RELEASE OF LIABILITY, WAIVER OF CLAIMS,
ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT
(hereinafter referred to as the “Release Agreement”)
BY SIGNING THIS DOCUMENT, YOU ARE AGREEING TO RELINQUISH CERTAIN
LEGAL RIGHTS, INCLUDING THE ABILITY TO FILE A LAWSUIT OR SEEK
COMPENSATION IN THE EVENT OF AN ACCIDENT. PLEASE READ CAREFULLY!

To: INTO THE WILD TOURS INC, along with its affiliated companies, directors, subsidiaries, shareholders, officers, employees, agents, instructors, guides, representatives, subcontractors, independent contractors, hosts, suppliers, successors, and assigns, as well as His Majesty the King in Right of Canada (collectively referred to as the “Releasee”).

DEFINITION:

In this Agreement, the term 'Activity' encompasses all tours and recreational pursuits, which may include but are not limited to walking, sightseeing, hiking, scrambling, climbing, snowshoeing, ice skating, ice-walking, sledding, canoeing, utilization of bus or van transportation, participation in vehicle tours, engagement in other leisure activities, use of parking lots, stairs, walkways, general physical activities, instructional sessions, social gatherings, and meetings associated with such pursuits, whether formally or informally organized by any of the Releasees.

ACKNOWLEDGMENT:

I confirm that I have received the necessary equipment and adequate instructions to engage safely in the Activities. I understand that the physical demands of the Activities and the associated forces on the body could potentially trigger or exacerbate pre-existing physical injuries, conditions, symptoms, or congenital defects. I have been advised to consult with a medical professional if I am aware or suspect that my physical condition may not be suitable for the Activities. I understand and agree that I will not engage in the Activities while under the influence of illicit drugs or alcohol.

RENTAL AGREEMENT:


I acknowledge full responsibility for the maintenance of the rental equipment ('Equipment') and agree to cover the costs for any damages incurred to the Equipment. Furthermore, I agree to replace the Equipment at its full retail value should it not be returned in satisfactory working condition by the agreed-upon date.

ACCEPTANCE OF HAZARDS

I am aware that the rental of equipment (“Equipment”) and activities, and the transportation to and from the Activities involve risks, hazards and dangers including, but not limited to: accidents involving motor vehicles; biking, paddling, and hiking activities; immersion in water of varying depths; hypothermia resulting from exposure to extremely cold water or weather conditions; the risk of drowning; and encountering diverse water conditions, surfaces, and currents, including waves and tides. I acknowledge the potential hazards, which may encompass but are not limited to: adverse weather conditions such as lightning; entrapment by natural obstacles such as trees, logs, or rocks, storms, high winds, and as well as equipment; collisions with trees, rocks, debris logs, boating equipment, individuals, other vessels, or motor vehicles; the negligence of other individuals; encounters with both domestic and wild animals and equipment malfunction.

I understand that there may be instances of negligence by the Releasees, distributors, and their staff, equipment manufacturers, including their failure to adequately protect me from the risks associated with my use of the equipment and participation in the activities. I am fully aware of the dangers, risks and hazards inherent in the activities, as well as in the transportation to and from such activities and the rental of all equipment. I willingly acknowledge and assume all such dangers, risks, and hazards, including the potential for personal injury, death, property damage, or loss arising from them.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY

AGREEMENT

As a condition for being granted permission by the Releasees to engage in the Activities and to utilize their equipment, vehicles, or any other facilities, and in exchange for other valuable considerations, the receipt and adequacy of which I acknowledge, I hereby consent to the following terms:

1. I agree to relinquish all present and future claims against the Releasee and absolve them from any responsibility for any harm, loss, expenses, or injuries, including death, that may occur while participating in the Activities, regardless of the cause, including negligence, contract breaches, or violations of statutory duties or other obligations of care. This includes instances where the Releasee fails to ensure my safety from the risks and hazards mentioned earlier.



2. I agree to protect and compensate the Releasees against any claims or liabilities arising from damage to third-party property or personal injury caused by my use of the Equipment or participation in the Activities.

3.This Release Agreement remains valid and enforceable even in the event of my death or incapacity, and it extends to my heirs, next of kin, executors, administrators, assigns, and representatives.

4.This Release Agreement, along with any rights, duties, and responsibilities between the parties, will be governed exclusively by the laws of the Province of Alberta, with no consideration given to any other jurisdiction.

5. All legal proceedings concerning the parties to this Release Agreement must be initiated within the province of Alberta and fall under the exclusive jurisdiction of the Courts of Alberta.

6. I acknowledge that in agreeing to this Release Agreement, I am not basing my decision on any verbal or written assurances or statements made by the Releasee regarding the safety of the Premises or the Activities, except for what is explicitly outlined in this Release Agreement.

HEALTH AND FITNESS DECLARATION

I confirm that I possess the requisite physical fitness to partake in the Activity. I affirm that my health condition is suitable for participation in the Activity. Furthermore, I have not received any medical advice or instruction from a healthcare professional indicating that I should refrain from engaging in the strenuous physical exercise associated with the Activity.

SUPPLEMENTARY DECLARATIONS

I affirm, certify, warrant, and declare, recognizing that the Releasees are relying on my assertions, that the individual identified in this waiver is identical to the person who filled out and signed the waiver. I agree to furnish supplementary details to the Releasees to substantiate these declarations upon their request.

DIGITAL SIGNATURE

I consent to the electronic signing of this Waiver, acknowledging that it holds equal legal validity and enforceability as if signed manually or documented through a paper-based record-keeping system, in accordance with the fullest extent permitted by applicable law. I hereby waive any objections to the contrary."


I AFFIRM THAT I HAVE THOROUGHLY READ AND COMPREHENDED THIS RELEASE AGREEMENT BEFORE SIGNING IT, AND I CONFIRM THAT I AM AT LEAST 18 YEARS OLD. IF I AM UNDER 18 YEARS OF AGE, I WILL ENSURE THAT A PARENT OR GUARDIAN SIGNS THIS WAIVER AND RELEASE OF CLAIMS ON MY BEHALF. I UNDERSTAND THAT BY SIGNING THIS RELEASE AGREEMENT, I AM RELINQUISHING CERTAIN LEGAL RIGHTS THAT I, OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS, AND REPRESENTATIVES, MAY HAVE AGAINST THE RELEASEE.
