Agreement, Waiver, Release & Discharge of Liability

I hereby WAIVE, RELEASE, AND DISCHARGE ANY AND ALL CLAIMS, DEMANDS, AND CAUSES OF ACTION FOR PERSONAL INJURY, ILLNESS, SICKNESS, PAIN, SUFFERING, DEATH AND OTHER FORMS OF ECONOMIC AND NONECONOMIC DAMAGES AND LOSSES that I have experienced and/or might experience in the future (whether known, unknown, anticipated, unanticipated) as a result of my riding in, riding on, operating, utilizing and/or in any manner arising out of my use of or participation in or performing any activities that involve property (“The Property”) that is owned by, licensed by, rented by, leased by, and/or otherwise made available to me by Premier Island Management Group LLC, Adventures Abound at Portofino Island, LLC and Adventures on Portofino One, LLC, including but not limited to the parasail, boats/vessels, PWCs, inflatable water park equipment, kayaks, paddle boards, boogie boards, surf boards, beach games, scoot coupes, trike scooters, low speed vehicles (golf carts & mokes), sailing equipment, beach chairs and umbrellas, swimming equipment, bicycles (baby carriage & pull behind cart), electric bicycles, and kids club activities and programs.

THIS WAIVER, RELEASE AND DISCHARGE APPLIES EVEN THOUGH MY CLAIMS, DEMANDS, AND CAUSES OF ACTION ARISE OUT OF NEGLIGENCE, GROSS NEGLIGENCE, RECKLESSNESS, WANTONNESS, AND/OR OTHER FORMS OF ACTION OR INACTION on the part of the owners, lessors, operators, users, captains, mates and/or marketers of “The Property” and/or on the part of the employers, employees, volunteers, agents, officers, directors, principals, members, shareholders, parent companies, subsidiaries and divisions.

I acknowledge and understand that there are significant elements of risk in the activities I wish to participate in and that serious injuries, illness and/or death occasionally occur to passengers, operators, spectators and users of “The Property”. Nevertheless, I AGREE TO ASSUME ALL RISKS (WHETHER KNOWN, UNKNOWN, ANTICIPATED OR UNANTICIPATED) AND TO RELEASE Premier Island Management Group LLC, Adventures Abound at Portofino Island, LLC and Adventures on Portofino One, LLC and the owners, lessors, operators, captains, mates and marketers of “The Property” and any of the employers, employees, volunteers, agents, principals, officers, directors, members, shareholders, parent companies, subsidiaries, divisions, successors and assigns of these owners, lessors, operators, users, captains, mates and/or marketers; who, through negligence, gross negligence, reckless conduct, wanton conduct and/or other actions or inactions might otherwise be liable to me.

I verify that I am physically fit, not under the influence of alcohol or drugs, and sufficiently qualified, trained and capable to participate in the activities. While participating in and/or engaging in water activities, I agree to wear a U.S. Coast Guard approved personal flotation device (life jacket). While riding bicycles, if you are of the age of 15 years or younger, I agree to wear protective headwear (helmet). Renters of all ages riding scooters or trikes, I agree to wear protective headwear (helmet) at all times. While riding the golf carts or scoot coupes, I agree to wear a seat belt at all times.

It is understood and agreed that this waiver, release, and discharge is binding on me, my heirs, executors, administrators, legal representatives, assigns and next of kin.

This Agreement, Waiver, Release and Discharge is to be governed by Florida state law. It is understood and agreed that this Agreement, Waiver, Release and Discharge is INTENDED TO BE AS BROAD AND INCLUSIVE AS IS PERMITTED PURSUANT TO FLORIDA STATE LAW, and that if any portion of this Waiver, Release and Discharge is ruled invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not affect the validity, legality and enforceability of any other provision hereof. 

