HOLD HARMLESS AGREEMENT & DAMAGE WAIVER AGREEMENTfor usage of Electric Bicycles owned by GEAR UP RENTALS, LLC

I/We, the undersigned authorized representative(s), shall be using the electric bicycle (s) owned by GEAR Up Rentals, LLC located in Green Lake Wisconsin, for the purpose of electric bicycle riding, herein referred to as “the activity” & “the equipment”

I/We understand and agree that neither GEAR Up Rentals, LLC nor its trustees, representatives, employees, or agents may be held liable in any way for an occurrence in connection with the activity which may result in injury, harm, or other damages to the undersigned or members of our organization and guests, invited or not.

I/WE accept full responsibility for care of the Equipment while it is in my possession. I agree to reimburse GEAR Up Rentals,, LLC for any loss or damage other than reasonable wear resulting from normal use. I also agree to reimburse GEAR Up Rentals,, LLC for the replacement cost of any Equipment rented by me but not returned. I/WE acknowledge that my credit card will have a $100 hold on account for damages that may occur.

I/We acknowledge that operating an electric bicycle requires good judgment, coordination, and the ability to react safely to traffic, road conditions, pedestrians, and other hazards.

I/We understand that operating an electric bicycle while under the influence of alcohol, illegal drugs, controlled substances, or any medication that may impair judgment, reaction time, balance, or ability to safely operate the bicycle may be illegal and significantly increases the risk of injury, death, or property damage.

I/We agree not to operate the rented electric bicycle while impaired by alcohol, drugs, or any substance that may affect safe operation. I/We accept full responsibility for complying with all applicable federal, state, and local laws regarding the operation of electric bicycles.

I/We assume all risks associated with the consumption of alcohol or use of drugs before or during the rental period and release GEAR Up Rentals, LLC, its owners, employees, agents, and representatives from any liability arising from my/our operation of the electric bicycle while impaired or in violation of any law.

As part of the consideration for being allowed to use electric bicycle (s) in the activity, I/we hereby assume all risk in connection with participation in the activity. I/We further release GEAR Up Rentals, LLC, its trustees, employees, agents, or representatives for any damage which may occur while participating in the activity. I/We further agree to save and hold harmless GEAR Up Rentals, LLC, its trustees, employees, agents, or representatives from any claim by the undersigned member of the organization, their estates, heirs, or assigns arising out of participation in any form or fashion in the activity. I/We also authorize GEAR Up Rentals, LLC, its employees, or agents to render or obtain such emergency medical care or treatment as may be necessary should any injury, harm, or accident occur while participating in the activity.

I/We further state that I/we am/are authorized to sign this agreement; that I/we understand the terms herein are contractual and not mere recital; and that I/we have signed this document of my/our own free act and volition. I/We further state and acknowledge that I/we have fully informed myself/ourselves of the content of this affirmation and release by reading it before I/we signed it.
