MEMBERSHIP AGREEMENT Welcome to Tardigrade Obstacle Course and Fitness Facility! You’re not just joining a gym - you’re becoming part of a vibrant, supportive tribe. Here, we come together to work out, push each other, conquer fears, tackle races and competitions, share our passion for fitness, and most importantly, have fun! We’re thrilled to have you with us on this journey. This membership agreement outlines the terms and conditions for joining our community, including access to our gym, field area, obstacle course, and various fitness programs. Please read carefully before signing. 1. Financial Terms - Membership Fees:
- Primary Membership: $35/month, includes access to all group classes, open gym, and field play.
- Family Membership Add-ons: $12/month per additional family member from the same household.
- Child Membership Requirement: All children using the facility must have a membership.
- Example: Sitting quietly doing homework does not require a membership; using equipment, such as the trampoline, soccer goals, basketball hoop, pickle ball, etc, does.
- Trial Membership: We’re excited to offer new members a one-time trial period to experience everything Tardigrade has to offer!
- Cost: $55 for a primary member; $20 per additional family member.
- Duration: One month.
- Terms: Trial memberships are available only once per person or family per year. At the end of the one-month trial, you may join as a full member or opt-out with no further obligation. Please note that the trial membership fee will be charged in full at the time of enrollment, regardless of whether you continue your membership after the trial period.
- Add-On Fees for Programs:
- Beyond Badass (BYB) Strength Training: $50/month.
- Beyond Badass (BYB) Nutrition Accountability: $15/month.
- Payment Terms:
- Automatic Billing: Membership fees are billed automatically on the first day of each month. A valid credit card must be kept on file. The first month's membership will be prorated based on the start date.
- Late Payments: Late payments may result in suspension of membership privileges until the account is brought current.
- Early Termination Policy:
- Commitment: A 12-month membership is required.
- Early Termination Fee: $75 or 50% of the remaining balance on the membership term, whichever is greater. The remaining balance is calculated by multiplying the number of remaining months by the monthly membership rate. If termination occurs mid-month, no prorated refund will be provided for that month. This fee is required to offset costs and ensure the continuity of our services for other members.
- Exceptions: Medical conditions preventing participation may qualify for exceptions, with appropriate documentation.
- Notice: A 30-day written notice is required for early termination. Membership dues will continue during this period.
2. Program-Specific Terms - Beyond Badass (BYB) Strength Training:
- Add-on Fee: $50/month.
- Automatic Billing: Membership fees are billed automatically on the first day of each month along with the primary membership. A valid credit card must be kept on file. The first month's membership will be prorated based on the start date.
- Program Format:
- Workouts are programmed through the Trainerize app.
- Sessions typically include Lower Body, Upper Body, and Core strength routines.
- The Trainerize app will allow you to keep track of weights, reps, and your progress.
- This program is specifically focused on strength training. For optimal results, we highly recommend supplementing it with additional functional fitness or cardio classes, like Boot Camp, or incorporating cardio sessions independently outside of the program. Don’t forget…all of the group classes, including Boot Camps, are already included with your primary membership!
- Initial Session for NEW BYB Members: A mandatory one-on-one personal training session will be conducted with one of our trainers to familiarize new BYB members with the exercises, proper techniques, and program structure.
- Self-Guided Program: After the initial session, BYB is a self-guided program. Participants may join scheduled BYB groups with other BYB members, or complete workouts independently during open gym.
- Commitment: A 30-day notice is required for cancellation. Membership dues will continue during this notice period.
- NoRefunds: No refunds will be issued for the BYB Strength program.
- Beyond Badass (BYB) Nutrition Accountability:
- Add-on Fee: $15/month.
- Automatic Billing: Membership fees are billed automatically on the first day of each month along with the primary membership. A valid credit card must be kept on file. The first month's membership will be prorated based on the start date.
- Program Format:
- Calculating daily calorie and macro targets based on individual goals.
- Weekly review of food diaries and personalized recommendations (this will most likely occur every Sunday).
- Setting goals and receiving feedback through the Trainerize app.
- Food logging by the member in MyFitnessPal, which connects to the Trainerize app.
- Participation in a Nutrition Group in the Trainerize app to foster community and shared accountability.
- Important Note: This program provides accountability support only. Advice is not provided by a certified nutritionist.
- Commitment: A 30-day notice is required for cancellation. Membership dues will continue during this notice period.
- No Refunds: No refunds will be issued for the BYB Nutrition program.
3. Group Class Reservations and Check-Ins - Class Reservations: Members MUST reserve their spot for all group classes through the Zen Planner app or website.
- Check-In Requirement: Members are REQUIRED to check in for each class, open gym session, or field play.
4. Vending and Sprout Transactions - Recording Purchases: All vending and sprout purchases must be accurately recorded on the transaction sheet located on the clipboard next to the Sprout fridge.
- Billing/Payments: These purchases will be automatically charged to the credit card on file on the first of each month, along with your membership fees.
- Penalty Fee for Unrecorded Purchases: Inventory is taken daily. A $10 administrative fee will be charged in addition to the cost of any unrecorded goods purchased. This fee covers the administrative costs of reviewing video footage to identify the individual who consumed the product.
