I. Acknowledgment of Risk I am 18 years of age or older, and I will be present at or participating in one or more events (co)sponsored by Wildcat Glades Friends Group (WGFG), a non-profit organization whose mission is to protect the area commonly referred to as “Wildcat Park” and the surrounding chert glade environment, habitat, and wildlife by promoting awareness and sustainability; by providing education and recreation space and programs; and by sponsoring nature-based activities. It is my understanding and belief that the event(s) in which I will be participating may take place in an outdoor setting consisting of both natural, undeveloped wildlands and partially maintained parklands. It is therefore my expectation that in participating in WGFG events, I am likely to encounter inconsistent or uneven terrain and potentially dangerous geological features, and that I may therefore be exposed to a variety of safety risks. Knowing these risks, I firmly believe that the benefits of my participation in the WGFG event(s) outweigh the dangers and risks inherent in such an environment, and I take full responsibility for any injury caused or inconvenience suffered resulting from my exposure to naturally-occurring or manmade hazards, including—but not limited to—the following: - Floods, rain and lightning, or prolonged exposure to sunlight and hot or cold temperatures
- Animals and insects capable of stinging, biting, and causing harm to persons, pets, and property
- Poisonous or inedible plants and fungi
- Moving and stagnant water
- Exposed rocks and elevated cliffs,
- Falling natural and manmade objects, such as branches, concrete, rocks, and debris from trees, bridges, and overpasses
- Uneven natural terrain as well as unmaintained, broken, or disturbed dirt and concrete pathways
- Items or substances brought into the area(s) by other persons or by floods, high winds, or erosion.
I hereby assert that my participation in any and all WGFG event(s) is/are voluntary and I knowingly assume the risks. II. Waiver of liability I, in consideration of my right to participate in any and all WGFG event(s), hereby release, waive, discharge, and agree not to sue WGFG, its employees, directors, officers, members, and volunteers from liability from any and all claims regarding personal injury, accidents, illnesses, and damage to property arising from or related to my participation in any and all WGFG event(s). I further agree to indemnify and hold harmless WGFG, its employees, directors, officers, members, and volunteers from any and all claims, actions, suits, costs, expenses, damages and liabilities including attorney fees, arising from or related to my participation in WGFG event(s). III. Consent to Use Image or Likeness I hereby acknowledge that WGFG is a non-profit organization that relies upon a variety of tools in order to carry out its mission, including the completion and submission of grant and other funding applications, accepting charitable contributions from private persons and businesses, hosting and co-sponsoring fundraising and/or educational events, community outreach and event planning via social media application (e.g. Facebook, Instagram, or Twitter) or other web-based platforms, as well as more traditional print-based publications. To that end, I understand that WGFG often photographs, videotapes, or otherwise records its events, including event participants, and I am fully aware that as a participant, I am likely to be photographed with or without my knowledge. I hereby grant the WGFG permission to use my image and likeness contained in any such recording for any reason whatsoever, provided that such use is lawful and related to the organization’s mission and purpose. Additionally, I agree that any and all such recordings shall become the property of the WGFG, to be used in perpetuity, and I hereby waive any and all right(s) that I may have to be compensated for, or notified about, the capture, creation, or publication of such images.
