WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENT

I, the below-named Participant, hereby acknowledge that I have voluntarily applied to enter on to and to engage in and/or observe the use, handling and operation of firearms and ammunition and other related activities (collectively, the “Activities”) at the indoor shooting range(s) (the “Range”) owned and operated by Firearms International, LLC, a Hawaii limited liability company (the “Company”). In consideration for receiving permission to participate in the Activities, I, on behalf of myself, my heirs, estate, executors, guardians, legal representatives, successors and assigns, hereby acknowledge and agree:

1. The Activities are inherently dangerous and may involve both known and unanticipated risks which could result in damage or destruction of property, physical injury, including paralysis or death, and/or emotional injury to myself or others, and that no amount of care, instruction or expertise can eliminate such dangers or risks.

2. The Range is an indoor shooting facility that utilizes fixtures and equipment to decelerate projectiles such as bullets. Such fixtures and equipment do not, in every possible instance, prevent the ricochet of projectiles or fragments thereof that may cause serious bodily injury or death to myself or others.

3. The Company makes no representations or warranties as to any services provided by the Company or the design, manufacture, condition or fitness for any particular purpose of any of the Company’s facilities or equipment, including, without limitation, any firearms, ammunition or safety equipment rented, sold or otherwise provided to me.

4. I am fully aware of the risks and hazards that could arise in connection with my presence at the Range and/or my participation in the Activities. I voluntarily elect to enter the Range and participate in the Activities and hereby accept and assume all risks in connection therewith, including, without limitation, all risk of loss, property damage and personal or emotional injury, including serious bodily injury and death to myself or others.

5. I, on behalf of myself and my heirs, estate, executors, guardians, legal representatives, successors and assigns, hereby waive, release and forever discharge the Company, its members, managers, officers, instructors and employees, any landlord/lessor of the Company (as applicable), and each of their agents, successors and assigns (collectively, the “Released Parties”), from any and all claims, demands, damages, liabilities, torts, causes of action, expenses (including attorneys’ fees) or claims of relief of any kind, whether caused by negligence or otherwise, that may exist or that may hereafter be asserted against the Released Parties in connection with my presence at the Range and/or my participation in the Activities.

6. I will indemnify, defend and hold harmless the Released Parties from any and all claims, demands, damages, liabilities, torts, causes of action, expenses (including attorneys’ fees) or claims of relief of any kind that may be asserted against any Released Party in connection with my presence at the Range and/or my participation in the Activities.

7. I have read, understood and will abide by the Range rules established by the Company, a copy of which is attached hereto.

8. I am at least eighteen (18) years of age, or am less than eighteen (18) years of age and am and will at all times be accompanied by and under the close supervision of the undersigned parent or guardian; I am not a convicted felon or a fugitive from justice, have never been adjudicated mentally defective or ever been committed to a mental institution, discharged from the Armed Forced under dishonorable conditions, subject to a court order restraining me from harassing, stalking or threatening my child or an intimate partner or child of such partner, convicted of a misdemeanor crime of domestic violence, or have any other legal proceedings prohibiting me from using or possessing firearms.

9. This document shall be interpreted and enforced under the laws of the State of Hawaii. If any portion of this document shall be deemed by a court of competent jurisdiction to be invalid, that portion shall be severed and the remainder of the document shall remain in full force and effect.

RANGE RULES

1. Always point your firearm in a safe direction (even when unloaded).

2. Always keep your finger off the trigger until you're ready to shoot at the target.

3. Always keep your firearm unloaded until you’re ready to shoot at the target.

4. Know how to use your firearm and be sure that it is safe to operate.

5. Use only the correct ammunition for your firearm. Outside ammunition is prohibited.

6. Never use alcohol or drugs before or while shooting.

7. Before shooting, identify your target and what lies beyond it.

8. Wear eye and ear protection while inside the range.

9. Shoot only at authorized targets.

10. Never go forward of the firing line.

11. When clearing firearms, visually and physically confirm that they are unloaded.

12. Follow all commands of the firearms instructor or range employee.

13. Smoking, eating or drinking while inside the range is prohibited.

14. Use common sense and avoid any actions that could jeopardize safety.

15. Remember, everyone shares the responsibility for range safety.

I HAVE CAREFULLY READ THIS DOCUMENT, FULLY UNDERSTAND ITS CONTENTS AND AM AWARE THAT THIS DOCUMENT IS A WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENT.

Instructor waiver Addition-Applicable only for Basic Firearms Safety Course

I, the below-named Participant, hereby acknowledge that my participation in the firearm class conducted by [Firearms International, LLC, FI Academy, FI Training Club and FI Group, Inc] involves inherent risks and hazards associated with handling firearms and participating in shooting activities. In consideration of being permitted to participate in the firearm class, I agree to the following terms and conditions:

Assumption of Risk:

I acknowledge that participation in the firearm class involves inherent risks, including but not limited to the risk of personal injury, property damage, or death, which may result from, but are not limited to, the following:

a. Accidental discharge of firearms

b. Improper handling or use of firearms

c. Failure to follow safety instructions and protocols

d. Equipment malfunction or failure

e. Acts of other participants or third parties

Release of Liability:

I hereby release, waive, discharge, and covenant not to sue Firearms International, FI Academy, FI Training Club and FI Group, Inc instructors, instructor assistants, and affiliates (collectively referred to as "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury, or death, including but not limited to those caused by the negligence or fault of the Released Parties.

Indemnification:

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all liabilities, damages, losses, costs, expenses, attorney's fees, and claims arising out of or related to my participation in the firearm class, including but not limited to any claims brought by third parties arising out of my actions or omissions.

Assumption of Responsibility:

I acknowledge that I am responsible for my own safety and well-being during the firearm class. I agree to abide by all safety instructions, rules, and protocols provided by the instructors and staff.

Acknowledgment of Understanding:

I have read this Liability and Indemnity Waiver Form carefully and fully understand its terms and implications. I acknowledge that I am voluntarily participating in the firearm class with knowledge of the risks involved.
