WAIVER, RELEASE AND HOLD HARMLESS AGREEMENT

In consideration for receiving permission to participate in activities at Easton Fish & Game Association, 2595 Redington Rd East, Hellertown, Pennsylvania (EFGA), I hereby FULLY RELEASE, FOREVER DISCHARGE, AND AGREE TO HOLD HARMLESS, for any and all purposes, Easton Fish & Game Association Inc.(EFGA), The National Rifle Association (NRA) and their respective officers, agents, volunteers and employees (collectively, the “Released Parties”), of and from any and all liability to me, my personal representatives, assigns, heirs and next of kin, for any damage to or loss of my property, any injury to my person, including bodily injury or death, arising directly or indirectly out of my participation in the activities, including any damage, loss or injury that is caused by any act or omission on the part of the released parties. I further agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties for, from, and against any and all liabilities, damages, claims, lawsuits, costs (including court costs, attorneys’ fees and costs of investigation), and actions of any kind or description for any damage to or loss of property or injury to persons, including bodily injury or death, arising out of the activities at EFGA or my participation in the activities.



By execution below I HEREBY ACKNOWLEDGE THAT THERE ARE INHERENT RISKS INVOLVED AND I RECOGNIZE AND ASSUME ALL OF THE RISKS ASSOCIATED WITH PARTICIPATION IN THE ACTIVITIES AT EFGA. I understand that no insurance coverage may exist through EFGA or NRA to cover any injuries, damages or claims which may arise as a result of my participation in the activities at EFGA.



I represent that I will take all safety precautions necessary. I state that I am in good health, physically fit to engage in the activities, and have no known medical condition which could foreseeably jeopardize my safety during such participation or be aggravated by such participation. I understand and agree that I may be held liable for any damage or loss to EFGA that is caused by my gross negligence, willful misconduct, or fraud while participating. I am at least eighteen (18) years of age and fully competent; or I am under the supervision of my parent or legal guardian.


FINALLY, I ACKNOWLEDGE THAT I HAVE CAREFULLY READ, AND CLEARLY UNDERSTAND, AND VOLUNTARILY SIGN THIS WAIVER, RELEASE and HOLD HARMLESS AGREEMENT.



GENERAL CONSENT, RELEASE AND COVENANT

NOT TO SUE FOR MEDIA

On behalf of myself, my heirs, administrators, executors, or assignees, hereby agree that Easton Fish & Game Association Inc., shall have the right to record my participation, appearance, image, likeness and voice on video tape, audio tape, film, photograph or in any other medium and to publish the same in any form of publication, including but not limited to print, electronic, video or Internet. I hereby unconditionally and irrevocably consent to Easton Fish & Game Association Inc.’s use of such materials for education and the promotion of the Club in the promotion of sportsmanship, conservation and the shooting sports. It is further understood that such materials will never be used for commercial endeavors. I understand that by so agreeing and consenting, I have forever waived (i) any right to require payment from Easton Fish & Game Association Inc. for use of such materials by it or those acting pursuant to its authority and (ii) the right to object to the use of such materials for any purpose permitted by this general consent and release, including, the Club publishing, printing, displaying, exhibiting, distributing, or otherwise publicly using any such materials for legal purposes. I understand the foregoing consent and release grants Easton Fish & Game Association Inc. the right to edit, crop, retouch or otherwise reasonable alter such materials, at its discretion. Furthermore, I understand and agree that any intellectual property rights associated with such materials are the sole property of the Club.


I hereby release and hold harmless Easton Fish & Game Association Inc. and their employees, agents and personnel for, from and against any and all claims for damages that I may have (including, but not limited to, claims of compensation, royalties, invasion of privacy, misappropriation or defamation) arising out of the use of my participation, appearance, image, likeness and voice pursuant hereto and furthermore covenant not to bring suit against Easton Fish & Game Association Inc.
