FACILITY RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY CONSENT

AGREEMENT (“AGREEMENT”)

 

IN CONSIDERATION of being permitted to participate in any way in S&K GAMING LLC, dba Gray Wolf Peak Casino, sport and recreation activities ("ACTIVITIES") I, for myself for personal representatives, assigns, heirs, and next of kin:

1.     Acknowledge, agree, and represent that I understand the nature of these sport and recreation activities and that I am qualified, in good health, and in proper physical condition to participate in such activities. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the “Activities”.

2.     Fully understand that:

a.      these sport and recreation activities involve risks and dangers of serious bodily injury, including permanent disability, paralysis, and death ("Risks");

b.      these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the activities, the condition in which the activities take place, or the negligence of the "Released Parties" named in 4 below;

c.      there may be other risk and social and economic losses either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs and damages I incur as a result of my participation or that of the minor in the activities.

3.     Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist.

4.     Hereby release, discharge, and covenant not to sue S&K GAMING LLC., and its respective administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owner and lessors of premises on which the activities take place, (each considered one of the "Released Parties" herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Released Parties or otherwise, including negligent rescue operations, and I further agree that if, despite this release and waiver of liability, assumption of risk, and indemnify agreement I, or anyone on my behalf, makes a claim against any of the Released Parties, I will indemnify, save, and hold harmless each of the Released Parties from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.

5.     In addition, I agree to follow the rules of conduct as stated below and set by S&K GAMING LLC, dba Gray Wolf Peak Casino. Failure to do so may result in suspension from participation. Consent: I the undersigned coach or guardian or adult participant hereby grant authority to the staff at Gray Wolf Peak Casino to render a judgment concerning medical assistance or hospital care in the event of an accident or illness during my absence.

6.      Use of Likeness; Participants and his/her parents or guardian hereby authorize “S&K GAMING LLC, dba Gray Wolf Peak Casino” and its assigns to use any and all photographs, pictures, videos or other likenesses of participants in its promotional materials or social media platforms

 

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

 

Gray Wolf Peak Casino Golf Simulator Rules of Conduct

1.Bring your own clubs.

2. Only practice swing when standing in the T-box area of the simulator.

3. Keep food and beverages at the provided tables in the seating area. NO FOOD OR DRINK INSIDE THE TEE BOX at any time.

4. Use clean golf clubs - All clubs must be cleaned before play.

5. Please make sure your golf balls are clean. Do not mark the golf balls with a marker, highlighter or pen.

6. Only wedges of 56 degrees or less are allowed.

7. No foot spray or aerosol spray allowed. Impact tape only.

8. Only use tees provided by Gray Wolf Peak.

9. No metal cleated shoes or dirty shoes in the simulator area.

10. Guests must be pre-registered with a signed liability waiver before golfing.

11. Any golfer under 16 must be accompanied by a playing adult.

12. No children under 8 years of age allowed in the simulator area.

13. When your reservation time is over we insist that you promptly exit the simulator to allow the next reservation to begin.
