Tour Participant Waiver

Release of Liability and Waiver of Claims – Road Tour Activities

BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION. PLEASE READ CAREFULLY.

In consideration of 16550843 Canada Inc., a duly incorporated Canadian corporation (the “Company”), permitting the undersigned (“I” or “me”) to participate in a Supercar Road Tour experience (the “Road Tour Activities”), and for other good and valuable consideration, I agree to all terms and conditions set out in this agreement (this “Agreement”).


Assumption of Risks

I acknowledge and understand that participating in Road Tour Activities involves inherent risks and hazards, including but not limited to: collision, vehicle malfunction, adverse weather conditions, road surface conditions, actions of other participants or drivers, and the possibility of serious injury, death, or property damage.

I voluntarily choose to participate in the Road Tour Activities and accept full responsibility for all associated risks, whether caused by my actions, those of others, or conditions of the route.

I agree that I am responsible for any damage caused to the vehicle I am driving due to my actions, negligence, or failure to follow instructions. This includes, but is not limited to, unsafe driving, failure to obey traffic laws, or any conduct deemed inappropriate or hazardous by the Company or its representatives.

I understand I must comply with all Company instructions and abide by applicable laws and regulations at all times. The Company reserves the right to remove me from the Road Tour Activities without refund if I fail to comply or behave in a way that jeopardizes the safety of myself, others, or the vehicles.


Waiver & Release

I hereby waive, release, and discharge any and all claims that I now have or may have in the future against the Company, its affiliates, and their respective directors, officers, employees, agents, representatives, shareholders, successors, and assigns (collectively, “Releasees”) arising out of or in connection with my participation in the Road Tour Activities.

This waiver includes claims related to injury, death, or property damage and applies regardless of the cause, including negligence, breach of contract, or breach of statutory or other duty of care (including under occupiers’ liability legislation).

I agree not to initiate any lawsuit or legal action against the Company or any other Releasee, and I fully release and discharge the Releasees from any liability connected to the Road Tour Activities.


Indemnification

I agree to indemnify and hold harmless the Company and all Releasees from and against any and all losses, damages, liabilities, claims, actions, costs, and expenses (including legal fees) arising out of or relating to my participation in the Road Tour Activities, including any third-party claims.


Entire Agreement

This Agreement is the complete and exclusive statement of the agreement between me and the Company regarding the Road Tour Activities and supersedes any prior discussions or agreements. If any portion of this Agreement is found to be invalid or unenforceable, the remaining sections will remain in full force and effect.

This Agreement is binding on and benefits me, my heirs, executors, administrators, and next-of-kin, as well as the Company and its successors and assigns.


Governing Law

This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in Ontario.


I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD THIS AGREEMENT. I AM SIGNING IT VOLUNTARILY AND AM WAIVING SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
