ZEN HOUSE SEDONA GUEST AGREEMENT & LIABILITY WAIVER

This Agreement applies to all members of the Guest's party no matter the age or affiliation. Guest acknowledges that Guest is responsible for sharing the renter agreement, and its requirements, with all members of the Guest's party and anyone else permitted onto the Rental Property by the Guest.

In consideration of the rent received and the mutual promises contained herein, Owner of the Rental Property does hereby lease and rent to Guest(s) such Rental Property under the following terms and conditions:

  1. Guest agrees to abide by all rules and regulations contained herein or posted on the premises related to the Rental Property. Guests obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that Guest uses. Guests agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation. Guest's breach of any duty contained in this paragraph shall be considered material and shall result in the termination of guest occupancy with no refund of any kind.


  1. In no event shall the Rental Property be occupied by more persons than the capacity of the property as stated on the web site or the confirmation letter, without prior approval by Owner. No fraternities, school, civic, or other non-family groups are allowed unless Owner grants prior approval. In no event shall Guests assign or sublet the Rental Property in whole or in part. Violations of these rules are grounds for expedited eviction with no refund of any kind. Guests hereby acknowledge and grant specific permission to Owner to enter premises at any time for inspection purposes should Owner reasonably believe that Guests are causing or have caused any damage to Rental Property. Guest further agrees to grant Owner access to Rental Property for purposes of maintenance and repair. If listed "For Sale", Guests agree to grant access by scheduled appointment upon notification.


  1. 1 pet is allowed at a $100 charge, must be housebroken and cleaned up after. Additional pets considered. Pets NOT allowed on furniture, violation of this will result in an additional charge of $250
  2. Guests must inform the Owner of their intention to bring children and the specific number. A child is defined as any person under the age of 18.


  1. No refunds will be provided due to inoperable appliances, pools, hot tubs, elevators, etc. The Owner will make every reasonable effort to assure that such appliances will be and remain in good working order. No refunds will be given due to power blackouts, water shortage, flooding, snow, construction at adjacent properties, or mandatory evacuations of the area by county officials due to hurricanes or other potentially dangerous situations arising from acts of god or nature.


  1. If a hot tub or pool is provided at the Rental Property, it will be prepared and tested for proper and safe chemicals prior to or on the day of occupancy. Misuse of a hot tub or pool by the spilling of foreign substances into the pool, i.e. soap, shampoo, oils, glass or metal will result in a Service Call Charge at the sole discretion of Owner. Under no circumstances are pets allowed in pools or hot tubs. Violation of this provision shall be grounds for expedited eviction and forfeiture of all monies paid.


  1. If linens or towels are rented from Owner or supplied with Rental Property, Guest is responsible for lost or damaged items at the cost of two (2) times the published standard rental price for such damaged or lost linens or towels.


  1. In the event Owner is unable to make Rental Property available for any reason other than described above or a reasonable substitute as determined by Owner, Guest agrees that Owner's sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and Guest expressly acknowledges that in no event shall Owner be held liable for any special or consequential damages which result from this unavailability. Guest also agrees to indemnify Owner from and against liability for injury to Guest or any other person occupying Rental Property resulting from any cause whatsoever including, but not limited to, injury sustained as a result of use of the spa, hot tub, sauna, whirlpool tub, pool, exercise equipment, elevator, etc. except only such a personal injury caused by the gross negligence or intentional acts of the Owner.


  1. Owner may terminate this Agreement upon the breach of any of the terms hereof by Guest. Guest shall not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately.


  1. Agreement shall be enforced under the laws of the state within which the Rental Property is located, including any applicable rental acts of that state, and represents the entire Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in the county within which the Rental Property is located. If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement.


  1. The Rental Property may offer access to recreational and water activities, including but not limited to canoes, bicycles, cold plunge, and swimming. Guest fully understands and acknowledges that outdoor recreational and water activities have inherent risks, dangers and hazards. Participation in such activities and/or use of equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability. Guest agrees to fully indemnify and hold harmless the Owner and any and all agents, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of the Owners, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable. Guest hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the Owners or by any other person. Guest hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Owner and any and all agents, employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of Rental Property facilities, equipment, or activities. Guest further assumes full responsibility for the actions of any and all persons whom he may allow to enter the property during the rental period and indemnifies Owner from any and all claims arising from such other persons.


