SAUNA USE WAIVER OF LIABILITY

You must read and sign this liability waiver prior to the rental or use of our Saunas. Please read carefully, because it affects your right to sue Nomad Saunas in the event of injury or damage even if Nomad Saunas is negligent.  

This waiver is in effect for all customers and includes any guests of our customers. It is important that you advise your guests of this waiver because it affects their right to sue Nomad Saunas in the even of an injury or damage, even if Nomad Saunas is negligent. 

This waiver begins with the rental/use of the sauna and remains in effect after the rental or sauna session.

NOTICE

All of our customers should check with a physician prior to using our Saunas, particularly those with any chronic health concerns, including a history of dizziness, fainting or other neurological problems, a history of heart or lung/respiratory problems, and those with metal hardware including rods, pins, plates, artificial joints, surgical implants (including silicone). 

We believe that saunas are a fun, healthy and enjoyable way to relax. However, we are not physicians, and do not claim any particular health benefit from saunas. If you have questions about the benefits vs. the potential hazards of the saunas, consult your physician.

Our saunas are for adult use only. All guests must be over the age of 18 to use the sauna, even accompanied by a parent. 



CAUTION

The saunas are hot. Typical temperatures range up to 195 degrees. Prolonged exposure to high temperatures may have detrimental effects on the body and cause conditions including fever, headache, dehydration, drowsiness, hyperthermia, heat stroke and even death. 

The surfaces of the sauna are hot to the touch. Use caution when touching bare skin to any surface.

If water is used to create steam, floors or other surfaces may become wet and slippery. Use caution with water and watch for water on the floor.

You should not remain in the sauna for more than two hours. If you experience symptoms noted above, pain, significant discomfort or other symptoms that can be caused by excessive heat, you should leave the sauna immediately.  

Consult your physician for additional precautions pertaining to the use of saunas.



RULES FOR USE OF NOMAD SAUNAS

  1. No admittance to any person under the age of 18 years.
  2. Clothing (e.g. a swimsuit) and towels are required. 
  3. No smoking (including e-cigarettes), or vaping of any substance in the sauna.
  4. No use of any alcohol, non-prescribed drugs, including marijuana prior to or during the sauna session.
  5. We do not prohibit, but strongly discourage the use of cell phones or electronic devices while in the sauna. The heat may damage the devices and they may become very hot to the touch.
  6. While Nomad Saunas are well constructed and well insulated, exercise caution when touching the exterior of the sauna. Examine the area around the sauna and be sure there is nothing in the vicinity that will be damaged by heat from the sauna.



WAIVER OF LIABILITY

In consideration for the rental fee and other good and valuable considerations, I hereby assume all risks associated with my use of the sauna, including of significant injury or death even if caused by the negligence of Nomad Saunas. I hold Nomad Saunas, its owners, employees, agents and insurers harmless from any claim, liability, loss, damage, injury including death, expense and other loss brought by me or anyone on my behalf. I further agree to hold Nomad Saunas harmless and defend it, its owners, employees, agents and insurers harmless from any claim, liability, loss, damage, injury including death, expense and other loss brought by anyone I allow to use the sauna. 

VENUE, JURISDICTION AND APPLICABLE LAW Any action or lawsuit asserting any claim arising from the event shall be venued in the Fourth District Court of the State of Minnesota. The laws of the State of Minnesota shall apply to any dispute relating to or arising from this agreement.

MERGER/MODIFICATION/SEVERABILITY This Agreement contains the entire agreement of the parties, and supersedes all oral statements, promises or representations. If any provision of this Agreement is held to be unlawful, void or for any reason unenforceable, then it shall be severed from this Agreement, the other parts of which will remain in force and effect.
