Turnagain Outfitters Rental Agreement

SECTION 1 — PARTIES

This Rental Agreement and Liability Waiver ("Agreement") is entered into between Turnagain Outfitters LLC ("Company") and the undersigned customer ("Renter"). By signing this Agreement, Renter agrees to all terms and conditions set forth herein.

SECTION 2 — GENERAL ASSUMPTION OF RISK

Renter acknowledges that outdoor recreational activities, including but not limited to fishing, camping, hiking, ice fishing, and backcountry travel in Alaska, involve inherent risks, dangers, and hazards. These risks include, but are not limited to: wild animal encounters, extreme weather conditions, difficult terrain, cold water immersion, hypothermia, injury from equipment use, and other risks beyond the Company's control.

Renter voluntarily assumes full responsibility for all risks, known and unknown, associated with the use of rented equipment and participation in any outdoor activity.

SECTION 3 — RELEASE OF LIABILITY

To the fullest extent permitted by Alaska law, Renter hereby releases, waives, discharges, and covenants not to sue Turnagain Outfitters LLC, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury (including death) that may be sustained by Renter or any minor in Renter's care, whether caused by negligence of the Company or otherwise, while using rented equipment or engaging in any related outdoor activity.

SECTION 4 — EQUIPMENT RESPONSIBILITY & DAMAGE POLICY

Renter agrees to:

  • Use all rented equipment only for its intended purpose and in a safe and responsible manner
  • Return all equipment in the same condition as received, normal wear and tear excepted
  • Accept full financial responsibility for any loss, theft, damage, or destruction of rented equipment
  • Notify the Company immediately of any equipment damage, malfunction, or loss
  • Not sublet, loan, or transfer rented equipment to any third party

Renter understands that failure to return equipment or returning equipment in damaged condition may result in charges to the payment method on file equal to the replacement cost of the equipment.

BEAR SPRAY

Renter acknowledges and agrees that:

  • Bear spray is a pressurized aerosol device containing capsaicin (pepper spray) and must be handled with extreme care
  • Bear spray must be kept away from children, heat sources, and open flames at all times
  • Renter has received or will review manufacturer safety instructions prior to use
  • Accidental discharge can cause severe eye, skin, and respiratory irritation — Renter assumes all risk of injury from improper handling or accidental discharge
  • Bear spray is prohibited on commercial aircraft (TSA regulated). Renter is solely responsible for ensuring bear spray is not transported via air travel. The Company is not responsible for confiscation by TSA, airline, or any law enforcement agency
  • Bear spray must be returned with the safety clip intact and the canister undeployed. A deployed or missing canister will result in full replacement charges
KNIVES, BLADES & SHARP IMPLEMENTS

Renter acknowledges that rented items may include sharp instruments including fillet knives, field dressing tools, fishing hooks, and related tackle. Renter assumes all risk of cuts, punctures, or lacerations resulting from use of these items. Renter agrees to handle all sharp implements with appropriate care and to keep them out of reach of minors.

Hooks, lures, and tackle are consumable items. Renter accepts that normal use may result in loss of individual items and that reasonable loss will not be charged. Deliberate misuse or negligent loss of significant quantities may be charged at replacement cost.

STOVES, FUEL CANISTERS & FLAMMABLE MATERIALS

Renter acknowledges that rented equipment may include pressurized fuel canisters and flammable liquids. Renter agrees to:

  • Follow all manufacturer safety instructions for stove and fuel use
  • Never use fuel-burning equipment inside a tent, vehicle, or enclosed space
  • Store fuel away from heat sources and open flame
  • Not transport pressurized fuel canisters on commercial aircraft - this is a federal violation. Renter is solely responsible for compliance with all TSA and airline regulations
  • Return fuel canisters in safe condition. Punctured, damaged, or leaking canisters will result in replacement charges
WADERS & WATER SAFETY

Renter acknowledges that wading in Alaska rivers, streams, and oceans carries significant risk of falling, cold water immersion, and drowning. Alaska waterways are often fast-moving, extremely cold, and unpredictable. Renter agrees to:

  • Assess water conditions before wading and never wade beyond personal ability
  • Wear a wading belt at all times when using chest waders to reduce water intake in the event of a fall
  • Never wade alone in remote or fast-moving water
  • Accept full responsibility for any injury or death resulting from wading activities

The Company makes no representation regarding water conditions at any fishing location and is not responsible for changes in water level, current speed, or other hazardous conditions.

ICE FISHING SAFETY

Renter acknowledges that ice fishing involves the risk of falling through ice, resulting in cold water immersion, hypothermia, and drowning. Renter agrees to:

  • Verify ice thickness and conditions before venturing onto any frozen body of water (minimum 4 inches for foot travel; more for groups or equipment)
  • Never go onto ice alone
  • Carry ice picks or similar self-rescue tools
  • Accept full responsibility for assessment of ice safety conditions

The Company makes no representation regarding ice conditions at any location and assumes no liability for ice-related incidents.

METAL DETECTING & LAND USE

Renter acknowledges that metal detecting may be restricted or prohibited on certain public lands including state parks, national parks, federal lands, and sites of historical significance. Renter is solely responsible for verifying land use regulations at any intended detection site prior to use. The Company assumes no liability for citations, fines, or confiscation resulting from use of detecting equipment in restricted areas.

MINORS

If Renter is renting equipment for use by a minor (under age 18), Renter represents that they are the parent or legal guardian of the minor and agrees to this waiver on the minor's behalf. Renter accepts full responsibility for supervision of the minor and all risks associated with the minor's use of rented equipment.

INDEMNIFICATION

Renter agrees to indemnify, defend, and hold harmless Turnagain Outfitters LLC from any and all claims, damages, losses, costs, and expenses (including attorney fees) arising out of or related to Renter's use of rented equipment or participation in any related activity.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Alaska. Any dispute arising under this Agreement shall be resolved in the courts of Anchorage, Alaska.

EQUIPMENT RETURN

Renter agrees to return all rented equipment by the date and time specified at booking. We understand that Alaska adventures don't always go exactly to plan - weather moves in, fish start biting, plans change. If you need more time, just reach out before your return time and we'll do our best to work with you on an extension based on availability.

Unreturned equipment after 48 hours past the agreed return time, without prior communication, will be treated as lost and Renter will be charged the full replacement value of the unreturned items.

Renter agrees to return equipment to the agreed pickup/dropoff location. Equipment left at an unspecified location without prior arrangement is the Renter's responsibility until confirmed received by the Company.

DAMAGE POLICY

Gear takes a beating out here, and we get it - that's what it's for. Normal wear and tear is on us. But if something comes back broken, bent, or missing in a way that goes beyond reasonable use, we'll need to address it together.

If equipment is returned damaged, we'll reach out to discuss what happened and what the repair or replacement looks like. Our goal isn't to hit you with a surprise charge - it's just to make sure our gear stays in good shape for the next person who needs it. In most cases, we'd rather talk it through than go straight to billing.

Renter agrees that:

  • Damage beyond normal wear and tear will be assessed at the Company's reasonable discretion
  • Renter will be responsible for documented repair costs, or replacement cost if the item cannot be reasonably repaired
  • The Company will make a good-faith effort to contact Renter before processing any damage-related charges
  • Renter may provide context or documentation (photos, explanation) that will be considered before any final determination

We ask only that you treat the gear like you'd treat your own — and if something happens, just let us know. Honest communication goes a long way.