  1. HOT TUB GUIDELINES:
  2. YOU ARE USING THE HOT TUB AT YOUR OWN RISK.
  3. PREGNANT WOMEN, PERSONS WITH HEART DISEASE, DIABETES OR HIGH BLOOD PRESSURE PROBLEMS AND ELDERLY PEOPLE SHOULD NOT USE A HOT TUB OR SPA WITHOUT A DOCTOR’S PERMISSION.
  4. WE DO NOT ADVISE YOUNG CHILDREN TO USE THE HOT TUB. IN THE EVENT THAT YPU ALLOW A MINOR TO USE THE HOT TUB, THEY MUST BE SUPERVISED AT ALL TIMES.
  5. HOT TUB TEMPERATURES CANNOT BY LAW EXCEED 104 DEGREES.
  6. NEVER USE A HOT TUB OR SPA ALONE.
  7. LIMIT TIME IN THE HOT TUB OR SPA TO NO MORE THAN 15 MINUTES.
  8. NO GLASS PRODUCTS WHATSOEVER IN OR AROUND HOT TUB.
  9. DO NOT USE A HOT TUB OR SPA IF THE WATER TEMPERATURE IS MORE THAN 104 DEGREES FAHRENHEIT.
  10. THE HIGH WATER TEMPERATURE IN A HOT TUB OR SPA WILL ACCELERATE DROWSINESS IF A PERSON HAS CONSUMED ALCOHOL OR IS TAKING DRUGS, INCREASING THE RISK OF DROWNING.
  11. The guest further agrees to acknowledge that they are using the hot tub at their own risk and that there is risk of personal injury or death while using the hot tub. 
  12. INFRARED SAUNA - The use of infrared saunas may have many health benefits; however it is important that you fully understand how to use the sauna and gradually introduce your body to the infrared sauna therapy to produce the best results. 
  13. Hydration is a requirement for sauna use. Drinking water or even advanced electrolyte replacement water is recommended before and after sauna use. Hydrate with at least 8oz of water to prepare your body for increased core temperature. 
  14. To get your body accustomed to infrared sauna therapy start with sessions of 15-20 minutes several times over a week at 100 degrees. If you feel comfortable with this gradually increase to 130-140 degrees and 30-40 minute sessions. 

  15. **The sauna takes 45-60 minutes to heat up and is on a 60 minute timer for safety purposes. To keep it at a higher temperature you will have to keep adding time to the timer**

  17. After care: drink at least 24oz of water or electrolyte to rehydrate. 
  18. Dry off with a towel. Cool down naturally or with a cool shower. 
  19. Self-treatment of any disease with an infrared sauna is not recommended without direct supervision of a certified physician. If anything listed below applies to you, please consult your physician before using an infrared sauna. 
  20. MEDICATIONS 
  21. Individuals who are using prescription drugs should seek the advice of their personal physician or a pharmacist for possible changes in the drugs effect when the body is exposed to infrared waves or elevated body temperatures. Some medications including diuretics, barbiturates, and beta-blockers and others may impair the body’s natural heat loss mechanisms. Some over the counter drugs such as antihistamines may also cause the body to be more prone to heat stroke. 
  22. CARDIOVASCULAR CONDITIONS
  23. Individuals with cardiovascular conditions or problems (hypertension/hypotension), congestive heart failure, impaired coronary circulation or those who are taking medications which might affect blood pressure should exercise extreme caution when exposed to prolonged heat. Heat stress increases cardiac output and blood flow in an effort to transfer internal body heat to the outside environment via the skin (perspiration) and respiratory systems. If using a pacemaker or defibrillator, please discuss risks involved with your physician. 
  24. ALCOHOL 
  25. Contrary to popular belief, it is not advisable to attempt to “sweat out” a hangover. Alcohol intoxication decreases a person’s judgment; therefore it might not be realized when the body has a negative reaction to high heat. Alcohol also increases the heart rate, which may be further increased by heat in the infrared sauna. 
  26. CHRONIC CONDITIONS 
  27. Various chronic conditions including Parkinson’s, Multiple Sclerosis, Central Nervous System Tumors, Lupus, Diabetes with Neuropathy and other conditions are associated with impaired sweating. Please consult a physician before use if you have a chronic condition. 
  28. JOINT INJURY / ENCLOSED INFECTIONS
  29. If you have a recent joint injury, it should not be heated for the first 48 hours after injury or until the hot and swollen symptoms subside. If you have joints that are chronically hot and swollen, these joints may respond poorly to vigorous heating of any kind. Vigorous heating maybe contraindicated in cases of infections. 
  30. IMPLANTS 
  31. Metal pins, rods, artificial joints or any other surgical implants generally reflect far infrared waves and thus are not heated by this system, nevertheless you should consult your surgeon prior to using an Infrared Sauna. Certainly, the usage of an Infrared Sauna must be discontinued if you experience pain near any such implants. Silicone does absorb far infrared energy. Implanted silicone or silicone prostheses for nose or ear replacement may be warmed by the far infrared waves. Since silicone melts at over 200°C (392°F), it should not be adversely affected by the usage of an Infrared Sauna. It is still advised that you check with your surgeon and possibly a representative from the implant manufacturer to be certain.
  32. USERS ARE NOT PREGNANT 
  33. Fetal damage can occur with a certain elevated body temperature which may arise from sauna use.
  34. USERS MUST BE 18 YEARS OLD UNLESS ACCOMPANIED BY AN ADULT
  35. The core body temperature of children rises much faster than adults. This occurs due to a higher metabolic rate per body mass, limited circulatory adaptation to increased cardiac demands and the inability to regulate body temperature by sweating. If user is under 18 they must be accompanied by an adult.
  36. ELDERLY
  37. The ability to maintain core body temperature decreases with age. This is primarily due to circulatory conditions and decreased sweat gland function. The body must be able to activate its natural cooling processes in order to maintain core body temperature. If you have concerns related to sauna use as it relates to your age please consult your medical Physician prior to use. Initial that you
  38. **DO NOT USE the infrared sauna if you are Pregnant or have Hemophilia, Fever, or Heat Insensitivity. ** 
  39.  In the rare event that you experience dizziness, pain and/or discomfort, immediately discontinue sauna use.  
  40.  
  41. It is not advisable to use an infrared sauna under certain medical conditions and it is recommended that you consult a physician before first use or if questions/concerns arise. It is solely your responsibility to monitor your body/reactions and determine if it is appropriate to use the Sauna. You alone are responsible for your safety and well-being. 
  42.  
  43. Renter acknowledges and accepts the risks inherent in the use of the Infrared Sauna. Renter voluntarily assumes the risk of injury, accident or death, which may arise from the use of the Infrared Sauna.

