This Bike Rental Waiver is entered into agreement between Kingsville Cycle Works and the undersigned ("Renter"). By signing below, Renter acknowledges and agrees to the following terms and conditions:

1. Assumption of Risk

Renter acknowledges that biking is an inherently risky activity, which can result in serious injury or death. Renter voluntarily assumes all risks associated with the use of the rental bike, including but not limited to accidents, collisions, falling, or any other form of injury.

2. Release of Liability

Renter agrees to release, discharge, and hold harmless the Rental Company, its owners, employees, and agents from any and all claims, demands, damages, or actions arising out of or related to the use of the rental bike, including but not limited to bodily injury, property damage, or death, whether caused by the negligence of the Rental Company or otherwise.

3. Rental Period

The rental period for the bike has been determined during payment. Renter agrees to return the bike in the same condition it was rented.

4. Renter’s Responsibilities

  • Renter agrees to operate the bike safely and in compliance with all applicable local laws and regulations.
  • Renter is responsible for inspecting the bike prior to use and acknowledging that it is in good working condition.
  • Renter agrees to wear a helmet and any other necessary safety gear while riding the bike.
  • Renter agrees to report any damage or malfunction to the Rental Company immediately.

5. Damages and Theft

Renter is responsible for any damages to the rental bike, including theft, loss, or vandalism. In the event of damage or theft, Renter agrees to compensate the Rental Company for the cost of repair or replacement.

6. Health and Fitness

Renter confirms that they are physically fit and capable of operating the bike and that they do not have any medical conditions that would impair their ability to safely operate the bike.

7. Indemnification

Renter agrees to indemnify and hold harmless the Rental Company from any and all claims, damages, losses, or expenses, including legal fees, arising from Renter's use of the rental bike, including any third-party claims.

8. Governing Law

This Agreement will be governed by the laws of the state or region where the rental takes place.

9. Acknowledgment of Understanding

By signing this Agreement, Renter acknowledges that they have read and fully understand the terms and conditions stated herein and voluntarily agree to be bound by them.
