Tracewski Fishing Adventures

My insurance company requires every adult on the trip to sign this participation agreement. This means if two adults are going on the trip, EACH must open and sign a separate agreement. 

All minors (less than 18 years old) must be listed on the Trip Leader’s participation agreement, but don’t need to sign. So for a family of four with 2 adults and 2 children, 2 signed agreements are required – one from the Trip Leader including the 2 minors and one from the second adult.

Risk Acknowledgement

I/we the undersigned, plan to participate in a guided fishing trip with Tracewski Fishing Adventures and registered Maine guide Kevin Tracewski and/or his associates. I /we understand that I/we alone are soley responsible for determining if I/we (and/our minor children) are physically able and skilled enough to participate in this activity.

I/we acknowledge that I/we have been advised to wear eye protection, in the form of prescription glass, sunglasses or safety glasses, whenever casting or fishing activity is underway. And that I/we were advised to obtain a Maine fishing license before embarking on this fishing trip.

I/we understand that such a trip involves risks, dangers and hazards that include, but are not limited to: walking on unmarked trails that may contain hazards; wading or fording rivers and other waterways; overturning or upsetting of boats; collision and/or entrapment in water by trees, logs, rocks or equipment; encounters with animals; inclement weather (including heavy rain, high winds and lightning); equipment failure.

I/we are aware that there is a risk of negligence on the part of Tracewski Fishing Adventures, Kevin Tracewski and/or his associates. I/we freely accept and assume all the risks and dangers associated with this type of activity, along with the possibility of personal injury, property damage or death resulting from it.

Liability Waiver

By signing below, I/we agree to and/or acknowledge the following:

1. To waive any and all claims that I/we have or may in the future have against Kevin Tracewski and/or Tracewski Fishing Adventures, or any of their employees, agents, or representatives. 

2. To release, hold harmless and indemnify Kevin Tracewski and/or Tracewski Fishing Adventures, or any of their employees, agents or representatives from any and all liability for any loss, damage, expense, or injury (including death) that I/we, or any third party, may suffer as a result of participation in one of their planned activities.

3. That this agreement shall be affective and binding upon my heirs, next of kin, executors and representatives, in the event of my death.

4. That I/we have adequate insurance to cover the cost of any injury or damage I/we may cause or suffer while participating in a Tracewski Fishing Adventures activity, or else I/we agree to bear the full costs of such injury or damage myself. I/we further certify that I/we (and/or our minor children) have no medical or physical conditions which could interfere with our safety in an activity, or else I/we are willing to assume, and bear the costs of, all risks that may be created either directly or indirectly by any such condition.

5. Should Kevin Tracewski and/or Tracewski Fishing Adventures, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I/we agree to indemnify and hold them harmless for all such fees and costs.

6. If any portion of this agreement is found to be void and unenforceable, the remaining portion shall remain in full force and effect.

7. That this agreement shall be governed and interpreted in accordance within the laws of the state of Maine; and that any litigation involving the parties to this agreement be brought within the state of Maine.

8. That in regard to safety and liability issues, I am not relying on any oral or written statements made by Kevin Tracewski and/or Tracewski Fishing Adventures, other than what is set forth in this agreement.
