Padre Island Jet Ski LLC Rental Agreement

SAFETY INSTRUCTIONS AND REGULATIONS

Must have and show a valid Government ID. No Exceptions.

Minimum age to rent and drive a Jet Ski (without a guardian) is 25 with Valid ID. Must bring ID with you, no exceptions. A Texas Parks and Wildlife (TPWD) certified boater education course and photo ID is required for any person born on or after September 1, 1993 to operate: (1) a vessel powered by a motor of more than 15 horsepower; or (2) a windblown vessel over 14 feet in length. 

We DO NOT allow additional passengers or drivers to switch out with people at the dock during a rental. If you have multiple riders that wish to take turns driving or riding then you will need to make separate reservations. Our insurance will not allow swapping out passengers during a single rental. If you make a reservation with the intent to do otherwise we WILL NOT refund your money.

We reserve the right to deny service if person(s) are intoxicated and no refund will be provided. 

If you are born after September 1st, 1993 and do not posses a Boater's Education Safety Course Certificate we reserve the right to deny service if you are the sole driver of a personal watercraft. You agree that you will not receive a refund due to our inability to rent out the time slot to another customer.

Be Early, Show up 20 minutes before your reservation time. Being late will only cut into your reservation, so please don't be late!

A maximum of 3 people can ride on a Jet Ski . Total weight must be less than the total combined weight of the rider(s). If the total weight is too much (more than 400 lbs) we will require you to rent an additional Jet Ski, if available. Ages 6 and up can ride with a jet ski driver 30 years of age and up. 

All drivers and passengers must wear personal flotation devices, which are provided by Padre Island Jet Ski, at all times.  

100% refund if cancellation request is more than 48 hours from the time of reservation . No refunds within the 24 hour window.

MANDATORY BOATER EDUCATION REQUIREMENTS

Recommended for all boat operators and required for those persons born on or after September 1, 1993. For information on boater education courses, call (800) 792-1112, ext. 4999 , or visit www.tpwd.texas.gov/boatered/

No person may operate a PWC or motorboat powered by a motor of more than 15 horsepower on the public waters of this state unless the person is at least 13 years of age and has successfully completed a Boater Education Course or is supervised by another person who: (1) is at least 18 years of age (2) can lawfully operate the motorboat; and (3) is on board the motorboat when under way. Proof of completion of the requirements to obtain a vessel operator's license issued by the United States Coast Guard and will satisfy the requirement for completing a boater education course in this state. Boater education courses from other states are acceptable.

I have read and understand the requirements for a Boater Education course and will be subject to a citation for operating a PWC without one. I understand that it is my responsibility and NOT Padre Island Jet Ski LLC to obtain this license and without one will be subject to forfeiting my reservation (without refund).


OPERATION OF YOUR PWC

Renters must agree to abide by the following terms at all times during the rental period.  

