RELEASE OF LIABILITY, ASSUMPTION OF RISK & PARTICIPATION AGREEMENT

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE SIGNING. BY SIGNING, YOU ACKNOWLEDGE THAT YOU ARE GIVING UP CERTAIN LEGAL RIGHTS.

This Release of Liability, Assumption of Risk & Participation Agreement (“Agreement”) is entered into between Skater Things LLC, doing business as Skater Things Clubhouse (“Skater Things,” “Clubhouse,” “we,” “us,” or “our”) and the undersigned participant (“Participant”).

This Agreement applies to Participant’s participation in, use of, or presence at Skater Things Clubhouse and its activities.

1. ACTIVITIES COVERED BY THIS AGREEMENT

This Agreement applies to Participant’s participation in or presence at Skater Things Clubhouse, including, but not limited to:

  • Roller skating
  • Roller skate lessons and instruction
  • Beginner, intermediate, and advanced skating instruction
  • Practice and training
  • Recreational skating
  • Use of rental skates and other skating equipment
  • Skate-related exercises and activities
  • Clubhouse events and activities
  • Entering, exiting, and moving throughout the facility
  • Being present as a spectator, parent, guardian, guest, or accompanying person
  • Activities occurring before, during, or after a scheduled lesson, session, or event
  • Any other recreational activity offered, sponsored, or permitted by Skater Things Clubhouse

2. ACKNOWLEDGMENT OF RISKS

Participant understands and acknowledges that roller skating and related activities are physical and recreational activities that involve inherent risks that cannot be completely eliminated.

These risks include, but are not limited to:

  • Falling
  • Loss of balance
  • Loss of control
  • Difficulty stopping or changing direction
  • Slipping or tripping
  • Collisions with other skaters or participants
  • Being struck by another skater or participant
  • Contact with walls, barriers, rails, furniture, equipment, or other objects
  • Changes in or conditions of skating surfaces
  • Uneven, wet, slippery, or otherwise changing surfaces
  • Equipment malfunction, failure, damage, or improper fit
  • Rental skate-related incidents
  • Actions or errors of other participants
  • Contact with persons or objects caused by another participant
  • Injuries resulting from skating beyond Participant’s skill or ability
  • Injuries resulting from attempting maneuvers or activities beyond Participant’s ability
  • Injuries occurring while learning or receiving skating instruction
  • Sprains, strains, bruises, cuts, fractures, concussions, head injuries, and other bodily injuries
  • Serious injury
  • Permanent disability
  • Death

Participant understands that injuries may occur even when reasonable rules, instruction, supervision, safety procedures, and precautions are used.

Participant knowingly and voluntarily accepts the inherent risks associated with roller skating and related activities.

3. PARTICIPANT RESPONSIBILITIES

Participant agrees to:

  1. Follow all Skater Things Clubhouse rules and posted instructions.
  2. Follow reasonable instructions given by Skater Things employees, instructors, or representatives.
  3. Skate within Participant’s own abilities.
  4. Exercise reasonable care toward other participants.
  5. Refrain from reckless, aggressive, dangerous, or disruptive behavior.
  6. Immediately report unsafe conditions, damaged equipment, or injuries to Clubhouse staff.
  7. Stop participating if Participant feels unable or unsafe to continue.
  8. Use rental skates and other equipment only as intended.
  9. Wear socks and any required safety equipment when applicable.
  10. Not participate while impaired by alcohol, drugs, medication, illness, or any other condition that could make participation unsafe.
  11. Inform Clubhouse staff of any condition or limitation that may affect Participant’s ability to safely participate.

Skater Things Clubhouse reserves the right, to the extent permitted by law, to require a Participant to stop participating or leave the facility when the Participant violates Clubhouse rules or engages in unsafe, reckless, threatening, disruptive, or prohibited conduct.

4. ASSUMPTION OF RISK

Participant knowingly and voluntarily assumes the risks associated with the activities described in this Agreement, including the inherent risks of roller skating and the risks specifically identified above.

Participant understands that participation is voluntary and that Participant may choose not to participate.

Participant accepts personal responsibility for injuries or losses arising from the inherent risks of the activities and from Participant’s own acts or omissions.

5. RELEASE AND WAIVER OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, Participant releases and agrees not to sue Skater Things LLC, Skater Things Clubhouse, and their respective owners, members, managers, officers, employees, instructors, agents, representatives, volunteers, and persons acting on their behalf (collectively, the “Released Parties”) for claims for bodily injury, death, or property damage arising out of or related to Participant’s participation in or presence at Skater Things Clubhouse or participation in activities covered by this Agreement, including claims based upon the ordinary negligence of a Released Party, to the maximum extent such a release is permitted by California law.

This release includes claims arising from Participant’s use of the Clubhouse premises, facilities, skating surfaces, equipment, rental skates, instruction, lessons, and skating activities.

Participant understands that by signing this Agreement, Participant is giving up certain legal rights and the right to bring certain claims against the Released Parties, including claims based upon ordinary negligence, to the extent permitted by California law.

Nothing in this Agreement is intended to release or waive liability that cannot legally be released or waived under California law, including liability for gross negligence, fraud, willful misconduct, willful injury, or other liability that applicable law prohibits from being released or waived.

