AERIALYMPICS PARTICIPATION WAIVER AND RELEASE OF LIABILITY & MEDIA RELEASE

READ BEFORE SIGNING. If you do not agree with the participation waiver and release of liability at any point, either for you or for the minor child you represent, you are not required to sign, in which case the registration fee will be returned, and you or the minor child you represent will not participate in this event. If you are not an English speaker, please ask a translator for assistance before signing.

 

PARTICIPATION WAIVER AND RELEASE OF LIABILITY

To participate in any way in the AERIALYMPICS, an aerial arts competition, or its related events and activities, the undersigned understands and agrees that:

1. I understand the risk of injury from the activities involved in the AERIALYMPICS is significant for myself or the minor child I represent, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal choices may reduce this risk, the risk of serious injury does exist; and

2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, even if arising from the negligence of the releasees or others, and I assume full responsibility for participation by myself or the minor child I represent; and

3. I willingly agree to comply with the stated and customary terms and conditions for participation for myself or for the minor child I represent. If, however, I observe any unusual significant hazard during my presence or participation, I will be responsible for removing myself or the minor child I represent from participation and I will bring such to the attention of the nearest official immediately; and

4. I, for myself or the minor child I represent and on behalf of my heirs, assigns, personal representatives and next of kin, or the heirs, assigns, personal representatives and next of kin of the minor child I represent, HEREBY RELEASE AND HOLD HARMLESS AERIALYMPICS, their officers, officials, owners and lessors or premises used to conduct the event, WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

AERIALYMPICS adheres to any privacy rules and regulations of which it is aware, and we respect specific requests not to share the information described below. These requests must be made in writing to info@aerialympics.com

Beyond these specific requests, the undersigned understands and agrees that:

I grant to Aerialympics the absolute and irrevocable right and unrestricted permission concerning any photographs and video that have been or may be taken of me or the minor child I represent in connection to AERIALYMPICS activities or in which I may be included with others. AERIALYMPICS may use, reuse, publish, and republish the photographs in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use my name and/or social media handle(s) in connection with any use if so chosen.

I release and discharge Photographer and Videographer from any and all claims and demands that may arise out of or in connection with the use of the photographs and videos, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of Photographer and Videographer, as well as the person(s) for whom the photographs and videos were taken.

I am a legally competent adult and have the right to contract in my own name for myself or the minor child I represent. I have read this document and fully understand its contents. This release shall be binding upon me and my heirs, legal representatives, and assigns or the heirs, legal representatives, and assigns of the minor child I represent.
