GUEST’S ACKNOWLEDGMENT, RELEASE, AND INDEMNITY AGREEMENT

Unlimited Off-Road Park, LLC, (Unlimited Off-Road Park) is the Operator of the Off-Road Park in Montgomery County, Tx.

           For a stated fee, Unlimited Off-Road Park permits Guest to enter the property, operate or ride on an all-terrain or off-road vehicle, operate or ride on a jet ski, swim, fish, picnic, barbecue, or merely be on the property during stated days and hours of the day. Unlimited Park permits Guest to enter the property with a minor child or children, subject to the provisions of the attached Child Addendum and the strict supervision of each child by Guest. Unlimited Park permits Guest to enter the property with a domesticated pet, provided Guest keeps the animal leashed and under the immediate control of Guest. I EXPRESSLY AGREE, COVENANT, AND PROMISE TO ACCEPT AND ASSUME ALL RESPONSIBILITY AND RISKS FOR INJURY, DEATH,ILLNESS, OR DAMAGE TO MYSELF, TO OTHERS OR TO MY PERSONAL PROPERTY ARISING FROM MY PARTICIPATION IN THIS ACTIVITY OF RIDING, SWIMMING JET SKING OR ANY OTHER ACTIVITY ON UNLIMITED OFF-ROAD PARK.I acknowledge that my participation in any activity is purely voluntary, no one is forcing me to participate, and I elect to participate in spite of the risks, I further acknowledge that if I am participating, I understand that Unlimited Off-Road Park makes no express or implied representation as to the condition of any roads, race tracks, buildings, gates, recreational devices, swings, diving platforms or other improvements on Unlimited Off-Road Park , on which the activities will take place. I also understand that I may be exposed to other dangerous conditions, risks and hazards on Unlimited Off-Road Park, including, but not limited to, poisonous snakes, alligators, insects and spiders , any type of infectious bacteria located in soil or waterways, natural erosion or erosion created by all-terrain vehicle riding and general conditions of the land both on and off roadways and in swimming or camping areas, which may create hazardous driving and walking conditions, animals both wild and domestic(which may be diseased and are potentially dangerous); deep waters, other persons with all-terrain vehicles on or off Unlimited Off-Road Park property.

    I EXPRESSLEY ACKNOWLEDGE THE EXISTENCE OF ALL SUCH RISKS, HAZARDS AND DANGERS WHICH I MAY BE EXPOSED TO ON UNLIMITED OFF-ROAD PARK PROPERTY. I ALSO AGREE TO FOLLOW ALL PARK RULES AS POSTED ON THE PROPERTY AND WEBSITE UNLIMITED OFF-ROAD PARK. Further, in exchange for right to enter Unlimited Off-Road Park property and engage in the activities described above, I hereby voluntary release, forever discharge and agree to hold harmless and indemnify Unlimited Off-Road Park, its agents or employees, owners, and all of the persons or entities from any and all liability, claims, demands, actions or rights of all actions, which are related to, arise out of, or in any way connect with my participation in this all-terrain vehicle activity or any activity, including specifically but not limited to the negligent acts or omissions of Unlimited Off-Road Park, its agents or employees, volunteers, owners, and all other persons or entities for any and all injury, death, illness or disease, and danger to myself or my property. IN SIGNING THIS DOCUMENT, I EXPRESSLY ACKNOWLEDGE THAT I AM RELEASING UNLIMITED OFF-ROAD PARK AND ITS OFFICERS, DIRECTORS, AGENTS, REPRESENTATIVES, GUESTS, EMPLOYEES AND VOLUNTEERS FROM LIABILITY FOR DAMAGES CAUSED BY THE NEGLIGENCE OF THE UNLIMITED OFF-ROAD PARK AND ITS OFFICERS, DIRECTORS, AGENTS, REPRESENTATIVES, GUESTS, AND EMPLOYEES OR VOLUNTEERS.  

Unlimited Park advises that the operation of or the riding on an all-terrain or off-road vehicle may be dangerous in certain circumstances and that the operator or passenger must have sufficient skill to safely operate or ride on such a vehicle. Guest agrees to operate or ride on such a vehicle safely and according to the safety rules and recommendations of the vehicle’s manufacturer. Unlimited Park advises that the operation of or the riding on a jet ski may be dangerous in certain circumstances and that the operator or passenger must have sufficient skill to safely operate or ride on such a craft. Guest agrees to operate or ride on such a craft safely and according to the safety rules and recommendations of the craft’s manufacturer. Unlimited Park permits swimming in bodies of water, but Unlimited Parks does not provide a lifeguard. Unlimited Park advises Guest that the presence near or swimming in a body of water may be dangerous in certain circumstances and that a person near or swimming in a body of water must exercise the utmost care for their own safety.

I understand that while riding at Unlimited Off-Road park ,the laws of Texas and Montgomery County apply to consumption of acholic beverages while operating an all-terrain vehicle, jet ski, or any motor vehicle. I agree to comply with those laws and not to operate an all-terrain vehicle , jet ski or any motor vehicle while impaired or legally intoxicated. I will also refrain from having open container of an alcoholic beverage while driving or riding on Unlimited Off-Road Park. Consumption of alcoholic beverages is is permitted at campsites, or upon conclusion of riding Law enforcement officers are frequent visitors to and security personnel at the park and will enforce DWI/DUI statues. I hereby agree to protect, defend, and indemnify Unlimited Off-Road Park, and their officers, owner, agents, employees, affiliates, or any person or entities associated therewith , including security personnel, from actions , rights of action, claims or causes of actions that may arise out of my operation of an all-terrain vehicle , jet ski or any type of motor vehicle while under the influence of alcohol or any other intoxicant. This indemnification shall extend through departure from Unlimited Off-Road Park, to include arrival, or 24 hours, whichever shall occur first.

