Warriors Academy of Gymnastics Waiver

Assumption of Risk/Release of Liability

I acknowledge and agree that participating in gymnastic activities and/or in other physical activities held at a gym involves the possibility of physical injury. I understand and accept that my child is participating in a group activity and that exclusive one-on-one “spotting” is not possible; and that supervision is in a group setting and therefore will not be solely on my child at all times. In consideration for the right to participate in Warriors Academy of Gymnastics (Warriors) events and in activities held at Warriors gym, I voluntarily agree, on my own behalf and on behalf of my child(ren), to assume all risks and responsibility for any injury or accident I, we or they may sustain on Warriors premises and/or through participation in Warriors activities. I, on my own behalf and on behalf of my child(ren), my and their heirs, executors, administrators, assigns, and/or personal representatives, knowingly and voluntarily release and agree to indemnify Warriors, its owners, agents, volunteers, assistants, employees, and/or successors from any and all liability claims, demands, or causes of action whatsoever for any damage, loss, injury, or death to me, my child(ren), or property which may arise out of or in connection with (i) use of Warriors gym, (ii) participation in Warriors events, (iii) or both. I further hereby voluntarily agree to waive my rights and that of my heirs and assigns, as well as the rights of my child(ren), to pursue any claim or complaint (in law or in equity) against Warriors, its owners, agents, volunteers, assistants, employees, and/or successors, for any damage, loss, injury, or death. I further agree not to sue Warriors, its owners, agents, volunteers, assistants, employees, and/or successors, for any of the claims and liabilities released and waived herein.

I acknowledge, understand, appreciate and agree that my participation may result in possible exposure to and illness from infectious diseases, including but not limited to, MRSA, Influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my/my child’s participation and exposure.

Guest Conduct

All persons on Warriors premises and/or participating in Warriors events are required to behave responsibly at all times and follow all Gym Rules. Warriors, in its sole discretion, may require any person (child or adult) to leave its premises at any time. No refunds will be issued if any person is asked to leave.

Pick up Policy

Parents/Guardians will come into the Warriors gym or come to the Warriors door to pick up their child(ren) from an event dismissal.

WAG May Use Pictures and Videos of Us

I permit Warriors to obtain and use photographs and videos of myself and of my child(ren) (“Images”) for educational, promotional, marketing, and social media purposes (“Permitted Purposes”). I agree that Images may be posted online and/or published, with or without my name/my child(ren)’s name, and used for Permitted Purposes by Warriors without compensation owed to me/my child(ren) and without further notice to me. I understand that this authorization is completely voluntary. I may instruct Warriors in writing to stop using Images at any time by email to Info@Warriorsacademygym.com, and that is my sole recourse regarding Warriors use of my and my child(ren)’s Images. I will not, on my own behalf or on behalf of my child(ren), pursue any claim, demand, estoppel, or damage of any kind against Warriors for their use of Images consistent with this Agreement, and I shall indemnify Warriors if any such claim, demand, estoppel, or damage is filed against them on behalf of myself of my child(ren), including reasonable defense costs and attorneys fees.
