RHODY SURF, INC. 

WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK

This is a standard waiver required for all lessons, camps, rentals, and beach equipment use. It outlines the risks of ocean and beach activities so everyone can have a safe and enjoyable experience.

Please read carefully - this agreement affects your legal rights.

1. ASSUMPTION OF RISK 

Participation in surfing, stand-up paddleboarding, bodyboarding, swimming, beach activities, lessons, camps, classes, rentals, and the use of related equipment (including surfboards, paddleboards, beach chairs, umbrellas, and other beach equipment) (the “Activities”) involves inherent and unavoidable risks.

These risks may include, but are not limited to:

  • Drowning or near-drowning  
  • Waves, rip currents, tides, and shore break  
  • Collisions with boards, equipment, or other people  
  • Contact with the ocean floor, sandbars, rocks, or submerged objects  
  • Marine life such as jellyfish  
  • Changing weather and water conditions  
  • Movement or displacement of beach equipment due to wind or environmental conditions  
  • Equipment issues or misuse  
  • Physical exertion, fatigue, or panic  
  • Instruction, supervision, or judgment decisions  

I understand these risks and choose to participate voluntarily.

2. RELEASE OF LIABILITY  

To the fullest extent permitted by law, I agree to release and not hold liable Rhody Surf, Inc., its owners, employees, instructors, contractors, and affiliates (the “Released Parties”) for any injury, loss, or damage arising from participation in the Activities.

This includes claims resulting from the negligence (active or passive) of the Released Parties.

3. INDEMNIFICATION  

I agree to indemnify and hold harmless the Released Parties from any claims, damages, or expenses (including legal fees) arising from my (or my child’s) participation in the Activities.

4. MINOR PARTICIPANTS  

If signing on behalf of a minor, I certify that I am the parent or legal guardian and have authority to sign this Agreement. I consent to the minor’s participation and agree to all terms on their behalf, including indemnifying the Released Parties from any claims brought by or on behalf of the minor.

5. MEDICAL AUTHORIZATION  

I authorize Rhody Surf staff to provide or obtain emergency medical care if needed. I understand that I am responsible for any associated costs.

6. FITNESS TO PARTICIPATE  

I confirm that I (or my child) am physically able to participate and comfortable in the water where applicable. I understand that Rhody Surf, Inc. does not assess individual fitness or swimming ability.

7. EQUIPMENT RESPONSIBILITY  

Equipment may be provided as part of participation in the Activities.

I agree to use all equipment safely and as instructed, and to return it in good condition. I accept responsibility for any loss or damage beyond normal wear and tear.

8. WEATHER & SCHEDULING  

Ocean and weather conditions can change quickly. Rhody Surf, Inc. may adjust, reschedule, or cancel activities as needed for safety. Specific conditions are not guaranteed.

9. PHOTO AND MEDIA USE  

Photos or videos may occasionally be taken during Activities.

I agree that Rhody Surf, Inc. may use images or video that include me (or my child) for marketing and promotional purposes. No names or personal information will be used without permission.

10. GOVERNING LAW  

This Agreement is governed by the laws of the State of Rhode Island.

11. SEVERABILITY  

If any part of this Agreement is found unenforceable, the remaining provisions will continue in full effect.

I understand that ocean and beach activities involve inherent risks, including serious injury or death.
I voluntarily accept all risks of participation.
I agree to release Rhody Surf, Inc. from liability, including for its own negligence.
I confirm that I (or my child) can swim and am physically able to participate where applicable.
I have read this agreement and agree to all terms.
Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.