MEDIA/PHOTO WAIVER; I hereby authorize and give my full consent to Unlimited Off-Road Park. and their agents and assigns to take , copyright and/or publish any and all photograph, videotapes and/or films (The Media) in which I, or my child may appear while on the property. I further authorize Unlimited Off-Road Park, to transfer, uses or cause to be used, the media in any exhibition, public displays, publications ,commercials ,art and advertising purposes, with out limitations or reservations. 

I further certify that I Have sufficient health, accident, and liability insurance to cover bodily injuries or property damage I may incur or cause while at the property or participating in any activity at Unlimited Off-Road Park and hereby agree to cover any bodily injury or property damage caused by a third party as a result of my participation of any activity or presence in Unlimited Off-Road Park. If no insurance , I am certifying that ism capable of personally paying for any and all such expenses or liability. 

           Guest accepts for Guest and for each minor child who accompanies Guest the risks, hazards, and dangers relating to the property, the operation of or riding on an all-terrain or off-road vehicle, the operation of or riding on a jet ski, the presence near or swimming in a body of water, and the acts or failures to act by other people on the property.

IN SIGNING THIS DOCUMENT, I EXPRESSLY ACKNOWLEDGE THAT I AM RELEASING UNLIMITED OFF-ROAD PARK AND ITS OFFICERS, DIRECTORS, AGENTS, REPRESENTATIVES, GUESTS, EMPLOYEES AND VOLUNTEERS FROM LIABILITY FOR DAMAGES CAUSED BY THE NEGLIGENCE OF THE UNLIMITED OFF-ROAD PARK AND ITS OFFICERS, DIRECTORS, AGENTS, REPRESENTATIVES, GUESTS, AND EMPLOYEES OR VOLUNTEERS. 

           GUEST, FOR GUEST OR EACH MINOR CHILD WHO ACCOMPANIES GUEST, HEREBY RELEASES FROM AND AGREES TO INDEMNIFY UNLIMITED OFF-ROAD PARK, LLC, AND ITS OWNERS, EMPLOYEES, AGENTS, AND CONTRACTORS FOR ANY INJURY, LIABILITY, CLAIM, ACTION, LOSS, OR EXPENSE, INCLUDING ATTORNEY FEES AND OTHER FEES AND COSTS, CAUSED BY, ARISING OUT OF, DUE TO, OR RELATED IN ANY WAY TO THE CONDITION OF THE PROPERTY, THE ACTS OR OMISSIONS OF UNLIMITED OFF-ROAD PARK, LLC, AND ITS OWNERS, EMPLOYEES, AGENTS, AND CONTRACTORS, AND ANY OTHER PERSON ON THE PROPERTY, EVEN IF SUCH INJURY IS CAUSED IN WHOLE OR IN PART BY THE SOLE, CONCURRENT, OR CONTRIBUTORY NEGLIGENCE OF UNLIMITED OFF-ROAD PARK, LLC, OR ITS OWNERS, EMPLOYEES, AGENTS, OR CONTRACTORS.

                            Parent/Legal Guardian Child Addendum

According to the provisions of Guest’s Acknowledgment, Release, and Indemnity Agreement with Unlimited Off-Road Park, LLC, the Agreement to which this Child Addendum is completed, Guest states and affirms that (1) Guest is either a parent of each following named child, having the rights, duties, powers, and privileges of a parent of each child, permitting Guest to agree to the provisions of this Child Addendum, or (2) Guest is not the parent of each following child, but Guest has the permission of a parent of the child to accompany Guest into the Unlimited Park:

           Guest promises and agrees to strictly supervise each child on or around the property onto which Unlimited Park has permitted Guest to bring the child. Guest will familiarize the child with the risks, hazards, and dangers relating to the property, to the operation of or riding on an all-terrain or off-road vehicle on the property, to the operation of or riding on a jet ski on the property, to the presence near or swimming in a body of water on the property, and to the actions or failures to act by any other person on the property, all as outlined in the Guest's Acknowledgment, Release, and Indemnity Agreement. 

I, THE PARENT/LEGAL GUARDIAN FOR EACH MINOR(S) LISTED BELOW, GIVES MY PERMISSION FOR MY CHILD TO BE PRESENT AND RIDE AN ALL-TERRAIN VEICHLE, RIDE JET SKI OR SWIM AT UNLIMTED OFF-ROAD PARK. I, THE PARENT/LEGAL GUARDIAN FOR EACH MINOR CHILD HEREBY RELEASES FROM AND AGREES TO INDEMNIFY UNLIMITED OFF-ROAD PARK, LLC, AND ITS OWNERS, EMPLOYEES, AGENTS, AND CONTRACTORS FOR ANY INJURY, LIABILITY, CLAIM, ACTION, LOSS, OR EXPENSE, INCLUDING ATTORNEY FEES AND OTHER FEES AND COSTS, CAUSED BY, ARISING OUT OF, DUE TO, OR RELATED IN ANY WAY TO THE CONDITION OF THE PROPERTY, THE ACTS OR OMISSIONS OF UNLIMITED OFF-ROAD PARK, LLC, AND ITS OWNERS, EMPLOYEES, AGENTS, AND CONTRACTORS, AND ANY OTHER PERSON ON THE PROPERTY, EVEN IF SUCH INJURY IS CAUSED IN WHOLE OR IN PART BY THE SOLE, CONCURRENT, OR CONTRIBUTORY NEGLIGENCE OF UNLIMITED OFF-ROAD PARK, LLC, OR ITS OWNERS, EMPLOYEES, AGENTS, OR CONTRACTORS.
