RELEASE OF LIABILITY AND ASSUMPTION OF RISK 

The individual named below (referred to as "I" or "me") desires to participate in chartering a vessel for purposes of snorkeling, fishing and/or hunting for various species, including but not limited to alligator and iguana hunting, snook fishing and gigging (whether singular or plural, hereinafter referred to as the "Activities") provided by Reefs to Rivers Fishing Charters, LLC, a Florida limited liability company with offices located at 1950 71st Street South, Boynton Beach Florida, 33426 (the "Company"). In consideration of being permitted by the Company to participate in the Activities and in recognition of the Company's reliance hereon, I agree to all the terms and conditions set forth in this instrument (this "Release").

ASSUMPTION OF RISK. I AM AWARE AND UNDERSTAND THAT THE ACTIVITIES ARE POTENTIALLY DANGEROUS ACTIVITIES AND INVOLVE THE RISK OF SERIOUS INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF THE COMPANY, INCLUDING NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF THE COMPANY. NOTWITHSTANDING THE RISK, I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE ACTIVITIES, WHETHER CAUSED BY THE NEGLIGENCE OF THE COMPANY OR OTHERWISE.

RELEASE. I hereby expressly waive and release any and all claims, now known or hereafter known, against the Company, and its officers, directors, manager(s), employees, agents, affiliates, members, successors, and assigns (collectively, "Releasees"), arising out of or attributable to my participation in the Activities, whether arising out of the negligence of the Company or any Releasees or otherwise. I covenant not to make or bring any such claim against the Company or any other Releasee, and forever release and discharge the Company and all other Releasees from liability under such claims. 

INDEMNITY. I will defend, indemnify, hold harmless, and reimburse the Company from and for all damages, losses, costs, or expenses (including legal fees) incurred by the Company in respect of any, loss, or property damage, including but not limited to damage to the Company boat, air rifles, reels, bang guns and any equipment used in connection with the Activities, however caused or resulting from, arising out of, or otherwise in connection with my participation in the Activities. I will reimburse the Company if anyone makes a claim against Company in connection with my participation in the Activities, including, without limitation, any accident I may be involved in or any injury, loss, damage to me, other parties or property however caused.

PUBLICITY. I irrevocably grant the Company my permission and the right to photograph me, and to use any and all photographic or other images taken of me, on the date hereof in connection with the Activities, including finished pictures, negatives, transparencies, proofs, reproductions, copies of the original prints and negatives, and digital information pertaining to them. I hereby grant the Company, without limitation, the right to use my name and likeness in connection with the Activities for any publicity without further compensation or permission. 

ENTIRE AGREEMENT. This Release constitutes the sole and entire agreement of the Company and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of the Company and me and their respective successors and assigns. All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the State of Florida without giving effect to any choice or conflict of law provision or rule (whether of the State of Florida or any other jurisdiction). Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in Palm Beach County, Florida and I hereby consent to the exclusive jurisdiction of such courts.

I represent and warrant to Company that I am at least eighteen (18) years of age and that I have full right, power, and authority to enter into this Agreement and grant the rights granted hereunder.


I am the parent or legal guardian of the minor named below. I have the legal right to consent to and, by signing below, I hereby do consent to the terms and conditions of this Release of Liability and Assumption of Risk.
