If you are a parent/guardian of the participant, please use your initials and signature. ______________________________________________________________________________________ Into The Blue Scuba Travel Policy Please read this policy carefully, agree to each section, and sign. Traveler: Thank you for showing interest in one of our vacation/ dive adventure packages. This is probably the most serious document you will ever receive from Into The Blue Scuba. Why? Because, we’re entering into an agreement with you. We are agreeing to plan and provide you with a vacation/ dive adventure package, and you are agreeing to pay us for it. So, we want to communicate clearly to you the obligations involved when traveling with us and to offer you some advice on how to prepare for a very fun and safe vacation/ dive adventure. I Agree
Vacation/ Dive Packages: All our vacation/ dive adventure packages are carefully curated to provide you with the greatest travel experience possible! We put a lot of time, effort, and money into planning and booking our vacation/ dive adventures. For this reason, all vacation/ dive adventure packages are sold as a whole package. There’s not any a la cart pricing. If you want to join us, then you must buy the whole vacation/ dive adventure package. There will No Exceptions on this! I Agree Preparation: This is the important process of preparing to have as much fun as you possibly can on your vacation/ dive adventure. The more prepared you are the less likely you are to encounter any problems and the more fun you will have. Passport: You must have a passport (Unless you’ve signed up for a domestic trip). You must have it on your person on your days of travel or you will not be traveling! Your passport must also be valid for at least 6 months after the trip return date as many international destinations will reject entry. Please check this now. Your diving equipment and your personal dive skills need to be appropriate for the diving planned on the adventure you have chosen. If your equipment needs servicing, please give yourself plenty of time to have this done in case any issues arise. Also, check to make sure that all your electronics are working and that the batteries hold a charge. If you feel like your scuba skills need to be refreshed, please let us know ASAP so, we can get you scheduled for a refresher course. Please remember that a lot of our international destinations do not have the normal American comforts that we are used to like convenient well-stocked pharmacies and stores. So, please carry important items like medications, etc. on your person as baggage can get lost. Lastly, only you know what you really like or need to truly enjoy your vacation. So please pack accordingly. I Agree Personal Diving Abilities: Into The Blue Scuba always allows those who are running the dive operations we use to retain ultimate control. Logically, they know their diving environment better than occasional visitors (like us) do. It is important that you understand that even though you are carrying evidence of certification, if the dive operators believe your diving skills may compromise your safety, they may not allow you to dive and Into The Blue Scuba will stand by their decision. Please make sure your dive skills are adequate for your adventure. Please ask us if you have any questions about this. I Agree Air Travel: Into The Blue Scuba does not make your air travel arrangements. Therefore, it is important that you understand your responsible for booking the correct air travel. Make sure you are aware of the policies of the airline you are using. Most tickets issued are non-refundable and non-transferable This means that should you need to cancel your trip; you will not be able to get a refund on the airline ticket. We can take no responsibility for airline policies, and therefore, we always recommend trip cancellation/ interruption insurance. I Agree Hotel/Diving: Into The Blue Scuba acts as intermediary agent for the Resort/ Hotel and/or Dive Operator’s we use. Our adventures are negotiated with the Resort/ Hotel and/or Dive Operator’s based on the number of guests traveling, occupancy patterns, etc. This means that a single group member needing to cancel at the last moment can affect the entire group contract. The Resort/ Hotel and/or Dive Operator’s also have policies beyond our control. These generally involve a complete forfeiture of all monies paid for a canceled trip. So again, we recommend trip cancellation/ interruption insurance. I Agree Weather: As much as we wish we could, Into The Blue Scuba nor anyone else for that matter can control the weather. So, for this reason if the Resort/ Hotel, and/or Dive Operator or Into The Blue Scuba’s on site representative decides that the weather conditions are too bad to dive then you will not be diving that day. As stated before, since payment has been made to the Resort/ Hotel, and/or Dive Operator in advance there will not be any refunds for days that you cannot dive. For this reason, we again recommend trip cancellation/ interruption insurance. I Agree Payment Schedule: Your trip payments may involve a deposit, a series of payments, or a onetime full payment. All payments are required by the payment due date. Payment information will be detailed on the vacation/ dive adventure information sheet. I Agree Vacation / Dive Adventure Details: As stated earlier, all our vacation/ dive adventure packages are carefully curated to provide you with the greatest travel experience