5. Facility Rules - General Rules:
- Keep the facility clean. If you make a mess, clean it up.
- Dispose of trash properly and clean up spills immediately.
- Report any broken equipment or issues to Jess or Matt promptly.
- Ensure that all equipment (weights, mats, exercise balls, etc.) is returned to its proper place after use to maintain organization and safety.
- Smoking is strictly prohibited on the property.
- Drive slowly and safely up the driveway, park in the designated parking area, and avoid driving on the yard or field.
- Supervise children at all times. Ensure they respect the equipment and facility rules.
- Use of the Obstacle Course:
- Members may only use the obstacle course during specific classes with an instructor, during scheduled group events or birthday parties, or during times that they have scheduled specifically with Jess or Matt.
- Any use of the obstacle course outside of these times requires prior approval and may be subject to a safety briefing to ensure proper usage and safety protocols are followed.
- Safety and Security:
- Practice safe habits while using the gym and obstacle course.
- Be aware that security cameras are in use both inside and outside the facility for safety, security, and monitoring purposes.
6. Afterschool Youth Fitness and Games Class - Transportation: If your child is riding the bus from Chapel Elementary School to Tardigrade, please notify both the school and us in advance to ensure proper arrangements.
- Class Reservations: You must reserve your child’s spot online or through the Zen Planner app to ensure we know they are attending.
- Pick-Up: Please pick up your child promptly at 5:00 pm. If you will be late, kindly text Jess at 410-829-6608 so she can arrange for someone to stay with your child until you arrive. A late pick-up fee may be applied if we need to pay staff to stay with your child beyond the scheduled time.
7. Member Responsibilities - Community Responsibility: This is your gym, your community, and our house. Please take care of it as if it were your own. Clean up after yourself, whether in the gym, porta-potty, driveway, or field area.
- Communication: If something is broken or if an issue arises, notify us immediately. If you need cleaning supplies or assistance, don’t hesitate to ask.
8. Notice of Consumer Rights - Our Business Registration Number: Our business’ registration number with the State’s Consumer Protection Division is 6043.
- No Performance Bond Requirement: We are not required to carry a performance bond under the Maryland Health Club Services law because we do not accept more than three months' payment in advance or charge initiation fees over $200.
- Facility Closure: If Tardigrade Obstacle Course and Fitness Facility is closed for a month or more, you are entitled to your choice of either an extension of the contract/agreement or a prorated refund. If the closure is due to circumstances beyond our control (e.g., natural disasters, government-mandated shutdowns), we reserve the right to choose the appropriate option for you.
- Right to Cancel: Members may cancel this contract without penalty or obligation within three (3) business days from the date of signing. Cancellation requests must be submitted in writing, and delivered in person or by certified or registered mail. If you cancel, you are entitled to a full refund of all monies paid.
- Medical Cancellation: Members who are unable to use the facility due to a medical condition may cancel their membership with a physician’s note.
9. 12-Month Commitment Renewal Policy Upon the completion of your initial 12-month membership term, your membership will automatically renew for another 12-month period under the following terms: - Renewal of Commitment: After your initial 12-month membership term, your membership will automatically renew for an additional 12-month period at the current membership rate, unless you provide written notice of cancellation as described below.
- New 12-Month Term: Each renewal period will be a new 12-month commitment, and you will be responsible for the full 12-month membership fees for the renewal period. You will not be required to sign a new contract, but your membership will be subject to the same terms and conditions as the original agreement.
- Notice of Non-Renewal: If you do not wish to continue your membership for the next 12-month period, you must notify Tardigrade Obstacle Course and Fitness Facility in writing at least thirty [30] days prior to the expiration of your current term. Cancellations can be submitted via email or by written letter sent by certified mail. Failure to provide timely notice will result in automatic renewal and billing for the next 12-month term.
- Billing for Renewed Term: Your membership will be billed at the current rate for the new 12-month term. Tardigrade Obstacle Course and Fitness Facility reserves the right to adjust the membership fee with advance notice.
- Effect of Cancellation: If you provide written notice of cancellation in accordance with the terms outlined above, your membership will end at the conclusion of the current 12-month term, and no further charges will be applied after that date.
- Early Termination: If you choose to cancel before the end of the 12-month term, early termination fees may apply, as outlined in the Termination Policy section of this agreement.
By continuing your membership beyond the initial 12-month term, you acknowledge and agree to the renewal of the 12-month commitment for each subsequent term. 10. Waiver and Release By signing this Membership Agreement, you acknowledge and agree that, in addition to the terms outlined herein, you will be required to complete and sign a separate waiver and release of liability prior to using the facility, including the obstacle course and any fitness programs. This waiver will be provided to you upon registration and must be signed for each member, including minors. Failure to sign the waiver will prevent you from participating in any activities at the facility. 11. Guest Policy Members are welcome to bring guests to the facility; however, the following terms apply: - Drop-In Fee: A $20 drop-in fee will be charged for each guest, payable at the time of their visit.
- Waiver Requirement: All guests must complete and sign a waiver before using any equipment or participating in any activities. This waiver is separate from the membership agreement and must be signed each time a guest visits.
- Supervision: Members are responsible for their guests' conduct and adherence to the facility’s rules during their visit.
