Please take your time to review this document carefully to ensure you completely understand it

I, hereby acknowledge and agree that SENSEA NORDIC SPA (“the spa” or "Sensea") - 40 sensea road, Chester, B0J 1J0, Nova Scotia, Canada - offers a variety of spa experiences and treatments for use by guests as myself solely at their own risk.

I expressly agree to assume all risk associated therewith and agree to forever waive any and all claims and legal rights which I may have whatsoever, to the extent permitted by law, in connection with my use of the Spa facilities (inclusive of the Spa’s parking lot or any property whatsoever owned by the Spa) or my participation in any Spa treatment.

I understand that before participating in any Spa activities that I should consult my physician if I have a doubt on my ability to use the Spa. Notwithstanding the foregoing, I warrant and represent that I am in good health and that I am able to use the Spa facilities and participate in Spa treatments/programs, without limitation.

I understand that the spa is developed in a natural environment (forest, lake etc.) including some rough terrain and ground, and may have some wet floors indoor or outdoor, requiring more attention from me in order to prevent me from injuring myself. Should I fall or get injured any way in this environment, I will not hold the spa liable for this.

SENSEA NORDIC SPA cannot guarantee that there will be no contraction of diseases (like COVID 19 or any other) arising out of my visit to the spa. I accept this risk and will not hold the spa responsible for this.

I acknowledge that it is my responsibility to choose appropriate footwear to use at the spa and that Sensea makes no representation whatsoever with respect to the suitability of the courtesy footwear that it makes available at the spa.

I hereby authorize Spa personnel to call for medical assistance for me or minors under my responsibility and to transport the same to a medical facility or hospital in the event of an emergency ; and I will be responsible for all associated costs and expenses.​

Furthermore, I understand that the Spa reserves the right to exclude any person from utilizing the Spa facilities for any reason whatsoever. If I consume alcohol while using the Spa facilities, I represent and warrant that I am over the legal drinking age of 19 years old. I acknowledge that alcohol consumption may impair my ability to function properly, which may result in HAZARDOUS actions on my part. I further acknowledge and agree that Sensea reserves the right to refuse admission and/or remove from the premises any guest showing signs of intoxication.

I acknowledge that the spa cannot be held responsible for any lost or stolen personal items. I hereby acknowledge that SENSEA NORDIC SPA has security cameras installed on its premises for the safety and security of clients, staff, and property. I understand that these cameras may record video footage including sound and I consent to being filmed while on the premises of the spa including during my time spent at the reception when I give my consent and approve this waiver.

I HEREBY RELEASE, WAIVE and DISCHARGE SENSEA NORDIC SPA, his/her administrators, employees, officers, agents, successors, heirs and assigns from all liability, actions, demands, and proceedings arising from my visit to the spa. I agree to release the spa, and the manufacturer or installer of any product or equipment installed, used, or operated at the spa property, from any liability for any loss, damage, injury, or expense incurred as a result of or arising from any negligence, breach of contract, breach of statute/regulation/duty including any duty pursuant to the Occupiers’ Liability Act.

I ACKNOWLEDGE I have read this Waiver and Release and fully understand its terms and I have digitally signed it below freely and without any inducement or assurance of any nature; and I intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law relating to this and all my future visits to SENSEA NORDIC SPA. If any portion of this Waiver and Release is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.

If I am executing this Release of Liability and Waiver of Rights on behalf of a minor , I warrant and represent that I am the minor's parent or legal guardian.​

This Agreement shall be binding on my (or the mentioned minor's) estate, heirs, administrators and assigns. This Waiver and Release shall be governed by and construed under the laws of the Province of Nova Scotia (Canada).

RULES & SENSEA ETIQUETTE

I, here agree to abide by all rules and regulations as may be established from time to time by the SENSEA NORDIC SPA (the "Spa"), which includes the following:

• Smoking, using cannabis in any forms, or bringing alcohol or food from outside the spa, are not allowed on site.
• Smartphones are tolerated on site, but please be mindful of other guests and kindly never take any photo with other guests presents on the background.
• We have a whispering only policy on site, except in saunas, hammams and around treatment pods where silence is expected.
• Please no public displays of affection or intimacy. Please be respectful of guests and staff around you.
• Please provide at least 2 days notice should you need to change or cancel your booking, otherwise a cancellation fee will apply ($80 for any massage or treatment, $40 for a Spa Pass). And once your check-in is done, no cancellation is possible and no refund can be applied. No cancellation nor refund is allowed for pre-paid morning and evening spa passes.
• When you come for a treatment, please be sure to check in at least 30 min before your treatment time, otherwise we will consider this as a no show and the treatment will be offered to someone else and penalty fees will apply.
• You must choose the footwear appropriate (don't consider the one offered at the spa as a solution for you if you are not sure) and take all necessary measure (walking slowly, staying away from any slippery or uneven surfaces, holding hand rails when available, etc...) to prevent you from any slip and fall.
• Make sure to sit on your towel inside the saunas, it's more hygienic. Don't stay more than 15 min (use the timers on the wall). Don't stay more than 15 min in the hot pools and a few seconds in the cold pools.
• At any time if you feel unwell, stop the experience and exit the location where you are and ask immediately for help.
• Stay always hydrated (drink water regularly) and be sure to eat sufficiently to not be in a situation of deficiency which could lead you to feel dizzy.
• No Glass on site due to the risk in case it gets broken.
• You must have your swim suit at all time on (we are not allowing to be naked in our installations, nor to be dressed in your regular clothes once you exit the changing rooms to start your experience).
• The booking must be done under your name, if we have a different name between the payee and the person who book, we will have to cancel your appointment or refuse your check-in. This is a breach of our policy.
• Please be aware that we have a strict alcohol policy and our team is trained to limit your alcohol consumption in order to keep you and other people safe at all times especially with our saunas and your drive back home. A maximum of 3 alcoholic beverages are allowed during your stay (1 hour between the 2 first drinks must be respected and 2 hours between the 2d and the 3rd). Alcohol consumption is not allowed everywhere on site, please ask one of our attendant when you have a doubt. And our approach helps as well to keep a quiet and relaxation environment. We count on your understanding regarding our policy. Bringing or drinking alcohol not supplied by us on site (parking lot included) is strictly forbidden. At any time during your stay, one of our associate can check your drink container and dump it or decide to ask you to leave the spa. Police can be called in some cases if needed.
• The spa might change its operation hours for various reasons (weather, etc...) even after your booking and check-in. We consider that as long as you received your treatment or had at least 2 hours of presence in the spa that you received your full experience and that no refund or gift card will be provided in compensation.
• We do not allow guests to leave any pets unattended in their vehicle while they are using the spa. Please leave all animals at home for their safety. Guests who leave animals in their car may be asked to leave.
• Once you exit (check out) the spa, you are ending your experience and cannot come back even if you need to go to your car.
• All guests must be 16 year old and plus to access the spa. A piece of ID with age might be required during the check-in.
• And the most important, enjoy every minute of your experience, you deserve it!

Any breach of our rules and policy or if we assess that your behavior (or the behavior of the group you belong to) is not compatible with what we want at the spa, we can ask you to leave at any time (if you don't comply, we could call the police). Then we can decide any time without any notice to ban you or the whole group you came with, from coming the spa again and cancel any future bookings related to you or any other member of your group. Please understand that it is crucial for us to be sure that all our guests have a safe and relaxing experience when they come the spa.
