SECTION 1 — PARTIESThis Rental Agreement and Liability Waiver ("Agreement") is entered into between Turnagain Outfitters LLC ("Company") and the undersigned customer ("Renter"). By signing this Agreement, Renter agrees to all terms and conditions set forth herein. SECTION 2 — GENERAL ASSUMPTION OF RISKRenter acknowledges that outdoor recreational activities, including but not limited to fishing, camping, hiking, ice fishing, and backcountry travel in Alaska, involve inherent risks, dangers, and hazards. These risks include, but are not limited to: wild animal encounters, extreme weather conditions, difficult terrain, cold water immersion, hypothermia, injury from equipment use, and other risks beyond the Company's control. Renter voluntarily assumes full responsibility for all risks, known and unknown, associated with the use of rented equipment and participation in any outdoor activity. SECTION 3 — RELEASE OF LIABILITYTo the fullest extent permitted by Alaska law, Renter hereby releases, waives, discharges, and covenants not to sue Turnagain Outfitters LLC, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury (including death) that may be sustained by Renter or any minor in Renter's care, whether caused by negligence of the Company or otherwise, while using rented equipment or engaging in any related outdoor activity. SECTION 4 — EQUIPMENT RESPONSIBILITY & DAMAGE POLICYRenter agrees to: - Use all rented equipment only for its intended purpose and in a safe and responsible manner
- Return all equipment in the same condition as received, normal wear and tear excepted
- Accept full financial responsibility for any loss, theft, damage, or destruction of rented equipment
- Notify the Company immediately of any equipment damage, malfunction, or loss
- Not sublet, loan, or transfer rented equipment to any third party
Renter understands that failure to return equipment or returning equipment in damaged condition may result in charges to the payment method on file equal to the replacement cost of the equipment. |