possible! We try to make them as all-inclusive as possible. This way all you have to do is show up, have fun, and relax! However, not everything that everyone wants can be included. There will an information sheet available detailing pricing and everything included/ not included for the vacation/ dive adventure that you will be attending. I Agree Releases/ Waivers of Liability: Into The Blue Scuba, PADI, and the Resort/ Hotel and/or Dive Operator’s will require you to complete these documents before you can participate in any activities. Please be advised that a parent or legal guardian will have to complete these for any minors that will be participating in any activities. I Agree Trip Application: We hate paperwork, too, but it must be done. So, you might as well get it out of the way. You need to fill your trip application out completely and return it to us as quickly as possible. Take your time and read this document thoroughly. Please ask us if you have any questions and yes, we need an emergency contact, health insurance information, your doctor’s name and phone number. In the highly unlikely event of an accident we need these documents to assure you the best care and to make certain that the people you care about and who care about you are immediately informed. I Agree Trip / Dive Insurance – We believe in this insurance. We recommend that you have a current policy while you are traveling. This insurance covers some items not generally covered by normal health insurance. Further, the international assistance alone is invaluable, and the trip cancellation aspect can save you a lot of money due to cancelation, or in the event of an unanticipated interruption. The two major companies that offer this coverage is Divers Alert Network or DiveAssure. Please ask if you have any questions. I Agree Into The Blue Scuba’s Cancellation Policy: Our policy is based on a few factors. As stated before, our adventures are negotiated with the Resort/ Hotel and/or Dive Operator’s based on the number of guests traveling, occupancy patterns, divers etc. and when a space on an adventure is sold it is removed from inventory and no further attempts are made to sell that space. So, if a single group member canceled at the last moment this would affect the entire group. The Resort/ Hotel and/or Dive Operator’s cancelation policies generally involve a complete forfeiture of all monies paid for a canceled trip. Because of these factors our policy is ALL TRIP PAYMENTS ARE NON-REFUNDABLE. If you cancel at any point, your money is forfeited, period. NO exceptions. For this reason, WE STRONGLY ADVISE all our travelers to obtain trip insurance that includes cancellation coverage. Please ask if you have any questions. ___________________________________________________________ Photography Release I give Into The Blue Scuba, LLC, 11874 HWY 36, Covington, GA 30014 and Into The Blue Scuba Dive Club (photographers) the irrevocable right to use my picture and/ or photograph in all forms and media, without restriction as to changes or alterations, for advertising, trade, promotion, exhibition, or any other lawful purposes. I waive any right to inspect or approve the pictures and/ or photographs that may be used in conjunction with them now or in the future, whether that use is known to me or unknown, and I waive any right to royalties or other compensation arising from or related to the use of the pictures and/ or photographs. I am 18 years of age or the parent/guardian of the participant and am competent to sign this release. I have read this release and waiver and am fully familiar with its contents. ___________________________________________________________ Equipment Rental Agreement THIS AGREEMENT is entered into between Into The Blue Scuba, LLC and myself, for the rental of scuba, cylinder, skin diving equipment, and/or any other equipment provided by Into The Blue Scuba, LLC. This AGREEMENT is a release of my rights and the rights of my heirs, assigns or beneficiaries to sue for injuries or death resulting from the rental and/or use of this equipment. I personally assume all risks of skin and/or scuba diving, whether foreseen or unforeseen, related in any way to the rental and/or use of this equipment. ___________________________________________________________ PADI Non-Agency Disclosure and Acknowledgement Agreement I understand and agree that PADI Members (“Members”), including ____Into The Blue Scuba, LLC____ and/or any individual PADI Instructors and Divemasters associated with the program in which I am participating, are licensed to use various PADI Trademarks and to conduct PADI training, but are not agents, employees or franchisees of PADI Americas, Inc, or its parent, subsidiary and affiliated corporations (“PADI”). I further understand that Member business activities are independent, and are neither owned nor operated by PADI, and that while PADI establishes the standards for PADI diver training programs, it is not responsible for, nor does it have the right to control, the operation of the Members’ business activities and the day-to day conduct of PADI programs and supervision of divers by the Members or their associated staff. I further understand and agree on behalf of myself, my heirs and my estate that in the event of an injury or death during this activity, neither I nor my estate shall seek to hold PADI liable for the actions, inactions or negligence of ___Into The Blue Scuba, LLC___ and/or the instructors and divemasters associated with the activity.
