WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENT

FIREARMS INTERNATIONAL – COMBINED LIABILITY WAIVER & RELEASE

(General Range Use • Instructor/Class Training • Shotgun Usage)


SECTION 1 — GENERAL RANGE LIABILITY WAIVER

(Applies to ALL individuals entering or using the FI Range)

I, the below‑named Participant, hereby acknowledge that I have voluntarily applied to enter and to engage in and/or observe the use, handling, and operation of firearms and ammunition and other related activities (collectively, the “Activities”) at the indoor shooting range(s) (the “Range”) owned and operated by Firearms International, LLC, a Hawaii limited liability company (the “Company”). In consideration for receiving permission to participate in the Activities, I, on behalf of myself, my heirs, estate, executors, guardians, legal representatives, successors, and assigns, hereby acknowledge and agree:

  1. The Activities are inherently dangerous and may involve known and unanticipated risks which could result in property damage, physical injury (including paralysis or death), and/or emotional injury to myself or others, and that no amount of care, instruction, or expertise can eliminate such dangers or risks.
  2. The Range is an indoor shooting facility that utilizes fixtures and equipment to decelerate projectiles. Such fixtures and equipment do not, in every instance, prevent ricochets or projectile fragments that may cause serious bodily injury or death.
  3. The Company makes no representations or warranties regarding any services provided or the design, manufacture, condition, or fitness of any facilities or equipment, including firearms, ammunition, or safety equipment rented, sold, or provided to me.
  4. I am fully aware of the risks and hazards associated with my presence at the Range and/or participation in the Activities. I voluntarily elect to enter the Range and assume all risks, including loss, property damage, personal injury, emotional injury, serious bodily injury, and death.
  5. I hereby waive, release, and forever discharge the Company, its members, managers, officers, instructors, employees, any landlord/lessor, and their agents, successors, and assigns (“Released Parties”), from any and all claims, demands, damages, liabilities, torts, causes of action, or expenses (including attorneys’ fees), whether caused by negligence or otherwise, arising from my presence at the Range and/or participation in the Activities.
  6. I will indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, damages, liabilities, torts, causes of action, or expenses (including attorneys’ fees) asserted in connection with my presence at the Range and/or participation in the Activities.
  7. I have read, understood, and will abide by the Range Rules established by the Company.
  8. I certify that I am legally permitted to possess and use firearms and am not prohibited under federal or state law.
  9. This document shall be interpreted and enforced under the laws of the State of Hawaii. If any portion is deemed invalid, the remainder shall remain in full force and effect.


RANGE RULES

(Participant acknowledges receipt and understanding)

  1. Always point your firearm in a safe direction.
  2. Keep your finger off the trigger until ready to shoot.
  3. Keep your firearm unloaded until ready to shoot.
  4. Know how to operate your firearm safely.
  5. Use only correct ammunition. Outside ammunition is prohibited.
  6. No alcohol or drugs before or during shooting.
  7. Identify your target and what lies beyond.
  8. Wear eye and ear protection at all times.
  9. Shoot only at authorized targets.
  10. Never go forward of the firing line.
  11. Confirm firearms are unloaded when clearing.
  12. Follow all instructor or range employee commands.
  13. No smoking, eating, or drinking inside the range.
  14. Use common sense and avoid unsafe actions.
  15. Everyone shares responsibility for safety.


SECTION 2 — INSTRUCTOR / CLASS‑SPECIFIC WAIVER

(Applies ONLY to Basic Firearms Safety Course, CCW or Instructor‑Led Training)

I acknowledge that participation in any firearm class conducted by Firearms International, FI Academy, FI Training Club, or FI Group, Inc involves inherent risks associated with handling firearms and participating in shooting activities. In consideration of being permitted to participate in the firearm class, I agree to the following:

Assumption of Risk

I acknowledge risks including but not limited to:

• Accidental discharge

• Improper handling

• Failure to follow instructions

• Equipment malfunction

• Acts of other participants

Release of Liability

I release, waive, discharge, and covenant not to sue the instructors, assistants, and affiliates (“Released Parties”) from any and all liability arising from injury, death, or property damage, including negligence.

Indemnification

I agree to indemnify and hold harmless the Released Parties from any claims arising from my participation, including third‑party claims.

Responsibility

I am responsible for my own safety and will follow all instructions and protocols.

Acknowledgment

I have read and understand this section and voluntarily participate with full knowledge of the risks.


SECTION 3 — SHOTGUN USAGE WAIVER, RELEASE & INDEMNIFICATION

This Shotgun Usage Waiver (“Agreement”) is required for any individual (“Shooter”) who wishes to use a shotgun on the Firearms International (“FI”) range.

1. Eligibility & Age Requirements

• Shotgun usage permitted only for individuals 18+

• Minors are not permitted

• Valid government ID required

2. Ammunition Restrictions

Only full lead slugs or frangible slugs with 1‑piece wads are permitted.

All other ammunition types are prohibited unless:

• Inspected by an FI RSO, and

• RSO grants written approval for a specific purpose

RSO approval is discretionary.

3. Usage Limits & Fees

• VIP Members: No fee

• Range Members: $19.99 surcharge

• No walk‑ins

• Limit: 20 shells per session

• FI may deny shotgun use at any time

4. Shooter Conduct Requirements

Shooter agrees to:

• Follow all RSO instructions immediately

• Use only FI‑approved ammunition

• Report unsafe conditions or malfunctions

• Not use the range while impaired

• Certify they are medically fit for shotgun use

Noncompliance may result in removal without refund.

5. Hazard Disclosure & Assumption of Risk

Risks include but are not limited to:

• Ricochet, spalling, debris

• Lead exposure

• Hearing damage

• Burns, cuts, recoil injuries

• Mechanical failure

• Property damage

• Injury or death

Shooter voluntarily assumes all risks.

6. Release of Liability

Shooter releases FI and all Released Parties from all claims arising from shotgun use, including negligence.

7. Indemnification

Shooter agrees to defend and indemnify FI for any claims arising from:

• Shotgun use

• Rule violations

• Damage to FI property

• Injury to others

• Use of unapproved ammunition

8. FI Authority

FI may suspend or revoke shotgun privileges at any time without refund.

9. Jurisdiction & Severability

• Governed by Hawaii law

• Venue: Honolulu County

• Invalid provisions do not affect remainder

10. Certification of Understanding

Shooter certifies they have read, understand, and voluntarily agree to all terms.