  45. **Unless you’ve been practicing cold exposure for a long time already, don’t start at 39 degrees. The worst thing you can do is push your body too far, too fast. Like going the gym for the first time and working out for 3 hour it’s going to do more damage than good.
  46. Start somewhere between 50-60 degrees, and drop it a degree every week, so that you’re able to complete at least 2 minutes of a cold plunge. Even at 60 degrees, you’ll still get the anti-inflammatory benefits***
  47. Consult a physician if you are concerned about cold water therapy and how it pertains to your health. 
  48. While entering and exiting the cold plunge please use caution 
  49. Renter acknowledges and accepts the risks inherent in the use of the Cold Plunge. Renter voluntarily assumes the risk of injury, accident or death, which may arise from the use of the Cold Plunge. 
  50. The JOOVV Red Light Therapy 3.0 Quad-  There will be eye protection on the shelf next to the device and we require that you use it when using the Joovv red light device. If the protective eye glasses are not there please contact the owner immediately.  Do not stare directly into the LEDs. The beam window covers the full front surface area of the device. If your eyes are more sensitive to light or if you take medications that have a history of causing photosensitivity, we recommend that you consult your physician before treating with a Joovv device. Furthermore if you have any serious or chronic medical conditions consult your physician before using the Joovv red light device.  To use the Joovv red light device red lights play/pause button on the top right panel. To add time press it again and then press the time button. And to change settings from red to infrared or use both press the play button and then the mode button. 


  1. On Thursday between 12-4pm we have a hot tub maintenance man that will be there to clean/adjust the tub. He will enter through the front door and clean the hot tub/cold plunge this usually takes 10-30 minutes unless the hot tub or cold plunge need to be drained. If you have an issue with this please notify owner at least 1 week in advance and we can try and work something else out. 



NOW, THEREFORE, in consideration of the mutual agreements and covenants herein contained, Guest has read and agreed to the following:

I understand the rules and rental conditions upon which I am agreeing to rent accommodations, equipment, and use of the property. I acknowledge and accept that the sole responsibility for safety lies with the participant. In agreeing to this, I acknowledge that outdoor activities and exposure to the natural elements and animals can be dangerous and sometimes result in injury and even death. Steps and decks can be slippery, animals and insects can threaten and infect or injure, exposure to the elements can cause hypothermia, sunburn, among other risks inherent in participating in camping, outdoor and water activities. I know that alcohol and/or drugs do not mix safely with any outdoor activity.

I certify that I am at least 18 years of age and am signing this Agreement on my own behalf. I acknowledge that I am voluntarily participating in the use of the Rental Property, its amenities, and any activities associated with my stay, and I assume all risks associated with such use.

I accept full personal responsibility for any injury, loss, or damage that may occur to me during my stay, including but not limited to use of the property, equipment, and amenities.

I further acknowledge that each adult member of the Group is required to sign this Agreement individually and is responsible for their own actions, safety, and participation.

If I am accompanying or responsible for any minor(s) (under the age of 18), I agree that I am solely responsible for their supervision, safety, and conduct at all times. I assume full responsibility for any risks, injuries, damages, or claims arising from the minor’s presence or participation in any activities or use of the property and its amenities.

I will abide by the rules and accept these rental conditions:

  • The property I rent will be returned in the same condition in which it was rented and I will be responsible for all damage and/or loss that occurs during my rental period.
  • I agree to hold harmless and to indemnify the Owner of the Rental Property against all loss, damage, expense and penalty on account of personal injury or property damage to the rental dwellers, the undersigned or to any minor child or children in the charge of the undersigned, howsoever rising, whether by act or acts or failure to act of the employees, owners or animals of the said company or property owners or not.
  • I acknowledge receipt of the property in good order and condition (if found otherwise per my arrival I will contact Owner immediately) and further agree that the Owner of the Rental Property shall not be liable for consequential damages of any kind or nature from whatever cause arising, whether property or equipment is loaned or rented.
  • I enter into agreement freely with the Owner of the Rental Property at my own risk, acknowledging the risks inherent in indoor and outdoor activities and assume any and all responsibility for the minor children and myself in my charge.
  • All parties agree to and will comply with Federal, State and County pollution laws and any other applicable laws and regulations.