6. COVENANT NOT TO SUE

To the maximum extent permitted by California law, Participant agrees not to bring or maintain a claim against a Released Party for a matter that Participant has expressly agreed to release under this Agreement.

This provision does not prevent Participant from bringing a claim that California law does not permit Participant to waive.

7. PARTICIPANT’S OWN CONDUCT

Participant understands that Participant is responsible for Participant’s own conduct while at Skater Things Clubhouse.

Participant agrees to be responsible, to the maximum extent permitted by law, for claims, damages, losses, or expenses arising from Participant’s own negligent, reckless, intentional, or wrongful conduct or violation of Clubhouse rules.

Nothing in this provision requires Participant to assume responsibility for liability that cannot legally be shifted to Participant.

8. SKATING EQUIPMENT AND RENTAL SKATES

Skater Things Clubhouse may provide or rent roller skates and other equipment.

Participant agrees to inspect rental equipment before use and promptly report any apparent defect, damage, improper fit, or other concern to Clubhouse staff.

Participant agrees not to use equipment that Participant reasonably believes is damaged or unsafe and agrees to immediately notify Clubhouse staff of any such concern.

Participant understands that the use of roller skates and other skating equipment carries inherent risks, including falls, loss of control, collisions, and equipment-related injuries.

9. HEALTH AND FITNESS TO PARTICIPATE

Participant represents that Participant is voluntarily choosing to participate and is responsible for determining whether participation is appropriate based upon Participant’s physical condition and abilities.

Participant should consult a physician or other qualified healthcare professional before participating if Participant has a medical condition, injury, physical limitation, or other concern that could affect safe participation.

Participant agrees to immediately stop participating if Participant experiences pain, dizziness, shortness of breath, loss of balance, or another condition that makes continued participation unsafe.

Participant understands that Skater Things Clubhouse personnel are not qualified to determine whether a Participant is medically fit to skate.

10. EMERGENCY MEDICAL ASSISTANCE

In the event of an emergency, Participant authorizes Skater Things Clubhouse personnel to contact emergency medical services when reasonably believed necessary.

Participant understands that Skater Things Clubhouse is not a medical provider and does not guarantee the availability, adequacy, or outcome of emergency or medical treatment.

Participant understands that Participant may be responsible for medical expenses resulting from an injury or medical emergency, except to the extent otherwise required by law.

11. PERSONAL PROPERTY

Participant understands that Skater Things Clubhouse is not responsible for lost, stolen, or damaged personal property except to the extent responsibility cannot legally be excluded.

Participant is responsible for securing personal belongings while at the Clubhouse.

12. CLUBHOUSE RULES AND CONDUCT

Participant agrees to comply with all current Skater Things Clubhouse rules, whether those rules are:

  • Posted at the facility
  • Provided electronically
  • Included in registration materials
  • Communicated by Clubhouse employees, instructors, or representatives

Rules may include restrictions concerning unsafe or reckless skating, fighting, harassment, smoking or vaping, alcohol or prohibited substances, prohibited food or beverages, damage to Clubhouse property, unsafe behavior, failure to follow staff instructions, and other conduct that creates a safety concern.

Skater Things Clubhouse reserves the right, to the extent permitted by law, to refuse participation or remove a person from the facility for violating Clubhouse rules or engaging in unsafe, threatening, disruptive, or prohibited conduct.

13. PARTICIPANTS UNDER 18 YEARS OF AGE

If Participant is under 18 years of age, the Participant’s parent or legal guardian must review and sign this Agreement on behalf of the minor.

The parent or legal guardian represents that they have the legal authority to provide consent for the minor’s participation.

The parent or legal guardian acknowledges that they have read and understand the risks described in this Agreement and voluntarily consent to the minor’s participation in activities at Skater Things Clubhouse.

The parent or legal guardian agrees, to the maximum extent permitted by California law, to the release and waiver provisions of this Agreement on behalf of themselves and, to the extent legally permitted, on behalf of the minor Participant.

The parent or legal guardian further agrees to be responsible for the minor’s compliance with Clubhouse rules and instructions.

The parent or legal guardian understands that this Agreement does not waive any right or claim that California law does not permit a parent or guardian to waive on behalf of a minor.

14. ACKNOWLEDGMENT OF UNDERSTANDING

By signing this Agreement, Participant acknowledges that:

  • Participant has read this Agreement in its entirety.
  • Participant understands that roller skating and related activities involve risks of injury, including serious injury, disability, and death.
  • Participant understands that participation is voluntary.
  • Participant understands that Participant is giving up certain legal rights.
  • Participant understands the release of ordinary negligence described in this Agreement.
  • Participant knowingly and voluntarily assumes the risks described in this Agreement.
  • Participant agrees to follow Skater Things Clubhouse rules and instructions.
  • Participant has had the opportunity to ask questions regarding this Agreement before signing.
  • Participant understands that this Agreement does not waive rights that cannot legally be waived under California law.

15. GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the State of California, to the extent California law applies.

16. SEVERABILITY

If any provision of this Agreement is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect to the extent permitted by law.
