LIABILITY RELEASE AND ASSUMPTION OF RISK AGREEMENT

1. Acknowledgment of Risk

I, the undersigned participant, hereby acknowledge that I have voluntarily agreed to participate in an air tour flight conducted by Davis Aero LLC, DBA North Tahoe Aviation (“the Company”). I understand that this flight involves flying in a small aircraft over mountainous terrain, which may include risks such as:

- Sudden changes in weather, turbulence, or wind conditions;

- Hard or off-airport landings;

- Mechanical failure;

- Collisions with terrain, obstacles, or other aircraft; and

- Other hazards inherent to general aviation flight.

I fully understand and accept that these risks could result in property damage, injury, or death.

2. Voluntary Participation

I acknowledge that my participation in this sightseeing flight is entirely voluntary. I have not been pressured or coerced to participate, and I am physically and mentally fit to do so.

3. Assumption of Risk

I voluntarily assume all known and unknown risks associated with participation in this flight, including those caused by the negligence of the Company, its owners, officers, agents, pilots, employees, or representatives.

4. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, and discharge Davis Aero LLC, DBA North Tahoe Aviation, its owners, officers, employees, pilots, agents, contractors, insurers, successors, and assigns (collectively, “Released Parties”) from any and all claims, demands, causes of action, damages, or liabilities arising out of or connected with my participation in this flight, whether caused by negligence or otherwise.

This release includes, but is not limited to, claims for:

- Personal injury or death;

- Property loss or damage;

- Emotional distress; and

- Any consequential or incidental damages.

5. Indemnification

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur as a result of my participation or any claims brought by others arising from my conduct during or in connection with the flight.

6. Acknowledgment of FAA Regulations

I understand that this flight is operated under 14 CFR Part 91 and is not subject to the same requirements as scheduled airline or charter operations under Part 135. I acknowledge that the Company’s pilots are FAA-certified and that the aircraft is maintained in accordance with FAA regulations.

7. Photography and Media Release

I grant permission for the Company to use any photographs or video taken during my flight for promotional, educational, or advertising purposes without compensation.

8. Severability

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. Governing Law

This agreement shall be governed by and construed under the laws of the State of California. Any disputes shall be resolved in the appropriate court within Nevada County, California.

10. Acknowledgment of Understanding

I have read this agreement carefully, fully understand its contents, and sign it voluntarily. I understand that by signing this document, I am giving up substantial legal rights, including the right to sue.