___________________________________________________________ PADI Liability Release and Assumption of Risk Agreement Please read carefully before signing. I hereby affirm that I am aware that skin and scuba diving have inherent risks which may result in serious injury or death. I understand that diving with compressed air involves certain inherent risks; including but not limited to decompression sickness, embolism or other hyperbaric/air expansion injury that require treatment in a recompression chamber. I further understand that the open water diving trips which are necessary for training and for certification may be conducted at a site that is remote, either by time or distance or both, from such a recompression chamber. I still choose to proceed with such instructional dives in spite of the possible absence of a recompression chamber in proximity to the dive site. I understand and agree that neither my instructor(s), , the facility through which I receive my instruction, ___Into The Blue Scuba, LLC___, nor PADI Americas, Inc., nor its affiliate and subsidiary corporations, nor any of their respective employees, officers, agents, contractors or assigns (hereinafter referred to as “Released Parties”) may be held liable or responsible in any way for any injury, death or other damages to me, my family, estate, heirs or assigns that may occur as a result of my participation in this diving program or as a result of the negligence of any party, including the Released Parties, whether passive or active. In consideration of being allowed to participate in this course (and optional Adventure Dive), hereinafter referred to as “program,” I hereby personally assume all risks of this program, whether foreseen or unforeseen, that may befall me while I am a participant in this program including, but not limited to, the academics, confined water and/or open water activities. I further release, exempt and hold harmless said program and Released Parties from any claim or lawsuit by me, my family, estate, heirs or assigns, arising out of my enrollment and participation in this program including both claims arising during the program or after I receive my certification. I also understand that skin diving and scuba diving are physically strenuous activities and that I will be exerting myself during this program, and that if I am injured as a result of heart attack, panic, hyperventilation, drowning or any other cause, that I expressly assume the risk of said injuries and that I will not hold the Released Parties responsible for the same. I further state that I am of lawful age and legally competent to sign this liability release, or that I have acquired the written consent of my parent or guardian. I understand the terms herein are contractual and not a mere recital, and that I have signed this Agreement of my own free act and with the knowledge that I hereby agree to waive my legal rights. I further agree that if any provision of this Agreement is found to be unenforceable or invalid, that provision shall be severed from this Agreement. The remainder of this Agreement will then be construed as though the unenforceable provision had never been contained herein. I understand and agree that I am not only giving up my right to sue the Released Parties but also any rights my heirs, assigns, or beneficiaries may have to sue the Released Parties resulting from my death. I further represent I have the authority to do so and that my heirs, assigns, or beneficiaries will be estopped from claiming otherwise because of my representations to the Released Parties. I, BY THIS INSTRUMENT, AGREE TO EXEMPT AND RELEASE MY INSTRUCTORS, Into The Blue Scuba, LLC, THE FACILITY THROUGH WHICH I RECEIVE MY INSTRUCTION, AND PADI AMERICAS, INC., AND ALL RELATED ENTITIES AS DEFINED ABOVE, FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH HOWEVER CAUSED, INCLUDING, BUT NOT LIMITED TO, THE NEGLI GENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. I HAVE FULLY INFORMED MYSELF AND MY HEIRS OF THE CONTENTS OF THIS NON-AGENCY DISCLOSURE AND ACKNOWLDGE MENT AGREEMENT AND LIABILITY RELEASE AND ASSUMPTION OF RISK AGREEMENT BY READING BOTH BEFORE SIGNING BELOW ON BEHALF OF MYSELF AND MY HEIRS.
___________________________________________________________ PADI Standard Safe Diving Practices Statement of Understanding This is a statement in which you are informed of the established safe diving practices for skin and scuba diving. These practices have been compiled for your review and acknowledgement and are intended to increase your comfort and safety in diving. Your signature on this statement is required as proof that you are aware of these safe diving practices. Read and discuss the statement prior to signing it. If you are a minor, this form must also be signed by a parent or guardian. I understand that as a diver I should: 1. Maintain good mental and physical fitness for diving. Avoid being under the influence of alcohol or dangerous drugs when diving. Keep proficient in diving skills, striving to increase them through continuing education and reviewing them in controlled conditions after a period of diving inactivity, and refer to my course materials to stay current and refresh myself on important information. I Agree 2. Be familiar with my dive sites. If not, obtain a formal diving orientation from a knowledgeable, local source. If diving conditions are worse than those in which I am experienced, postpone diving or select an alternate site with better conditions. Engage only in diving activities consistent with my training and experience. Do not engage in cave or technical diving unless specifically trained to do so. I Agree 3. Use complete, well-maintained, reliable equipment with which I am familiar; and inspect it for correct fit and function prior to each dive. Have a buoyancy control device, low-pressure buoyancy control inflation system, submersible pressure gauge and alternate air source and dive planning/monitoring device (dive computer, RDP/dive tables—whichever you are trained to use) when scuba diving. Deny use of my equipment to uncertified divers. I Agree 4. Listen carefully to dive briefings and directions and respect the advice of those supervising my diving activities. Re cognize that additional training is recommended for participation in specialty diving activities, in other geographic areas and after periods of inactivity that exceed six months. I Agree 5. Adhere to the buddy system throughout every dive. Plan dives – including communications, procedures for reuniting in case of separation and emergency procedures – with my buddy. I Agree 6. Be proficient in dive planning (dive computer or dive table use). Make all dives no decompression dives and allow a margin of safety. Have a means to monitor depth and time underwater. Limit maximum depth to my level of training and experience. Ascend at a rate of not more than 18 meters/60 feet per minute. Be a SAFE diver – Slowly Ascend From Every dive. Make a safety stop as an added precaution, usually at 5 meters/15 feet for three minutes or longer. I Agree 7. Maintain proper buoyancy. Adjust weighting at the surface for neutral buoyancy with no air in my buoyancy control device. Maintain neutral buoyancy while underwater. Be buoyant for surface swimming and resting. Have weights clear for easy removal, and establish buoyancy when in distress while diving. Carry at least one surface signaling device (such as signal tube, whistle, mirror). I Agree 8. Breathe properly for diving. Never breath-hold or skip-breathe when breathing compressed air, and avoid excessive hyperventilation when breath-hold diving. Avoid overexertion while in and underwater and dive within my limitations. I Agree 9. Use a boat, float or other surface support station, whenever feasible. I Agree 10. Know and obey local dive laws and regulations, including fish and game and dive flag laws. I understand the importance and purposes of these established practices. I recognize they are for my own safety and well-being, and that failure to adhere to them can place me in jeopardy when diving.
