By signing this agreement, the undersigned (“Passenger”) acknowledges and agrees to the following terms and conditions, which shall apply to each tour or charter undertaken during the calendar year indicated on the signature page.

1. DEFINITIONS

  • Passenger: Each individual named in the booking or otherwise participating in the activity.
  • Vessel: Refers to Bama Breeze, Coastal Cruiser, or any other boat used in connection with a tour, charter, or rental operated by Flora-Bama Old S.A.L.T.S., Inc.
  • Captain: The licensed operator of the vessel, including any First Mate or designated crew member acting under the Captain’s authority.
  • Boating Activities: Includes all activities on, in, or around the vessel, including boarding, disembarking, swimming, snorkeling, sightseeing, and any ancillary or preparatory activity.

2. TOUR TERMS & CONDITIONS

All trips are subject to change or cancellation at any time. This agreement is non-transferable and binding upon execution. Participation is subject to availability, vessel capacity, and compliance with company policies.

3. WEATHER & OPERATIONAL DELAYS

Tour times may vary based on weather and sea conditions. Flora-Bama Old S.A.L.T.S., Inc. reserves the right to cancel, delay, or modify any trip due to inclement weather, mechanical failure, client behavior, or safety concerns.

4. SAFETY POLICY

All Passengers must follow safety instructions provided by the Captain and crew. Failure to comply may result in removal from the vessel without refund. Smoking, illegal drugs, and pets are prohibited on board. Flora-Bama Old S.A.L.T.S., Inc. assumes no responsibility for injuries or accidents resulting from failure to adhere to safety protocols.

5. CHILDREN & MINORS

All minors must be accompanied by a parent or legal guardian. The company reserves the right to deny participation to minors if age, size, or behavior poses a safety risk or cannot be reasonably accommodated.

6. CANCELLATION & REFUND POLICY

Cancellations made within 72 hours of departure are non-refundable. In the event of a company-initiated cancellation (e.g., due to weather or mechanical issues), passengers will be offered the choice to reschedule or receive a credit valid for 12 months. Refunds will not be issued for no-shows or late arrivals.

7. PERSONAL PROPERTY

Passengers may bring reasonable personal belongings (e.g., bags, hats, towels). Coolers, glass containers, and large items are not allowed. Flora-Bama Old S.A.L.T.S., Inc. is not responsible for loss, theft, or damage to personal items.

8. PROHIBITED ITEMS

The following are not permitted on any vessel:

  • Firearms or weapons
  • Explosives or fireworks
  • Compressed gases, including oxygen tanks
  • Illegal drugs or substances

The Captain reserves the right to inspect large bags or containers and to refuse boarding or remove any Passenger violating this policy.

9. ITINERARY CHANGES

The Captain retains full authority to alter the planned route, duration, or destination of any trip in the interest of safety, weather, passenger behavior, or operational necessity.

10. ASSUMPTION OF RISK & WAIVER OF LIABILITY

Participation in boating activities involves inherent risks, including but not limited to slipping, falling, collision, exposure to natural elements, or equipment malfunction. By signing below, Passenger voluntarily assumes all risks—known or unknown—associated with such participation, including the risk of serious injury, illness, or death.

11. RELEASE OF LIABILITY

Releasor—on behalf of themselves, their spouse, children, guests, heirs, representatives, and assigns (collectively, “Releasors”)—hereby releases, waives, and discharges FLORA-BAMA OLD S.A.L.T.S., INC., and its employees, owners, officers, contractors, agents, affiliates, successors, and assigns (“Releasees”) from all liability for injury, loss, or damages—including but not limited to personal injury, death, property damage, or economic loss—arising out of or related to the use, condition, or operation of the vessel, participation in Boating Activities, or breach of this agreement, whether caused by negligence, acts of God, or otherwise.

12. INDEMNIFICATION

Passenger agrees to indemnify, defend, and hold harmless the Releasees from any and all claims, losses, damages, liabilities, costs, or expenses (including attorney’s fees) arising from or related to Passenger’s participation, conduct, or violation of this agreement.

13. DISPUTE RESOLUTION

Any dispute or claim arising under this Agreement shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association. Venue shall be in Escambia County, Florida. Passenger waives the right to trial by jury or participation in a class action.

14. SEVERABILITY

If any provision of this Agreement is deemed unenforceable, the remainder shall remain in full force and effect.

15. ENTIRE AGREEMENT

This document constitutes the entire agreement between the parties. No verbal or written representations not contained herein shall be binding. This waiver remains valid and enforceable for the entire calendar year unless revoked in writing by the company.
