Assumption of Risk, Participation & Acknowledgment

Read carefully. This is not a release of claims based on negligence to the extent prohibited by Hawaiʻi law 

Note: Minor is a person under the age of 18.

1) Activity & Parties

“Activity” means any hike, meet-up, or related event organized by Oahu Hike Club [official entity name] (“OHC”). “Participant” includes anyone attending, hiking, observing, or assisting.

2) Inherent Risks (Disclosure)

I understand hiking and outdoor activities involve inherent risks, including but not limited to:

  • uneven terrain, slips/trips/falls;
  • exposure to cliffs or drop-offs;
  • loose rock, rockfall;
  • stream crossings and potential flash flooding;
  • changing weather, heat/humidity, sun exposure, dehydration, and heat illness;
  • limited cell service and delayed rescue;
  • wildlife or insects;
  • travel on roads and at trailheads;
  • and risks from the actions or inattention of other participants.

These dangers may exist even when leaders use reasonable care and are often beyond their control.

3) Assumption of Inherent Risks

I voluntarily assume the inherent risks of the Activity and accept personal responsibility for my safety, decisions, and equipment. This provision addresses inherent risks only and is not a waiver of claims based on negligence to the extent such waivers are prohibited by Hawaiʻi law, including HRS §663-1.54. 

4) Fitness & Instructions (standing commitment)

I will only participate in an OHC Activity when I am physically fit and properly equipped for the Activity as described in the safety briefing. I will review or receive the day-of briefing (route, hazards, weather, cutoffs, group protocol), and I will follow leader instructions and stay with the group. I understand that leaders may rely on my representations.


5) Conduct & Turn-Back

Leaders may modify the route or turn participants back for safety. I will comply. 

6) Medical Consent

In an emergency, I consent to first aid and activation of 911. I am responsible for my own medical costs.

7) Volunteer Status

I understand OHC leaders are volunteers and not professional guides. 

8) Claims & Indemnity (Narrow)

I understand and agree that I cannot bring claims against OHC, its leaders, or volunteers for injuries or losses that result solely from the inherent risks disclosed in this agreement.

This agreement does not waive claims based on OHC’s negligence to the extent prohibited by Hawaiʻi law.

I will indemnify and hold harmless OHC only for claims, damages, or losses caused by my own actions, omissions, or violations of this agreement.

10) Minors

If the participant is under 18, the parent/guardian must sign below, acknowledging Sections 2–9, accepting full responsibility for the minor’s safety, and consenting to participation and emergency care. 

11) Electronic Signature & Records

By signing electronically, I agree my e-signature has the same effect as a wet signature, and that OHC may retain electronic records (including timestamp, IP address, and email) of this agreement. (HRS ch. 489E.)

12) Governing Law & Venue; Severability

Hawaiʻi law governs. Venue is the First Circuit Court (Honolulu). If any term is invalid, the rest remains in effect.