I understand that by signing this document I am expressing my intention to waive valuable legal rights that I now possess or might possess DURING MY ENTIRE STAY AT PORTOFINO ISLAND RESORT. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT I AM EXPRESSING MY INTENTION TO WAIVE VALUABLE LEGAL RIGHTS THAT I NOW POSSESS OR MIGHT POSSESS IN THE FUTURE. I HAVE READ AND VOLUNTARILY SIGN THIS AGREEMENT, RELEASE, WAIVER and DISCHARGE OF LIABILITY, and further agree that no oral representations, statements or inducements apart from this written agreement have been made.

I understand that there are no refunds due to inclement weather.

 GENERAL RENTAL TERMS & FEES

  • Return Policy: Equipment must be returned to the rental area on or before the specified time in the same condition it was rented.
  • Late Fees: * PWC: If not returned by the specified time, you will be charged an additional hourly rate of $165.
  • All Other Equipment: An additional hourly fee will be charged for each hour late.
  • Missing/Damaged Items: If equipment is not returned prior to checkout, I will be charged the MSRP of the missing item(s). Any damage caused to the rental item(s) while in use by the signing rental, or member(s) of their party, shall be paid for by the signing renter. This includes, but is not limited to, water damage to electrical components.
  • Refunds: There are no refunds due to inclement weather or product availability.
  • Absolutely no use of alcohol or drugs before or during the rental period.

ACTIVITY-SPECIFIC RULES & SAFETY

Personal Watercraft (PWC / Sea-Doo)

  • Age/License: Must be born before Jan 1, 1988, OR have a valid NASBLA approved Boater’s License and government ID. Must be 18 years or older to operate the PWC. The rent must also be able to provide needed identification and boater's license.
  • Fees: Minimum $100 flip fee; minimum $250 charge for hull/fiberglass damage or damage to other vessels. Should the damages exceed $250; the signing renter will be charged fully for all needed repairs.
  • Operation: Only the signing renter may drive; instructions must be followed.
  • Safety: A U.S. Coast Guard approved life jacket must be worn at all times.
  • The renter assumes and accepts all risks associated with operating the PWC while a passenger is onboard.
  • Only the renter is allowed to operate the PWC.
  • The renter acknowledges that they have received instructions on how to operate the PWC and they will follow all laws associated with operating.

Electric Bicycles (E-Bikes)

  • Age: Must be 18+ with a valid Driver's License.
  • Pensacola Beach Core Area: In the designated "core area," the battery motor MUST BE SWITCHED OFF and operated by human power only.
  • Safety/Fees: Helmets must be worn at all times. There is a $50 fee for a popped tire.

Hobie Cat Sailboats

  • Requirements: Must be 18+ with ID and have documented experience sailing a two-hull catamaran.
  • Fees: Minimum $50 flip fee; minimum $50 charge for damage to lines, sails, or rails. Should damage exceed $50; the signing renter will be charged fully for all the needed repairs.

Bicycles & Land Rentals

  • Helmets: Required for ages 15 and younger on bicycles.
  • Seat Belts: Must be worn at all times in golf carts.

Water Rentals

  • Life Jackets: Any person under 18 years old must wear a life jacket, everyone else must have a correct sized life jacket on the rental

ADVENTURE PACKAGES

  • Coverage: Packages cover up to 4 individuals (max 3 additional people may be added).
  • Wristbands: All members of the party must be present at the time of purchase for a Premier employee to attach wristbands.
  • Availability: Equipment is first-come, first-serve, except for cruises and tennis pro sessions, which require reservations.
  • Rentals: All rentals are in one hour increments with the exception of PWC rentals which are 30 minute increments. Each package comes with one beach chair set (2 chairs/ 1 umbrella) even if additional people are added. All requirements for rentals are still required.
  • Weather: No Refunds due to weather

I HAVE READ AND VOLUNTARILY SIGN THIS AGREEMENT. I UNDERSTAND I AM WAIVING VALUABLE LEGAL RIGHTS.

Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.