  1. I understand that the PWC I am renting is a high-performance boat, not a toy, and as such I will carefully observe and follow the instructions and safety rules receive from my rental operator. 
  2. I will not operate the PWC while consuming alcoholic beverages or taking drugs. The rental will be immediately cancelled with no refund given if the renter is deemed to be under the influence or operating in an unsafe or hazardous manner. Operating a PWC under the influence is a federal offense and can be subject to fines as high as $5,000.00.
  3. I will pay close attention to the required safety equipment and instructions provided by my rental operator so that I am able to use it in the case of an emergency. Each PWC is equipped with a whistle and a fire extinguisher. 
  4. I will ensure my passengers and myself each have a U.S. Coast Guard approved life jacket that is the proper size for the intended wearer, is in good and serviceable condition (including straps and zippers) and is properly worn at all times.  
  5. I understand that it is highly recommended to wear protective clothing such as a wetsuit or wetsuit bottom while operating the PWC due to the risk of internal Injuries if water is forced into body cavities as a result of falling into the water or being near the jet thrust nozzle.
  6. I understand that the jet drive intake has tremendous suction and will pull loose items, such as long hair, sand, stones, fishing line, loose clothing, or life jacket straps through the jet drive. I will keep these objects away from the intake grate while the PWC is running. I will not apply the throttle when anyone is standing or swimming anywhere near the PWC.
  7. Before starting the engine, I will securely attach the engine shut-off cord/safety lanyard to my wrist or life jacket and wear it at all times, keeping it free from the handlebars so that if I fall off of the PWC, the engine will stop.
  8. I understand that in order to turn off the engine, I need to push the stop button. I understand that the throttle controls the speed of my PWC. I understand that I should apply the throttle lever on the handle to accelerate and release it to slow down.
  9. I understand that stopping the engine will not stop the forward motion of the PWC, and that on most PWC's, steering control is lost when the throttle is released or when the engine is turned off. 
  10. I understand that I must use the throttle to turn. The jet thrust is what makes the PWC turn. The PWC is in motion at all times, there is no neutral position.
  11. I understand that the IBR (intelligent brake and reverse) system will slow the PWC, but I need to allow the proper time and distance to slow down or stop.  
  12. When operating my PWC, I will maintain a proper lookout and scan constantly with sight and hearing, being alert for conditions that limit my visibility or block my vision of others. I will watch out for areas of low water, taking into consideration the changing tides.  
  13. I will always operate my PWC at safe speeds, taking into consideration the conditions around me, including other boats, weather, and visibility. I will refrain from weaving through vessels that are underway, stopped, moored or at anchor while exceeding a reasonable speed.
  14. I will be aware of the traffic around my PWC. Sailboats, commercial vessels and all other boats have the right of way. I must keep out of their way at all times and avoid crossing ahead of other vessels. I can change course, slow down, or stop if necessary to avoid a collision. If a head on situation is arising, unless otherwise agreed, each shall alter course to starboard (right) and with the other on the port (left) side.  
  15. I will not operate my PWC at an excessive speed or in a slow speed area or within an area designated as bathing, fishing swimming, or otherwise restricted. 
  16. I will follow local regulations regarding speed limits, whether posted or not. I will follow no wake zones and operate at headway speed without creating a swell or wake. I will not operate so as to cause a hazardous wake or wash. Headway speed means slow, idle speed, or speed only fast enough to maintain steerage without creating a swell or wake.
  17. I will not operate at a rate of speed greater than is reasonable and prudent or greater than a rate of speed that would prohibit me from stopping within the clear distance ahead of me.  
  18. I will avoid making sharp turns and other maneuvers that make it difficult for others to avoid colliding with me or to understand where I am going.
  19. I will not jump wakes or waves, nor will I steer toward an object or person and then turn sharply in close proximity to that object or person in order to spray or attempt to spray them with the wash or jet-spray of the watercraft, as this is unsafe operation.  
  20. I will not operate in a circular course around another vessel, PWC, or individual engaged in water activities unless retrieving a downed or fallen passenger or a person engaged in similar activity. 
  21. If a passenger or I fall off the PWC, I will board from the rear of the PWC. The engine should not be running when a person in the water is near the rear of the PWC. Use the rear grab handle to pull your knees to the PWC platform and use the handle on the seat or the step to help pull yourself onboard. Use the handlebars to maintain balance as you position yourself forward on the seat. Passengers should board the same way after the driver is on board. Once all aboard, reconnect the safety switch and restart the engine.  
  22. If I capsize in open water, I understand I should swim to the rear of the PWC and turn it upright. I am aware that most PWC's have a decal at the bottom or rear of the vessel that indicates the direction to roll your PWC to return it to an upright position. Failure to follow the correct procedure can result in severe damage to the PWC.  
  23. I understand that there is no towing, fishing, swimming, smoking, water skiing, surfboarding, wakeboarding, or pets allowed.  
  24. I will not moor or attach to any buoy, beacon, light marker, stake, flag or other aid to safe operation or to move, remove, displace ,tamper with, damage or destroy the same. I will not anchor in the traveled portion of a river or waterway so as to prevent, impede, or interfere with safe passage of any other boat through the same area. 
  25. I will not ride at night, as I understand that my PWC does not come equipped with navigation lights and most states do not allow PWC operation at night.  
  26. I will ensure I have enough gas for my return back to the marina. I understand a good rule of thumb regarding fuel use is one-third out, one-third back in, and one-third in reserve.
  27. I understand I shall return the PWC in good working order and condition at the end of the rental. If any equipment has been lost or damaged, whether the damage is intentional or unavoidable. I will inform Padre Island Jet Ski upon return and I understand that I am financially responsible for lost or damaged equipment or damage to the PWC. The cost of replacement or repairs are as follows: Life Jacket $50, Jet Ski Pump Damage $ 800, Jet Ski Hull Damage $150 per square/inch, Jet Ski full of water Damage $400, Seat Damage $250, Clean up Fee $40-$80. 
  28. I agree that PADRE ISLAND JET SKI LLC has the rights to use any of my images or videos for promotional use or ads online. 
  29. In signing this rental agreement, I acknowledge and represent that I HAVE READ THE FOREGOING Waiver and Release of Liability, UNDERSTAND IT AND SIGN IT VOLUNTARILY as my own free act and deed with no inducement; and that no representations, statements or inducements, apart from the foregoing written agreement, have been made by the RELEASED PARTIES or relied upon by me; and I EXECUTE THIS RELEASE OF LIABILITY FOR FULL, ADEQUATE AND COMPLETE CONSIDERATION FULLY INTENDING TO BE BOUND BY SAME.

In signing below, I certify that I am at least 25 years of age for a jet ski rental, and that I have fully read and understand all the terms, conditions and rules set forth above, and agree to all terms without reservation. I am voluntarily making this release and waiver of any liability for myself or a participant for whom I am legally responsible.  

In signing below, I also acknowledge that I have fully read and understand the form titled “Safety Instructions and Regulations.” I also acknowledge that I understand the safety instructions for personal watercraft operations as well as my financial obligations for responsible personal watercraft rental for myself or a participant for whom I am legally responsible.
