affect my, and my Party’s, safety or the safety of others during such Activities. I agree to comply with all safety instructions and regulations provided by The Park and its staff. If I should require medical care or treatment, I authorize the Park to provide all emergency medical care deemed necessary, including but not limited to first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred because of such treatment.

5.   RULES & REGULATIONS – CODE OF CONDUCT: I agree to adhere to all Terms and Conditions of The Park’s rules and regulations (“Code of Conduct”), including but not limited to prohibited animal feeding and animal harassment, and disruptive behavior. I understand that any violation of the Code of Conduct may result in the immediate removal from Park Premises with no consideration of refund of any payments made and Activities not consumed.

6.   ERRORS & OMISSIONS:I acknowledge that The Park is not responsible for errors, omissions, acts, or failures to act of any person or entity conducting a specific Activity.

7. SURVIVABILITY:The provisions, covenants, conditions, and indemnities contained in this Release shall survive the term of all my or my Party’s Activities with The Park and my and my Party’s stay on the Park’s premises. I represent and warrant that (a) I have had ample opportunity to read this Release and have done so; (b) I fully understand and voluntarily agree to each term of this release; (c) I have the authority to sign this Release for all those in my Party including minors; (d) I am under no duress or requirement to sign this Release; (e) I have not been induced to sign this Release by any statement or conduct of the Park, its agents, volunteers, employees, officers and/or our directors or owners; and (f) I have the mental competency to understand and enter into this Release.

8.   MINOR CHILDREN: If minor children are covered by this waiver, I represent that I have complete and absolute authority to bind, contract for and legally act on behalf of the minor child/children in my Party and have the legal authority to make the waivers and releases contained here. I understand and acknowledge that The Park relies to its detriment on this representation and would not allow the minor child/children to participate in its programs or activities without this representation. In consideration of the minor child/children in my Party being permitted by The Park to participate in its programs and activities and to use its equipment and facilities, I further agree to indemnify and hold The Park its owners, agents, volunteers, employees, officers and directors and any and all said landowners harmless from any and all claims which are brought by, or on behalf of any minor child in my Party, and which are in any way connected with such use of participation by any such minor child. I further agree to accompany and supervise the minor(s) present at all times and be responsible for any property damage directly caused by the minor(s) due to my failure to supervise.

Governing Law:This Agreement, and its application and interpretation shall be governed exclusively by Georgia law, and the Guest acknowledges and stipulates that any suits, actions, and/or other proceedings arising from or related to this Agreement shall be brought in the state courts in Morgan County, Georgia, and the Guest hereby irrevocably consents to the personal jurisdiction and venue to such court in any such suits, actions, and/or proceedings. The Guest also irrevocably waives any and all rights to trial by jury in any such suits, actions, and/or proceedings between the parties.
