Exeter Corn Maze. LLC, ASSUMPTION OF RISK AND WAIVER AND RELEASE OF LIABILITY


PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS AND ASSUMPTION OF THE RISKS AGREEMENT. THIS WAIVER MUST BE SIGNED PRIOR TO AND AS A CONDITION OF ENTRY INTO THE EXETER CORN MAIZE  

By entering the Exeter Corn Maze and/or Cole Farm, the undersigned Entrant and any minor accompanying the Entrant: (1) voluntarily assumes all risks incident to participation and activities located on the Exeter Corn Maze, LLC Property including the risk of lost or damaged property or personal injury; and (2) hereby expressly waives, releaser and relinquishes any and all rights, claims, or causes of action that Entrant (and any minor accompanying Entrant) may have that may arise against: Exeter Corn Maze, LLC or Cole Farm (including Arthur Cole and Robyn Cole, Individually) (Collectively “Owner”), and any of their respective parent companies, subsidiaries, affiliates, officers, directors, employees and agents (hereinafter all collectively referred to as “Operators”), for bodily injury, personal injury, mental injury, property damage, death, medical expenses and any and all other economic and non-economic losses sustained by Entrant (or any minor accompanying Entrant), which: (1) arise from or are in any way related to Owner’s Property or any Activities taking place on Owner’s Property’ or the condition of Owner’s Property, premises or equipment; or (2) are caused by the result from, in whole or in part, the NEGLIGENCE of any Owner or Operator, including any such claims brought by any person or entity claiming by or through Entrant. Entrant further covenants and agrees that he/she will not sue Owner or Operator or assert any claims against Owner for any alleged NEGLIGENT act or omission, arising out of or in any way related to Entrant’s participation in any activities located on the property Owner, or any premises or equipment of Owner. Entrant further agrees to indemnify and hold Owner and Operator harmless from any and all liabilities, settlements, expenses, and costs, including reasonable attorneys’ fees, incurred by Owner or Operator in defending against claims, suits, etc. arising from Entrant’s participation in Exeter Corn Maze or other activities on Owner’s property. This waiver includes a waiver of all claims against Owner, as well as any claims that may otherwise exist against any Officers, Members, Employees or Agents of Owner.

Risks assumed include but are not limited to risk of broken bones; internal injuries; allergic reactions; risks of falling; risks of injury caused by falling objects; risks related to injuries sustained by collision with other persons or objects and all other risks of any kind or nature occurring on the premises.

Entrant understands and agrees to observe the safety requirements at all times. Entrant further agrees to follow any and all instructions provided by Exeter Corn Maze employees and all signage. Upon failure or refusal to follow instructions or signage, Exeter Corn Maze may revoke Entrant’s license to participate in activities located on Exeter Corn Maze, LLC and Owner may eject or otherwise bar any such Entrant from any further participation on Owner’s property for violation of rules, illegal activity, misconduct, failure to comply with safety or security measures, or for any other reason at Owner’s sole discretion; and may immediately eject Entrant from Owner’s premises without a refund.
